AN ACT relating to governmental purchasing; eliminating the 
prohibition against a local government entering into 
certain contracts pursuant to a solicitation by certain other 
governmental entities or cooperative purchasing 
organizations if a contractor’s license is required for any 
portion of the work to be performed; and providing other 
matters properly relating thereto. 
Legislative Counsel’s Digest: 
 Existing law prohibits a local government from entering into a contract 1 
pursuant to a solicitation by certain other governmental entities located within this 2 
State or another state or a cooperative purchasing organization if a contractor’s 3 
license is required for any portion of the work to be performed under the contract. 4 
(NRS 332.195) This bill removes the prohibition against local governments 5 
entering into such contracts.  6 
 
 
THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN 
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS: 
 
 Section 1.  NRS 332.195 is hereby amended to read as follows: 1 
 332.195 1.  [Except as otherwise provided in this section, a] A 2 
governing body or its authorized representative may enter into a 3 
contract pursuant to a solicitation by: 4 
 (a) A governmental entity located within or outside this State 5 
with the authorization of the contracting vendor. The originally 6

contracting local government is not liable for the obligations of the 1 
governmental entity which enters into a contract in response to the 2 
solicitation in accordance with this paragraph. 3 
 (b) The State of Nevada or another state with the authorization 4 
of the contracting vendor. The State of Nevada or other state is not 5 
liable for the obligations of the local government which enters into a 6 
contract in response to the solicitation in accordance with this 7 
paragraph. 8 
 (c) A cooperative purchasing organization. A cooperative 9 
purchasing organization is not liable for the obligations of the local 10 
government which enters into a contract in response to the 11 
solicitation in accordance with this paragraph. 12 
 2.  [A governing body or its authorized representative shall not 13 
enter into a contract pursuant to this section if a contractor’s license 14 
issued pursuant to chapter 624 of NRS is required for any portion of 15 
the work to be performed under the contract. 16 
 3.] As used in this section, “cooperative purchasing 17 
organization” means an organization that implements a cooperative 18 
arrangement to agree to aggregate demand on behalf of public 19 
entities for the purpose of obtaining lower prices from certain 20 
suppliers to reduce the costs of procurement. 21
