2727 AN ACT relating to state financial administration; providing for the
2828 nonreversion, retention and use of certain unobligated
2929 balances remaining at the end of a fiscal year by a state
3030 agency within the Executive Department of the State
3131 Government; and providing other matters properly
3232 relating thereto.
3333 Legislative Counsel’s Digest:
3434 Under existing law, with certain exceptions, any balance that is remaining at 1
3535 the end of a fiscal year in a budget account of a state agency reverts to the source of 2
3636 funding that supports the state agency. (NRS 353.253) This bill provides, with 3
3737 certain exceptions, for the nonreversion and retention by an agency of the 4
3838 Executive Department of the State Government of 50 percent of the remaining 5
3939 balances of appropriations made from the State General Fund or the State Highway 6
4040 Fund for the operation of the state agency that are not obligated for expenditure on 7
4141 or before the end of the fiscal year. This bill authorizes such a state agency to use 8
4242 that retained money for any purpose within the responsibilities of the state agency. 9

4545 THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
4646 SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

4848 Section 1. Chapter 353 of NRS is hereby amended by adding 1
4949 thereto a new section to read as follows: 2
5050 1. Except as otherwise provided in subsection 2, 50 percent of 3
5151 all remaining balances of appropriations made from the State 4
5252 General Fund or the State Highway Fund for the operation of a 5

5757 state agency that are not obligated for expenditure on or before 1
5858 June 30 of that fiscal year: 2
5959 (a) Must not revert to the State General Fund or State 3
6060 Highway Fund, as applicable; and 4
6161 (b) Must be retained by the state agency and used for any 5
6262 purpose within the responsibilities of the state agency. 6
6363 2. The provisions of subsection 1 do not apply to a 7
6464 supplemental or one-time appropriation. 8
6565 3. As used in this section, “state agency” means an agency, 9
6666 board, bureau, commission, department, division, office or any 10
6767 other unit of the Executive Department of the State Government 11
6868 except those boards listed in NRS 353.005. 12
6969 Sec. 2. NRS 353.253 is hereby amended to read as follows: 13
7070 353.253 1. Every agency, department and institution of the 14
7171 State of Nevada shall deposit all money received from the Federal 15
7272 Government, the counties or other sources, in the State Treasury as 16
7373 provided in NRS 353.250 unless otherwise provided by law. These 17
7474 deposits must be made to work program accounts directly or to other 18
7575 budget accounts. 19
7676 2. Except as otherwise provided in section 1 of this act and 20
7777 except for the balance in any proprietary fund and appropriated or 21
7878 authorized reserves, any balance remaining at the end of a fiscal 22
7979 year in a budget account of an agency, department or institution of 23
8080 the State of Nevada, whether or not authorized for expenditure 24
8181 under a work program, reverts to the source of funding supporting 25
8282 the agency, department or institution. If that source of funding is 26
8383 federal money or a source of revenue the use of which is restricted 27
8484 by statute, then the balance may be authorized for expenditure under 28
8585 a work program for the subsequent fiscal year in accordance with 29
8686 the provisions of this chapter. 30
8787 3. No provision of this chapter may be construed to authorize 31
8888 or direct the transfer, expenditure or reversion of any money 32
8989 received from the Federal Government contrary to the conditions 33
9090 upon which that money was received or to any federal law or 34
9191 regulation respecting the accountability therefor. 35
9292 4. This section does not apply to the Board of Regents of the 36
9393 University of Nevada and the Nevada State Museum. 37
9494 Sec. 3. NRS 353.255 is hereby amended to read as follows: 38
9595 353.255 1. [The] Except as otherwise provided in section 1 39
9696 of this act, the sums appropriated for the various branches of 40
9797 expenditure in the public service of the State shall be applied solely 41
9898 to the objects for which they are respectively made, and for no 42
9999 others. 43
100100 2. Any person violating the provisions of subsection 1 shall be 44
101101 punished by a fine of not more than $500. 45
