Allows for the use of an affirmation of truth of statement in an administrative proceeding; repeals certain provisions needed to make a technical correction in law.
Enacts the beekeeping rights act to prohibit homeowners' associations from adopting or enforcing any rules or regulations that would effectively prohibit, or impose unreasonable limitations on, the installation or use of an apiary.
Prohibits settlement agreements in any claim involving sexual harassment or any other form of discrimination prohibited by law from containing any condition that requires the complainant to pay the defendant liquidated damages in the event that the plaintiff violates any nondisclosure agreement included in such settlement agreement.
Provides that no bill which increases, extends, imposes or revives any tax, fee, assessment, surcharge or any other such levy or collection, be passed or become a law, except by the assent of two-thirds of the members elected to each branch of the legislature voting separately; makes an exception for any bill which results from the passage of a home rule message.
Requires approval by 2/3 vote of membership of the senate and assembly voting separately to increase or decrease any tax rate, impose a new state tax, extend or delete existing state tax.
Allows an affirmation by any person, wherever made, subscribed and affirmed by that person to be true under the penalties of perjury, to be used in a civil action in New York in lieu of and with the same force and effect as an affidavit.
Prohibits the governor from granting himself or herself or any person involved with furthering the illegal conduct of the governor a reprieve, commutation or pardon.
Prohibits utility companies from certain replevin actions; provides that the continued provision of all or any part of gas, electric and steam service to all residential and commercial customers without unreasonable qualifications or lengthy delays is necessary for the preservation of the health and general welfare and is in the public interest; establishes the seizure of electric, gas, or steam meters is against the public interest.
Provides that in order to present the claim for unjust conviction and imprisonment, claimant must establish by documentary evidence that: he or she has been convicted of one or more felonies or misdemeanors against the state and subsequently sentenced to a term of imprisonment, and has served all or any part of the sentence; and he or she has had the one or more felonies and misdemeanors dismissed with prejudice following serving all or part of the sentence; and his or her claim is not time-barred.
Establishes the paired testing program and compliance fee to determine if any real estate broker, real estate salesperson or employee or agent thereof is using unlawful discriminatory practices; creates the paired testing program fund.
