Establishes a blue ribbon commission on fair competition in the outdoor recreation industry to examine, evaluate and make recommendations regarding methods to promote fair competition in the outdoor recreation industry; provides such commission shall consist of eleven appointed members; requires a report to the governor and legislature on or before December 31, 2024.
Enacts the "Niagara parks reinvestment act"; requires fifty percent of parking revenue generated at state parks in the county of Niagara to be deposited in the Niagara parks reinvestment fund; establishes the Niagara parks reinvestment fund.
Relates to the authenticity, attribution and authorship of fine works of art; defines the term authenticator and stipulates that in a civil action regarding authenticity, the claimant must specify with particularity the facts and prove the elements by clear and convincing evidence; entitles the authenticator to recover reasonable attorneys' fees and expenses if he/she prevails.
Provides annual vehicular access for New York state's active volunteer firefighters and active volunteer ambulance workers and their immediate family at any state park or recreational facility.
Authorizes the commissioner of parks, recreation and historic preservation to issue rules, regulations and programs necessary to allow the presence and behavior of dogs conducive to the characteristics of each state park; requires the installation of dog waste stations; requires dogs to be under the direct supervision and control at all times by the owner or custodian of such dogs; makes related provisions.
Enacts into law components of legislation that relate to live event ticket sales; institutes civil penalties for utilizing ticket purchasing software; institutes new penalties for second offenses for licensees and for any person, firm, corporation or entity who is made aware of the utilization of ticket purchasing software and does not notify the attorney general of such utilization (Part A); establishes an annual professional reseller renewal fee; requires professional ticket resellers to provide their New York state ticket reseller license number as a condition of utilizing an online resale marketplace to resell tickets (Part B); provides criteria for when a purchaser may obtain a full refund of the amount paid for a ticket; permits a refund when a purchaser cannot attend an event due to a medical necessity (Part C); relates to resale requirements for tickets; requires that if a licensee or other ticket reseller doesn't have possession of the ticket, then they shall have a written contract to obtain the offered ticket at a certain price from a person or entity in possession of the ticket or from a person or entity who has a contractual right to obtain such ticket, and tickets to the event have been placed on sale by the venue or entity hosting the event or its authorized agent before the licensee or reseller can advertise the sale of the tickets (Part D); relates to unlawful charges in connection with tickets; permits reasonable charges for costs actually rendered or otherwise in connection to customer support, technological and software infrastructure, and actual operational costs for sales away from the box office; defines terms (Part E); relates to the availability of tickets for sale to the general public; defines a term (Part F); reduces the minimum seating capacity requirement for a professional sports organization membership pass to over thirteen thousand five hundred seats in a venue or stadium (Part G); prohibits exclusivity clauses in contracts between operators of places of entertainment and primary ticket vendors (Part H); relates to the resale of tickets included in a subscription or season ticket package (Part I).
Relates to equipment to be carried on certain vessels; requires a whistle to be carried on all vessels, rowboats, canoes and kayaks; requires fire extinguishers and use of engine cut-off switches on certain vessels.
Directs the commissioner of the office of parks, recreation and historic preservation to conduct a legal review for the re-designation of Donald J. Trump State Park, in Putnam and Westchester counties to a new name.
Requires the empire state plaza art commission to provide recommendations to the governor on renaming the agency buildings located at the empire state plaza; establishes considerations to include places, persons and matters of significance to the state that reflect state values; requires the governor to choose the new agency building names within 60 days after the commission's recommendation.
Authorizes the commissioner of parks, recreation and historic preservation to permit composting facilities at state parks when such facility does not harm the natural environment or integrity of the park, and provided that such facilities shall comply with relevant codes, rules and regulations relating to composting facilities.
