27	27	AN ACT relating to state financial administration; providing for the
28	28	nonreversion, retention and use of certain unobligated
29	29	balances remaining at the end of a fiscal year by a state
30	30	agency within the Executive Department of the State
31	31	Government; and providing other matters properly
32	32	relating thereto.
33	33	Legislative Counsel’s Digest:
34	34	Under existing law, with certain exceptions, any balance that is remaining at 1
35	35	the end of a fiscal year in a budget account of a state agency reverts to the source of 2
36	36	funding that supports the state agency. (NRS 353.253) This bill provides, with 3
37	37	certain exceptions, for the nonreversion and retention by an agency of the 4
38	38	Executive Department of the State Government of 50 percent of the remaining 5
39	39	balances of appropriations made from the State General Fund or the State Highway 6
40	40	Fund for the operation of the state agency that are not obligated for expenditure on 7
41	41	or before the end of the fiscal year. This bill authorizes such a state agency to use 8
42	42	that retained money for any purpose within the responsibilities of the state agency. 9

45	45	THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
46	46	SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

48	48	Section 1. Chapter 353 of NRS is hereby amended by adding 1
49	49	thereto a new section to read as follows: 2
50	50	1. Except as otherwise provided in subsection 2, 50 percent of 3
51	51	all remaining balances of appropriations made from the State 4
52	52	General Fund or the State Highway Fund for the operation of a 5

57	57	state agency that are not obligated for expenditure on or before 1
58	58	June 30 of that fiscal year: 2
59	59	(a) Must not revert to the State General Fund or State 3
60	60	Highway Fund, as applicable; and 4
61	61	(b) Must be retained by the state agency and used for any 5
62	62	purpose within the responsibilities of the state agency. 6
63	63	2. The provisions of subsection 1 do not apply to a 7
64	64	supplemental or one-time appropriation. 8
65	65	3. As used in this section, “state agency” means an agency, 9
66	66	board, bureau, commission, department, division, office or any 10
67	67	other unit of the Executive Department of the State Government 11
68	68	except those boards listed in NRS 353.005. 12
69	69	Sec. 2. NRS 353.253 is hereby amended to read as follows: 13
70	70	353.253 1. Every agency, department and institution of the 14
71	71	State of Nevada shall deposit all money received from the Federal 15
72	72	Government, the counties or other sources, in the State Treasury as 16
73	73	provided in NRS 353.250 unless otherwise provided by law. These 17
74	74	deposits must be made to work program accounts directly or to other 18
75	75	budget accounts. 19
76	76	2. Except as otherwise provided in section 1 of this act and 20
77	77	except for the balance in any proprietary fund and appropriated or 21
78	78	authorized reserves, any balance remaining at the end of a fiscal 22
79	79	year in a budget account of an agency, department or institution of 23
80	80	the State of Nevada, whether or not authorized for expenditure 24
81	81	under a work program, reverts to the source of funding supporting 25
82	82	the agency, department or institution. If that source of funding is 26
83	83	federal money or a source of revenue the use of which is restricted 27
84	84	by statute, then the balance may be authorized for expenditure under 28
85	85	a work program for the subsequent fiscal year in accordance with 29
86	86	the provisions of this chapter. 30
87	87	3. No provision of this chapter may be construed to authorize 31
88	88	or direct the transfer, expenditure or reversion of any money 32
89	89	received from the Federal Government contrary to the conditions 33
90	90	upon which that money was received or to any federal law or 34
91	91	regulation respecting the accountability therefor. 35
92	92	4. This section does not apply to the Board of Regents of the 36
93	93	University of Nevada and the Nevada State Museum. 37
94	94	Sec. 3. NRS 353.255 is hereby amended to read as follows: 38
95	95	353.255 1. [The] Except as otherwise provided in section 1 39
96	96	of this act, the sums appropriated for the various branches of 40
97	97	expenditure in the public service of the State shall be applied solely 41
98	98	to the objects for which they are respectively made, and for no 42
99	99	others. 43
100	100	2. Any person violating the provisions of subsection 1 shall be 44
101	101	punished by a fine of not more than $500. 45
