MEEKS, BRONSON, MAMDANI -- read once and referred to the Committee on Transportation AN ACT to amend the transportation law and the executive law, in relation to the development of a scannable code that links to trans- lations of work zone and truss type construction signs The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Section 22 of the transportation law, as added by chapter 2 223 of the laws of 2005, is amended to read as follows: 3 § 22. Work zone safety and enforcement. 1. The department shall, in 4 cooperation with the superintendent of state police, the commissioner of 5 motor vehicles, the chairman of the New York state thruway authority, 6 local law enforcement agencies and representatives for contractors and 7 laborers, develop and implement rules and regulations for the increased 8 safety of work zones. Such rules and regulations shall include, but 9 shall not be limited to, a police presence at all major active work 10 zones as defined by rules and regulations set forth by the commissioner, 11 the use of radar speed display signs at all major active work zones as 12 defined by rules and regulations set forth by the commissioner, and a 13 system for reviewing work zone safety and design for all work zones 14 under the jurisdiction of the department. 15 2. (a) The department shall, in cooperation with the secretary of 16 state and any other state or local agencies the commissioner shall deem 17 necessary, develop a scannable code to be displayed on work zone signs, 18 and signs notifying of truss type construction in compliance with 19 section three hundred eighty-two-a of the executive law. Such code 20 shall, when scanned with a smartphone, tablet, or other similar device, 21 open an internet link on such device that (i) determines the user's 22 location; and (ii) displays the contents of such sign in the most 23 commonly spoken language other than English and Spanish within a ten- 24 mile radius of such user. LBD04526-01-3A. 2079 2 1 (b) Beginning one year from the effective date of this subdivision, 2 all work zone signs used in an area where there is residential housing 3 and/or a reasonable expectation of pedestrians shall be printed in 4 English and in Spanish, and shall contain the scannable code developed 5 pursuant to paragraph (a) of this subdivision. 6 (c) For the purposes of this subdivision "user" shall mean the opera- 7 tor of a smartphone, tablet, or other similar device. 8 § 2. Subdivision 1 of section 382-a of the executive law, as added by 9 chapter 119 of the laws of 2001, is amended to read as follows: 10 1. All commercial and industrial structures that utilize truss type 11 construction shall be marked by a sign or symbol in a manner sufficient 12 to warn persons conducting fire control and other emergency operations 13 of the existence of truss construction in the structure. Beginning one 14 year from the effective date of the act which amended this subdivision, 15 such signs shall be printed in English and in Spanish, and shall contain 16 the scannable code created pursuant to subdivision two of section twen- 17 ty-two of the transportation law. 18 § 3. This act shall take effect one year after it shall have become a 19 law. Effective immediately, the addition, amendment and/or repeal of any 20 rule or regulation necessary for the implementation of this act on its 21 effective date are authorized to be made and completed on or before such 22 effective date.
