AN ACT relating to domestic violence; revising provisions relating to programs for the treatment of persons who commit domestic violence; and providing other matters properly relating thereto. Legislative Counsel’s Digest: Existing law requires the Division of Public and Behavioral Health of the 1 Department of Health and Human Services to: (1) adopt regulations governing the 2 evaluation, certification and monitoring of programs for the treatment of persons 3 who commit domestic violence; and (2) evaluate, certify and monitor programs for 4 the treatment of persons who commit domestic violence in accordance with those 5 regulations. (NRS 439.258) Under section 1 of this bill, the regulations adopted by 6 the Division must include provisions requiring that the curriculum and instructional 7 materials used in a program be evidence-based. 8 THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS: Section 1. NRS 439.258 is hereby amended to read as follows: 1 439.258 1. The Division shall evaluate, certify and monitor 2 programs for the treatment of persons who commit domestic 3 violence in accordance with the regulations adopted pursuant to 4 subsection 2. 5 – 2 – - *SB84* 2. The Division shall adopt regulations governing the 1 evaluation, certification and monitoring of programs for the 2 treatment of persons who commit domestic violence. 3 3. The regulations adopted pursuant to subsection 2 must 4 include, without limitation, provisions: 5 (a) Requiring that a program: 6 (1) Include a module specific to victim safety; and 7 (2) Be based on: 8 (I) Evidence-based practices; and 9 (II) The assessment of a program participant by a 10 supervisor of treatment or provider of treatment; [and] 11 (b) Requiring that the curriculum and instructional materials 12 used in a program be evidence-based; and 13 (c) Allowing a program that is located in another state to 14 become certified in this State to provide treatment to persons who: 15 (1) Reside in this State; and 16 (2) Are ordered by a court in this State to participate in a 17 program for the treatment of persons who commit domestic 18 violence. 19 Sec. 2. 1. This section becomes effective upon passage and 20 approval. 21 2. Section 1 of this act becomes effective: 22 (a) Upon passage and approval for the purpose of adopting any 23 regulations and performing any other preparatory administrative 24 tasks that are necessary to carry out the provisions of this act; and 25 (b) On October 1, 2025, for all other purposes. 26 H
