27	27	Contractors’ Board of a restricted license; setting forth
28	28	various requirements relating to restricted licenses;
29	29	requiring the Board to adopt regulations governing
30	30	restricted licenses; and providing other matters properly
31	31	relating thereto.

33	33	Existing law provides for the licensure and regulation of contractors by the 1
34	34	State Contractors’ Board. (Chapter 624 of NRS) Section 2 of this bill authorizes the 2
35	35	Board to issue a restricted license that authorizes a person to perform certain work 3
36	36	of a type for which a contractor’s license is required, within the scope and monetary 4
37	37	limit of the restricted license, to a person who satisfies certain requirements, which 5
38	38	include, without limitation, the requirement to have obtained certain experience, to 6
39	39	have passed an entry-level examination required by the Board and, within the year 7
40	40	immediately preceding the application, to have completed a course in business 8
41	41	counseling or a similar curriculum. Section 2 sets forth certain bonding 9
42	42	requirements for applicants for a restricted license and authorizes a person who has 10
43	43	held such a license for not less than 2 years to apply for a contractor’s license that is 11
44	44	not a restricted license under certain circumstances. Under section 2, the 12
45	45	requirements generally applicable to the issuance and renewal of a contractor’s 13
46	46	license do not apply to the issuance and renewal of a restricted license, with certain 14
47	47	exceptions. Rather, sections 2 and 3 of this bill require the Board, on or before 15
48	48	January 1, 2027, to adopt regulations necessary to provide for the issuance and 16
49	49	renewal of a restricted license. The regulations are required to, among other things: 17
50	50	(1) set forth the type of work in which the holder of a restricted license may engage, 18
51	51	which must not be of a type performed by a plumbing, electrical, refrigeration or 19
52	52	air-conditioning contractor; and (2) the monetary limit of a restricted license, which 20

57	57	must be $7,000, including labor and materials, or such greater amount that the 21
58	58	Board determines to be appropriate. 22

61	61	THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
62	62	SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

65	65	Sec. 2. Chapter 624 of NRS is hereby amended by adding 2
66	66	thereto a new section to read as follows: 3
67	67	1. The Board may issue a restricted license that authorizes 4
68	68	the holder to perform certain work for which a contractor’s 5
69	69	license is required, within the scope and monetary limit of the 6
70	70	restricted license, to a person who submits to the Board: 7
71	71	(a) An application containing any information required by the 8
72	72	Board by regulation; 9
73	73	(b) Any fees required for the issuance of the license 10
74	74	established by the Board by regulation; 11
75	75	(c) Proof satisfactory to the Board that the person: 12
76	76	(1) Has not less than 2 years of experience in a trade, 13
77	77	which may include, without limitation: 14
78	78	(I) Work experience of a particular type or within a 15
79	79	particular classification; 16
80	80	(II) Alternative training in a program which is offered 17
81	81	at an accredited college or university, apprenticeship or equivalent 18
82	82	program accepted by the Board; or 19
83	83	(III) Completion of any other program or obtaining any 20
84	84	other qualification acceptable to the Board; 21
85	85	(2) Completed, within the year immediately preceding the 22
86	86	date on which the application is submitted, a course in business 23
87	87	counseling or a similar curriculum which consists of a minimum 24
88	88	number of hours and any other requirements established by the 25
89	89	Board; and 26
90	90	(3) Passed an entry-level examination required by the 27
91	91	Board. 28
92	92	2. Before issuing a restricted license to an applicant, the 29
93	93	Board shall require the applicant to file with the Board a surety 30
94	94	bond or cash deposit in an amount determined by the Board by 31
95	95	regulation, which must be not less than $2,000. 32
96	96	3. A restricted license issued pursuant to this section is valid 33
97	97	for 2 years and may be renewed in accordance with the procedures 34
98	98	for the renewal of a restricted license established by the Board by 35
99	99	regulation. A person who has held a restricted license for a period 36
100	100	of 2 years or more may, in accordance with the provisions of this 37
101	101	chapter and the regulations adopted pursuant thereto governing 38
102	102	the issuance of a contractor’s license that is not a restricted 39

107	107	license, apply for a contractor’s license that is not a restricted 1
108	108	license if the person is not the subject of any open or unresolved 2
109	109	complaints. 3
110	110	4. Except for the provisions of NRS 624.268 and except as 4
111	111	otherwise provided by the regulations adopted by the Board 5
112	112	pursuant to subsection 5, the provisions of NRS 624.240 to 6
113	113	624.288, inclusive, that apply to a contractor’s license that is not a 7
114	114	restricted license do not apply to a restricted license issued 8
115	115	pursuant to this section. 9
116	116	5. The Board shall adopt regulations necessary to provide for 10
117	117	the issuance and renewal of a restricted license pursuant to this 11
118	118	section. The regulations must: 12
119	119	(a) Set forth the type of work in which the holder of a 13
120	120	restricted license may engage, including, without limitation, each 14
121	121	classification or subclassification for which a restricted license 15
122	122	may be issued. The regulations must not authorize the holder of a 16
123	123	restricted license to engage in any work which is of a type 17
124	124	described in paragraph (b) or (c) of subsection 6 of NRS 624.031. 18
125	125	(b) Establish the monetary limit for a restricted license, which 19
126	126	must be $7,000, including labor and materials, or such greater 20
127	127	amount that the Board determines to be appropriate. 21
128	128	(c) Set forth the required contents of an application for the 22
129	129	issuance or renewal of a restricted license and any additional 23
130	130	procedures for the issuance and renewal of a restricted license 24
131	131	that the Board determines to be necessary. The regulations must 25
132	132	not require an applicant for the issuance or renewal of a restricted 26
133	133	license to submit a financial statement prepared by a certified 27
134	134	public accountant pursuant to NRS 624.263 or 624.264. 28
135	135	(d) Establish requirements for the examination required for an 29
136	136	applicant for a restricted license and any other qualifications 30
137	137	necessary for a person to obtain a restricted license. 31
138	138	(e) Establish reasonable fees for an application, for an 32
139	139	examination and for a restricted license to be paid by applicants 33
140	140	for the issuance or renewal of a restricted license, which must not 34
141	141	exceed the amount of the fees set forth in NRS 624.280. 35
142	142	(f) Set forth any additional requirements, restrictions or 36
143	143	conditions governing restricted licenses that the Board determines 37
144	144	to be necessary. 38
145	145	Sec. 3. The Board shall adopt the regulations necessary to 39
146	146	provide for the issuance and renewal of restricted licenses required 40
147	147	by section 2 of this act on or before January 1, 2027. 41
