3333 Existing law provides for the licensure and regulation of contractors by the 1
3434 State Contractors’ Board. (Chapter 624 of NRS) Section 2 of this bill authorizes the 2
3535 Board to issue a restricted license that authorizes a person to perform certain work 3
3636 of a type for which a contractor’s license is required, within the scope and monetary 4
3737 limit of the restricted license, to a person who satisfies certain requirements, which 5
3838 include, without limitation, the requirement to have obtained certain experience, to 6
3939 have passed an entry-level examination required by the Board and, within the year 7
4040 immediately preceding the application, to have completed a course in business 8
4141 counseling or a similar curriculum. Section 2 sets forth certain bonding 9
4242 requirements for applicants for a restricted license and authorizes a person who has 10
4343 held such a license for not less than 2 years to apply for a contractor’s license that is 11
4444 not a restricted license under certain circumstances. Under section 2, the 12
4545 requirements generally applicable to the issuance and renewal of a contractor’s 13
4646 license do not apply to the issuance and renewal of a restricted license, with certain 14
4747 exceptions. Rather, sections 2 and 3 of this bill require the Board, on or before 15
4848 January 1, 2027, to adopt regulations necessary to provide for the issuance and 16
4949 renewal of a restricted license. The regulations are required to, among other things: 17
5050 (1) set forth the type of work in which the holder of a restricted license may engage, 18
5151 which must not be of a type performed by a plumbing, electrical, refrigeration or 19
5252 air-conditioning contractor; and (2) the monetary limit of a restricted license, which 20

6262 SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

6565 Sec. 2. Chapter 624 of NRS is hereby amended by adding 2
6666 thereto a new section to read as follows: 3
6767 1. The Board may issue a restricted license that authorizes 4
6868 the holder to perform certain work for which a contractor’s 5
6969 license is required, within the scope and monetary limit of the 6
7070 restricted license, to a person who submits to the Board: 7
7171 (a) An application containing any information required by the 8
7272 Board by regulation; 9
7373 (b) Any fees required for the issuance of the license 10
7474 established by the Board by regulation; 11
7575 (c) Proof satisfactory to the Board that the person: 12
7676 (1) Has not less than 2 years of experience in a trade, 13
7777 which may include, without limitation: 14
7878 (I) Work experience of a particular type or within a 15
7979 particular classification; 16
8080 (II) Alternative training in a program which is offered 17
8181 at an accredited college or university, apprenticeship or equivalent 18
8282 program accepted by the Board; or 19
8383 (III) Completion of any other program or obtaining any 20
8484 other qualification acceptable to the Board; 21
8585 (2) Completed, within the year immediately preceding the 22
8686 date on which the application is submitted, a course in business 23
8787 counseling or a similar curriculum which consists of a minimum 24
8888 number of hours and any other requirements established by the 25
8989 Board; and 26
9090 (3) Passed an entry-level examination required by the 27
9191 Board. 28
9292 2. Before issuing a restricted license to an applicant, the 29
9393 Board shall require the applicant to file with the Board a surety 30
9494 bond or cash deposit in an amount determined by the Board by 31
9595 regulation, which must be not less than $2,000. 32
9696 3. A restricted license issued pursuant to this section is valid 33
9797 for 2 years and may be renewed in accordance with the procedures 34
9898 for the renewal of a restricted license established by the Board by 35
9999 regulation. A person who has held a restricted license for a period 36
100100 of 2 years or more may, in accordance with the provisions of this 37
101101 chapter and the regulations adopted pursuant thereto governing 38
102102 the issuance of a contractor’s license that is not a restricted 39

107107 license, apply for a contractor’s license that is not a restricted 1
108108 license if the person is not the subject of any open or unresolved 2
109109 complaints. 3
110110 4. Except for the provisions of NRS 624.268 and except as 4
111111 otherwise provided by the regulations adopted by the Board 5
112112 pursuant to subsection 5, the provisions of NRS 624.240 to 6
113113 624.288, inclusive, that apply to a contractor’s license that is not a 7
114114 restricted license do not apply to a restricted license issued 8
115115 pursuant to this section. 9
116116 5. The Board shall adopt regulations necessary to provide for 10
117117 the issuance and renewal of a restricted license pursuant to this 11
118118 section. The regulations must: 12
119119 (a) Set forth the type of work in which the holder of a 13
120120 restricted license may engage, including, without limitation, each 14
121121 classification or subclassification for which a restricted license 15
122122 may be issued. The regulations must not authorize the holder of a 16
123123 restricted license to engage in any work which is of a type 17
124124 described in paragraph (b) or (c) of subsection 6 of NRS 624.031. 18
125125 (b) Establish the monetary limit for a restricted license, which 19
126126 must be $7,000, including labor and materials, or such greater 20
127127 amount that the Board determines to be appropriate. 21
128128 (c) Set forth the required contents of an application for the 22
129129 issuance or renewal of a restricted license and any additional 23
130130 procedures for the issuance and renewal of a restricted license 24
131131 that the Board determines to be necessary. The regulations must 25
132132 not require an applicant for the issuance or renewal of a restricted 26
133133 license to submit a financial statement prepared by a certified 27
134134 public accountant pursuant to NRS 624.263 or 624.264. 28
135135 (d) Establish requirements for the examination required for an 29
136136 applicant for a restricted license and any other qualifications 30
137137 necessary for a person to obtain a restricted license. 31
138138 (e) Establish reasonable fees for an application, for an 32
139139 examination and for a restricted license to be paid by applicants 33
140140 for the issuance or renewal of a restricted license, which must not 34
141141 exceed the amount of the fees set forth in NRS 624.280. 35
142142 (f) Set forth any additional requirements, restrictions or 36
143143 conditions governing restricted licenses that the Board determines 37
144144 to be necessary. 38
145145 Sec. 3. The Board shall adopt the regulations necessary to 39
146146 provide for the issuance and renewal of restricted licenses required 40
147147 by section 2 of this act on or before January 1, 2027. 41
