3333 properly relating thereto.
3434 Legislative Counsel’s Digest:
3535 Existing law sets forth the annual compensation to be paid to county 1
3636 commissioners and certain elected county officers, including district attorneys, 2
3737 sheriffs, county clerks, county assessors, county recorders, county treasurers and 3
3838 public administrators. (NRS 245.043) Section 1 of this bill sets the base amount of 4
3939 compensation of elected county officers for: (1) Fiscal Year 2025-2026 as 3 percent 5
4040 higher than the highest salary of an employee under the supervision of the elected 6
4141 officer that was in effect on January 1, 2025; and (2) each fiscal year thereafter as 3 7
4242 percent higher than the highest salary of an employee under the supervision of the 8
4343 elected officer that has been approved by the board of county commissioners. 9
4444 Section 1 also eliminates the authority of the board of county commissioners to 10
4545 determine not to pay the increased salary for all elected county officers if the 11
4646 financial resources of the county are not available to pay the increased salaries in 12
4747 that fiscal year. 13
4848 Section 1 further: (1) establishes the amount of the annual salaries for county 14
4949 commissioners for Fiscal Year 2025-2026; and (2) provides that for the 5 fiscal 15
5050 years following Fiscal Year 2025-2026, each county commissioner is entitled to an 16
5151 increase in the amount of his or her annual salary of 3 percent per fiscal year. 17
5252 Section 5 of this bill makes a conforming change to provide that the Mayor of 18
5353 Carson City is entitled to the amount of compensation set forth in section 1. 19

5858 Existing law prohibits, with certain exceptions, district attorneys in every 20
5959 county except a county in classification 6 of the table of annual salaries (currently 21
6060 Esmeralda County) from engaging in the private practice of law. (NRS 245.0435, 22
6161 252.060) Section 1 eliminates the table and related classifications and sections 2 23
6262 and 4 of this bill replace references to the classifications to apply the exception to a 24
6363 county whose population is less than 3,000 (currently Esmeralda and Eureka 25

7575 Section 1. NRS 245.043 is hereby amended to read as follows: 1
7676 245.043 1. As used in this section: 2
7777 (a) “County” includes Carson City. 3
7878 (b) “County commissioner” includes the Mayor and supervisors 4
7979 of Carson City. 5
8080 (c) “Elected officer” means a district attorney, sheriff, county 6
8181 clerk, county assessor, county recorder, county treasurer and 7
8282 public administrator. 8
8383 2. Except as otherwise provided in [subsection 5 and by any 9
8484 special law, the] this section, each elected [officers] officer of [the 10

9999 under the supervision of the elected officer on July 1 of that fiscal 25

241241 entitled to the salary that was in effect for that county 19
242242 commissioner during Fiscal Year 2030-2031. 20
243243 4. If the salary of a county commissioner that is effective on 21
244244 June 30, 2025, is more than the amount that the county 22
245245 commissioner would be entitled to pursuant to subsection 3, the 23
246246 county commissioner is entitled to continue to receive the salary 24
247247 that is effective on June 30, 2025, until the amount that results in 25
248248 the calculation required pursuant to subsection 3 for a fiscal year 26
249249 is more than the salary of the county commissioner that is 27
250250 effective on June 30, 2025. 28
251251 5. Any elected officer or county commissioner who is entitled 29
252252 to a salary pursuant to [subsection 2 or 3] this section may elect not 30
253253 to receive any part of the salary to which he or she is entitled 31
254254 pursuant to [subsection 2 or 3, as applicable. 32
255255 5. The increased annual salaries for all elected county officers 33
256256 provided for in subsections 2 and 3 for a fiscal year must not be paid 34
257257 in a fiscal year if the board of county commissioners determines that 35
258258 sufficient financial resources are not available to pay increased 36
259259 annual salaries in that fiscal year and the annual salaries paid for 37
260260 those officers in the immediately preceding fiscal year must 38
261261 continue to be paid. If increased annual salaries are paid in a 39
262262 subsequent fiscal year: 40
263263 (a) Those increased annual salaries must be in the amounts 41
264264 provided for in subsections 2 and 3 starting with the first fiscal year 42
265265 in which increased salaries were not paid because sufficient 43
266266 financial resources were not available. 44

271271 (b) An elected county officer is not entitled to any retroactive 1
272272 payment of the salary increase for any previous fiscal year in which 2
273273 increased annual salaries were not paid.] this section. 3
274274 Sec. 2. NRS 245.0435 is hereby amended to read as follows: 4
275275 245.0435 1. Except as otherwise provided in NRS 252.060, 5
276276 the district attorneys in counties [of classes 1 to 5, inclusive, as 6
277277 classified in the table of annual salaries,] whose population is 3,000 7
278278 or more shall not engage in the private practice of law. 8
279279 2. A district attorney who is permitted to engage in the private 9
280280 practice of law shall disqualify himself or herself from any criminal 10
281281 prosecution of a person who has been involved in a matter related to 11
282282 the district attorney’s private practice of law. 12
283283 3. As used in this section, “private practice of law” by a district 13
284284 attorney means the performance of legal service, for compensation, 14
285285 for any person or organization except the district attorney’s county 15
286286 and any other governmental agency which the district attorney has a 16
287287 statutory duty to serve. 17
288288 Sec. 3. NRS 245.044 is hereby amended to read as follows: 18
289289 245.044 1. On and after July 1, 1973, if an elected county 19
290290 officer has served in his or her office for more than 4 years, the 20
291291 officer is entitled to an additional salary of 2 percent of his or her 21
292292 base salary [for the appropriate fiscal year as provided in subsection 22
293293 2 of NRS 245.043 or his or her annual salary set pursuant to 23
294294 subsection 3 of] as determined pursuant to NRS 245.043 [, as 24
295295 applicable,] for each full calendar year the officer has served in his 25
296296 or her office. 26
297297 2. The additional salary to which an elected county officer is 27
298298 entitled pursuant to subsection 1: 28
299299 (a) Must be calculated on July 1 of each year by multiplying 2 29
300300 percent of the base salary [for the appropriate fiscal year as provided 30
301301 in subsection 2 of NRS 245.043 or the annual salary set pursuant to 31
302302 subsection 3 of] as determined pursuant to NRS 245.043 [, as 32
303303 applicable,] by the number of full calendar years the elected county 33
304304 officer has served in his or her office; and 34
305305 (b) Must not exceed 20 percent of the base salary [for the 35
306306 appropriate fiscal year as provided in subsection 2 of] as determined 36
307307 pursuant to NRS 245.043 . [or the annual salary set pursuant to 37
308308 subsection 3 of NRS 245.043, as applicable.] 38
309309 3. Any elected county officer who is entitled to additional 39
310310 salary pursuant to subsection 1 may elect not to receive the 40
311311 additional salary or any part of the additional salary. 41
312312 4. Service on the Board of Supervisors of Carson City for the 42
313313 initial term which began on July 1, 1969, and ended on the first 43
314314 Monday of January, 1973, shall be deemed to constitute 4 full 44
315315 calendar years of service for the purposes of this section. 45

320320 Sec. 4. NRS 252.060 is hereby amended to read as follows: 1
321321 252.060 1. If the district attorney dies, resigns, is removed, 2
322322 disappears or is permanently disabled from performing the duties of 3
323323 his or her office, the board of county commissioners shall appoint an 4
324324 interim or permanent replacement for the district attorney. 5
325325 2. If the district attorney is temporarily disabled from 6
326326 performing the duties of his or her office: 7
327327 (a) The chief deputy district attorney shall perform the duties of 8
328328 the district attorney while the district attorney is disabled. The chief 9
329329 deputy is entitled to the chief deputy’s regular salary while engaged 10
330330 in the performance of those duties. 11
331331 (b) If there is no chief deputy, the board of county 12
332332 commissioners shall appoint an interim replacement for the district 13
333333 attorney. 14
334334 3. A person appointed as an interim or permanent replacement 15
335335 for the district attorney pursuant to this section must be appointed at 16
336336 the first regularly scheduled meeting of the board of county 17
337337 commissioners following the event giving rise to the appointment. 18
338338 Any such event occurring within the time provided by NRS 241.020 19
339339 for notice of the meeting is an emergency within the meaning of that 20
340340 section. 21
341341 4. A person appointed as an interim replacement for the district 22
342342 attorney pursuant to this section: 23
343343 (a) Is entitled to receive the same salary as the district attorney. 24
344344 (b) Shall: 25
345345 (1) If he or she is appointed pursuant to subsection 1, serve 26
346346 for not more than 60 days or until a permanent replacement is 27
347347 appointed, whichever occurs first. 28
348348 (2) If he or she is appointed pursuant to subsection 2, serve 29
349349 for the duration of the disability of the district attorney or, if the 30
350350 district attorney resigns or is removed from office, for not more than 31
351351 60 days after the resignation or removal or until a permanent 32
352352 replacement is appointed, whichever occurs first. 33
353353 (c) May engage in the private practice of law for not more than 34
354354 60 days after his or her appointment, to the extent permitted by NRS 35
355355 245.0435. The limitation of time provided by this paragraph does 36
356356 not apply in [any] a county [of class 6, as classified in the table of 37
357357 annual salaries contained in NRS 245.043.] whose population is 38
358358 less than 3,000. 39
359359 5. The provisions of NRS 245.170 govern the appointment of a 40
360360 permanent replacement for the district attorney, the length of service 41
361361 of the appointee and the election of a successor. 42
362362 Sec. 5. Section 3.010 of the Charter of Carson City, being 43
363363 chapter 213, Statutes of Nevada 1969, as last amended by chapter 44

370370 Sec. 3.010 Mayor: Duties; salary. 3
371371 1. The Mayor: 4
372372 (a) Shall serve as a member of the Board and preside over 5
373373 its meetings. 6
374374 (b) Is the head of the government of Carson City for all 7
375375 ceremonial purposes and for purposes of military law. 8
376376 (c) Shall perform such emergency duties as may be 9
377377 necessary for the general health, welfare and safety of Carson 10
378378 City. 11
379379 (d) Shall perform such other duties as may be prescribed 12
380380 by ordinance or by the provisions of Nevada Revised Statutes 13
381381 which apply to a mayor or to the chair of a board of county 14
382382 commissioners. 15
383383 2. The Mayor is entitled to an annual salary [of 130 16
384384 percent of the amount specified in] as determined pursuant 17
385385 to NRS 245.043. 18
386386 Sec. 6. Section 3.030 of the Charter of Carson City, being 19
387387 chapter 213, Statutes of Nevada 1969, as last amended by chapter 20
388388 270, Statutes of Nevada 2019, at page 1552, is hereby amended to 21
389389 read as follows: 22
390390 Sec. 3.030 Clerk: Duties; salary. 23
391391 1. The provisions of chapter 246 of NRS apply to the 24
392392 Office of Clerk, except that all deputy clerks other than the 25
393393 two provided for in section 2.330 must be appointed pursuant 26
394394 to and are governed by the regulations for the Merit Personnel 27
395395 System. 28
396396 2. The Clerk shall: 29
397397 (a) Keep the corporate seal and all books and papers 30
398398 belonging to Carson City. 31
399399 (b) Attend all meetings of the Board and keep an accurate 32
400400 journal of its proceedings, including a record of all 33
401401 ordinances, bylaws and resolutions passed or adopted by it. 34
402402 After approval of the journal at each meeting of the Board, 35
403403 the Clerk shall attest the journal after it has been signed by 36
404404 the Mayor. 37
405405 (c) Enter in the journal the results of the vote of the Board 38
406406 upon the passage of ordinances or of any resolution 39
407407 appropriating money, abolishing licenses, or increasing or 40
408408 decreasing the rates of licenses. 41
409409 (d) Act as ex officio Recorder. The provisions of chapter 42
410410 247 of NRS apply to the Clerk while acting in that capacity, 43

437437 1. The provisions of chapter 249 of NRS apply to the 22
438438 Office of Treasurer, except that all deputy treasurers other 23
439439 than the two provided for in section 2.330 must be appointed 24
440440 pursuant to and are governed by the regulations for the Merit 25
441441 Personnel System. 26
442442 2. The Treasurer shall: 27
443443 (a) Invest all surplus money of Carson City. 28
444444 (b) Keep a record of the cash balance and reconcile it 29
445445 with the Controller’s records monthly. 30
446446 (c) Perform such other duties as may be required by: 31
447447 (1) The Board; or 32
448448 (2) The provisions of Nevada Revised Statutes, 33
449449  which apply to county treasurers. 34
450450 (d) Establish and maintain a policy for the investment of 35
451451 the surplus money of Carson City. The Board of Supervisors 36
452452 shall review the policy at least once each year at a public 37
453453 hearing at which public comment is accepted. 38

494494 pursuant to and are governed by the regulations for the Merit 31

497497 (a) Diligently enforce all ordinances of Carson City. 34
498498 (b) Perform such other duties as may be required by: 35

502502 3. The Sheriff is not answerable upon his or her official 39
503503 bond for the conduct of deputies appointed pursuant to the 40
504504 provisions of this Charter, but the Board may require of such 41
505505 deputies such bonds as it may deem proper. 42

523523 (a) All deputy district attorneys serve at the pleasure of 11
524524 the District Attorney; and 12
525525 (b) Deputy district attorneys shall not engage in the 13
526526 private practice of law after July 1, 1979. 14
527527 2. The District Attorney shall perform such other duties 15
528528 as may be required by: 16
529529 (a) The Board; or 17
530530 (b) The provisions of Nevada Revised Statutes, 18
531531  which apply to county district attorneys. 19
532532 3. The District Attorney may, subject to the approval of 20
533533 the Board, contract for the services of special deputy district 21
534534 attorneys. 22
535535 4. The District Attorney is entitled to an annual salary 23
536536 [in the amount specified in] as determined pursuant to 24
537537 NRS 245.043. 25
538538 5. The District Attorney shall not engage in the private 26
539539 practice of law or any other business or occupation that 27
540540 creates a conflict of interest between his or her personal 28
541541 interest in the business or occupation and his or her official 29
542542 duties. 30
543543 Sec. 11. 1. During the 2025-2026 interim, the Joint Interim 31
544544 Standing Committee on Government Affairs shall conduct an 32
545545 interim study concerning county commissions. 33
546546 2. The study must include, without limitation: 34
547547 (a) Whether county commissioners should serve full-time 35
548548 without having any other employment or part-time with the 36
549549 authorization for additional employment; and 37
550550 (b) The appropriate salary for county commissioners. 38
551551 3. The Joint Interim Standing Committee on Government 39
552552 Affairs shall submit a report of the results of the study, including 40
553553 any recommendations for legislation, to the Director of the 41
554554 Legislative Counsel Bureau for transmission to the 84th Session of 42
555555 the Nevada Legislature. 43

560560 Sec. 12. 1. During the 2027-2028 interim, the Joint Interim 1
561561 Standing Committee on Government Affairs shall conduct an 2
562562 interim study concerning county commissions. 3
563563 2. If the Joint Interim Standing Committee on Government 4
564564 Affairs determined that county commissioners should serve full-5
565565 time in the study conducted pursuant to section 11 of this act, the 6
566566 study conducted pursuant to this section must include, without 7
567567 limitation, how to implement the transition to full-time service for 8
568568 county commissioners. 9
569569 3. The Joint Interim Standing Committee on Government 10
570570 Affairs shall submit a report of the results of the study, including 11
571571 any recommendations for legislation, to the Director of the 12
572572 Legislative Counsel Bureau for transmission to the 85th Session of 13
573573 the Nevada Legislature. 14
574574 Sec. 13. The provisions of NRS 354.599 do not apply to any 15
575575 additional expenses of a local government that are related to the 16
576576 provisions of this act. 17
