Enacts the New York child data privacy protection act to prevent the exploitation of children's data; requires data controllers to assess the impact of its products on children for review by the bureau of internet and technology; bans certain data collection and targeted advertising.
Relates to the processing of evidence related to sexual offenses and the inclusion of such results in the state DNA identification index; requires evidence of sexual offenses to be collected and forwarded to any forensic DNA laboratory for testing within the established time frame.
Establishes a commission to study and report on the potential implementation of legislation, rules and regulations for an open internet for New Yorkers.
Prohibits the use of a victim's DNA collected from sexual offense evidence kits from being added to the state DNA identification index or other databases or being used in certain actions.
Relates to the establishment of a single computerized state DNA identification index; requires municipalities to expunge any DNA record stored in a municipal DNA identification index.
Provides for the protection of health information; establishes requirements for communications to individuals about their health information; requires either written consent or a designated necessary purpose for the processing of an individual's health information.
Relates to the maintenance of a database on intellectual property generated by state employees or developed through state-funded research which shall include, at a minimum, a brief description of the intellectual property and up-to-date contact information for each item.
Requires certain businesses to offer identity theft prevention and mitigation services in the case of a security breach; exempts businesses under financial hardship.
Directs the office of information technology services to contract with a private entity to conduct an examination and evaluation of New York state's information technology infrastructure, data use and management, policies, procedures and operational processes.
Requires certain disclosures by a developer of virtual tokens in advertisements involving such virtual tokens; provides restrictions concerning advertising.
Requires social media companies to post terms of service for each social media platform owned or operated by the company in a manner reasonably designed to inform all users of the social media platform of the existence and contents of the terms of service; requires social media companies to submit to the attorney general certain terms of service reports; provides remedies for violations.
Directs the office of information technology services to establish a gun violence alert system to be added to the emergency alert notification system, known as alert.ny.gov or NY-Alert to provide real-time warnings and emergency information pertaining to gun violence to citizens of New York State.
Establishes the internet media freedom task force to study the practices and policies of social media companies that allow the posting of third-party content by users, as well as other issues relating to dissemination of such content, including but not limited to, forms of censorship employed by social media companies.
