S.B. 374 - *SB374* SENATE BILL NO. 374–SENATOR TAYLOR MARCH 17, 2025 ____________ Referred to Committee on Education SUMMARY—Revises provisions relating to education. CONTAINS UNFUNDED MANDATE (§ 1) (NOT REQUESTED BY AFFECTED LOCAL GOVERNMENT) ~ EXPLANATION – Matter in bolded italics is new; matter between brackets [omitted material] is material to be omitted. AN ACT relating to education; requiring the board of trustees of each school district to provide each staff member with professional development training concerning the discipline and behavior of pupils; requiring each public school to collect and report certain data on the number of pupils assigned to a temporary alternative placement; and providing other matters properly relating thereto. Legislative Counsel’s Digest: Existing law requires each public school to: (1) each quarter, collect data on the 1 discipline of pupils that includes, without limitation, information on the number of 2 expulsions and suspensions of pupils in the school; and (2) annually report such 3 data to certain entities. (NRS 392.462) Section 3 of this bill additionally requires 4 each public school to collect data on the number of pupils assigned to a temporary 5 alternative placement, thereby requiring such data to be included in the annual 6 report on the discipline of pupils prepared by each public school. 7 Existing law requires the board of trustees of each school district and the 8 governing body of each charter school to ensure that the teachers and 9 administrators employed by the school district or charter school have access to 10 high-quality, ongoing professional development training. (NRS 391A.370) Section 11 1 of this bill requires the board of trustees of each school district to, not later than 12 30 days after the first day of instruction of each school year, and such additional 13 times throughout the year thereafter as the board of trustees deems appropriate, 14 provide professional development training to each staff member concerning, 15 without limitation, the discipline and behavior of pupils. Section 1 further requires 16 the board of trustees of each school district to prepare and submit to the Legislature 17 or the Joint Interim Standing Committee on Education an annual report that 18 describes: (1) any such professional development training provided during the 19 – 2 – - *SB374* previous year; (2) how the school district ensured such training was provided; and 20 (3) each date on which such training was provided. Section 1 additionally requires 21 the Department of Education to coordinate with each regional training program for 22 the professional development of teachers and administrators to develop curricula 23 for such training that the board of trustees of a school district may to use to satisfy 24 the requirements of section 1. Section 2 of this bill makes a conforming change to 25 apply the existing definition of “professional development training” to the 26 provisions of section 1. 27 THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS: Section 1. Chapter 391A of NRS is hereby amended by 1 adding thereto a new section to read as follows: 2 1. The board of trustees of each school district shall ensure 3 that, not later than 30 days after the first day of instruction of each 4 school year, and such additional times throughout the year 5 thereafter as the board of trustees deems appropriate, each staff 6 member, including, without limitation, each teacher, administrator 7 and education support professional, receives professional 8 development training in best practices for: 9 (a) Addressing the behavior of pupils; 10 (b) Fostering a positive school climate; 11 (c) Positive behavioral interventions and support; 12 (d) Conflict resolution; 13 (e) De-escalation techniques; and 14 (f) Classroom management. 15 2. The Department shall coordinate with each regional 16 training program to develop curricula for professional 17 development training that the board of trustees of a school district 18 may use to provide the professional development training required 19 pursuant to subsection 1. 20 3. The board of trustees of each school district shall, on or 21 before August 1 of each year, prepare a report that describes any 22 professional development training provided pursuant to subsection 23 1 during the previous year, how the school district ensured that 24 such professional development training was provided and each 25 date on which such professional development training was 26 provided, and submit the report to the Director of the Legislative 27 Counsel Bureau for transmittal to: 28 (a) In even-numbered years, the next regular session of the 29 Legislature; and 30 (b) In odd-numbered years, the Joint Interim Standing 31 Committee on Education. 32 4. As used in this section: 33 – 3 – - *SB374* (a) “Education support professional” has the meaning 1 ascribed to it in NRS 391.488. 2 (b) “Regional training program” has the meaning ascribed to 3 it in NRS 391A.105. 4 (c) “School climate” means the basis of which to measure the 5 relationships between pupils and the parents or legal guardians of 6 pupils and educational personnel, the cultural and linguistic 7 competence of instructional materials and educational personnel, 8 the emotional and physical safety of pupils and educational 9 personnel and the social, emotional and academic development of 10 pupils and educational personnel. 11 Sec. 2. NRS 391A.345 is hereby amended to read as follows: 12 391A.345 As used in NRS 391A.345 to 391A.385, inclusive, 13 and section 1 of this act, unless the context otherwise requires, 14 “professional development training” has the meaning ascribed to 15 “professional development” in 20 U.S.C. § 7801(42). 16 Sec. 3. NRS 392.462 is hereby amended to read as follows: 17 392.462 Each public school shall quarterly collect data on the 18 discipline of pupils and the plans developed pursuant to NRS 19 392.4644. Such data must include, without limitation, the number of 20 expulsions and suspensions of pupils, the number of pupils 21 assigned to a temporary alternative placement pursuant to NRS 22 392.4645, the number of staff positions in the school that are vacant, 23 the average class size for each grade in the school, the 24 implementation of each plan, the training received by teachers and 25 administrators regarding each plan, the number of placements of 26 pupils in another school and the ratio of pupils to school counselors, 27 school psychologists and school social workers. Such data must be 28 disaggregated into the subgroups of pupils listed in subsection 2 of 29 NRS 385A.250 and the types of offense. The principal of each 30 public school shall: 31 1. Review the data and take appropriate action; 32 2. On or before August 1 of each year, report the data to: 33 (a) The board of trustees of the school district or the governing 34 body of the public school, as applicable; 35 (b) The superintendent of the school district or the 36 administrative head of the charter school or university school for 37 profoundly gifted pupils, as applicable; 38 (c) The Joint Interim Standing Committee on Education; 39 (d) The Superintendent of Public Instruction; and 40 (e) The Department; and 41 3. To the extent allowed by the Family Educational Rights and 42 Privacy Act of 1974, 20 U.S.C. § 1232g, post the data on the 43 Internet website maintained by the public school. 44 – 4 – - *SB374* Sec. 4. The provisions of NRS 218D.380 do not apply to any 1 provision of this act which adds or revises a requirement to submit a 2 report to the Legislature. 3 Sec. 5. The provisions of NRS 354.599 do not apply to any 4 additional expenses of a local government that are related to the 5 provisions of this act. 6 Sec. 6.
