Establishes confirmatory adoptions allowing adoption and parentage judgements for a child with more than two parents; recognizes functional parents as legal parents; allows "de facto parents" to get a court order confirming their parentage; grants all legal parents standing to seek visitation or custody of their children.
Restructures the selection process for judges of the housing part of the civil court of the city of New York; relates to designating petitions for candidates for the office of judge of the housing part of the civil court of the city of New York; makes conforming changes; abolishes the advisory council for the housing part of the civil court of the city of New York; repeals provisions relating to the selection and appointment of housing court judges.
Extends the revocation period for real estate brokers and real estate salespersons from one year to three years; includes the licnese revocation and suspension history of real estate brokers or real estate salespersons on the data.ny.gov website.
Prohibits a court from granting, denying or deciding a petition for guardianship, custody or visitation solely on the allegation or basis that a parent or guardian is providing or facilitating the provision of gender affirming care to the subject child.
Prohibits bad faith assertions of patent infringement where the person making the assertion is not engaging, has not engaged or attempted to engage, or does not intend to engage in the bona fide use of the patent in the production, development, licensing or commercialization of goods or services.
Prohibits assertions of copyright infringement where the amount demanded by the person making the assertion was not made in good faith or the claim or assertion of copyright infringement is based on copyrighted material that is in the public domain or for which the asserter lacks the authority to enforce the copyright.
Requires a stay of certain foreclosure proceedings where the mortgagor has applied for coverage under the New York state homeowner assistance fund or any local program administering federal emergency mortgage assistance program funds; allows such foreclosure proceedings to proceed against a mortgagor who has caused significant damage to the property.
Provides that all residential leases shall contain a detailed description of tenant's statutory rights including among others, warranty of habitability, willful violation of lease, right to participate in tenants' associations, no eviction for good faith complaint, utility payment offset and sublet rights; grants tenant the right to install extra locks; sets out landlord obligations with respect to heating and oil delivery.
Establishes a time limit on utilizing third-party practice of no later than twenty days unless consented to by the parties or upon written application of any of the parties to the main action or upon the consent of the court such time is extended.
