AN ACT relating to recreation; creating the Transit-to-Trails Task Force; prescribing the membership and duties of the Task Force; requiring the Task Force to submit certain reports; and providing other matters properly relating thereto. Legislative Counsel’s Digest: Existing law creates the Division of Outdoor Recreation of the State 1 Department of Conservation and Natural Resources and requires the Administrator 2 of the Division to perform certain duties relating to outdoor recreation in this State. 3 (NRS 407A.540, 407A.570) Section 2 of this bill creates the Transit-to-Trails Task 4 Force and sets forth the membership of the Task Force. Section 3 of this bill 5 requires the Task Force to: (1) identify high-priority areas for a program to expand 6 access to outdoor recreation areas in this State using public transit; and (2) identify 7 and apply for grants of money from the Federal Government and private entities for 8 the expansion of public transit that runs to outdoor recreation areas in this State. 9 Section 4 of this bill applies certain definitions relating to the Division to the 10 provisions of sections 2 and 3. 11 Section 5 of this bill requires the Task Force to prepare and submit a written 12 report describing the activities, findings and conclusions of the Task Force and any 13 recommendations for legislation by August 31 of each even-numbered year. 14 – 2 – - *SB405_R1* THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS: Section 1. Chapter 407A of NRS is hereby amended by 1 adding thereto the provisions set forth as sections 2 and 3 of this act. 2 Sec. 2. 1. The Transit-to-Trails Task Force is hereby 3 created. 4 2. The Task Force consists of the following members 5 appointed by the Legislative Commission: 6 (a) One member who represents the Office of the Governor; 7 (b) One member who represents a law enforcement agency in 8 this State; 9 (c) One member who represents a regional transportation 10 commission in a county whose population is 100,000 or more but 11 less than 700,000; 12 (d) One member who represents a regional transportation 13 commission in a county whose population is 700,000 or more; 14 (e) One member who represents a county whose population is 15 less than 100,000; 16 (f) One member who represents the Division; 17 (g) Two members who represent the public and who have an 18 interest in outdoor recreation and transportation; 19 (h) One member who represents an advocacy group relating to 20 transportation and outdoor recreation; 21 (i) One member who represents the Tahoe Transportation 22 District; 23 (j) One member who represents the United States Bureau of 24 Land Management; 25 (k) One member who represents the United States Forest 26 Service; and 27 (l) One member who represents the United States National 28 Park Service. 29 3. The members of the Task Force shall serve a term of 4 30 years. A member may be reappointed to the Task Force and any 31 vacancy must be filled in the same manner as the original 32 appointment. 33 4. The members of the Task Force serve without 34 compensation and are not entitled to the per diem or travel 35 expenses provided to state officers generally. 36 5. The Task Force shall meet on a quarterly basis. At the first 37 meeting of the Task Force, the members of the Task Force shall 38 elect a Chair and Vice Chair from among its members. 39 6. A majority of the members of the Task Force constitutes a 40 quorum for the transaction of business, and a majority of those 41 – 3 – - *SB405_R1* members present at any meeting is sufficient for any official 1 action taken by the Task Force. 2 Sec. 3. The Transit-to-Trails Task Force created by section 2 3 of this act shall: 4 1. Identify high-priority areas for a program to provide or 5 expand access to outdoor recreation areas in this State, using 6 public transit, based on the need for transportation infrastructure 7 to improve access to outdoor recreation for communities with 8 limited transportation or parking, with public safety concerns or 9 where the weather of the community makes public transportation 10 a better option for outdoor recreation access; and 11 2. Identify and apply for grants of money from the Federal 12 Government and private entities for the expansion of public transit 13 that runs to outdoor recreation areas in this State, including, 14 without limitation, in the high-priority areas identified pursuant to 15 subsection 1. 16 Sec. 4. NRS 407A.500 is hereby amended to read as follows: 17 407A.500 As used in NRS 407A.500 to 407A.620, inclusive, 18 and sections 2 and 3 of this act, unless the context otherwise 19 requires, the words and terms defined in NRS 407A.510, 407A.515 20 and 407A.525 have the meanings ascribed to them in those sections. 21 Sec. 5. The Transit-to-Trails Task Force created by section 2 22 of this act shall prepare and submit a written report to the Director 23 of the Legislative Counsel Bureau for transmittal to the Joint Interim 24 Standing Committee on Growth and Infrastructure describing the 25 activities, findings and conclusions of the Task Force and any 26 recommendations for legislation not later than August 31 of each 27 even-numbered year. 28 Sec. 6. The provisions of NRS 218D.380 do not apply to any 29 provision of this act which adds or revises a requirement to submit a 30 report to the Legislature. 31 Sec. 7. This act becomes effective on July 1, 2025, and expires 32 by limitation on October 1, 2030. 33 H
