HYNDMAN -- read once and referred to the Commit- tee on Health AN ACT to amend the social services law, in relation to fiscal interme- diary services The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Subparagraph (vi) of paragraph (b) of subdivision 4-a of 2 section 365-f of the social services law, as amended by section 1 of 3 part LL of chapter 57 of the laws of 2021, is amended to read as 4 follows: 5 (vi) the commissioner is authorized to either reoffer contracts or 6 utilize the previous offer, to ensure that all provisions of this 7 section are met. The commissioner shall reoffer, to ensure that all 8 provisions of this section are two fiscal intermediaries headquartered 9 in each county with a population of two hundred thousand or more. 10 § 2. Section 365-f of the social services law is amended by adding two 11 new subdivisions 4-e and 4-f to read as follows: 12 4-e. Following the selection of contractors pursuant to this section 13 and in order to ensure regional choice and experience serving individ- 14 uals with developmental disabilities, the commissioner shall provide no 15 less than five additional awards to entities which meet the following 16 criteria: 17 (a) are a not-for-profit entity; 18 (b) have been established as fiscal intermediaries prior to January 19 first, two thousand twelve and have been continuously providing such 20 services for eligible individuals pursuant to this section; and 21 (c) are currently authorized, funded, approved and certified to deliv- 22 er state plan and homes and community-based waiver supports and services 23 to individuals with developmental disabilities by the office for people 24 with developmental disabilities. Following the selection of contractors pursuant to this section 2 and in order to ensure regional choice and experience serving racial and 3 ethnic minorities, the commissioner shall provide no less than five 4 additional awards to entities which meet the following criteria: 5 (a) are a not-for-profit entity; 6 (b) have been established as fiscal intermediaries prior to January 7 first, two thousand twelve and have been continuously providing such 8 services for eligible individuals pursuant to this section; and 9 (c) primarily provide services to racial and ethnic minority residents 10 or persons who have recently become American citizens in such person's 11 native language. 12 § 3. This act shall take effect immediately and shall be deemed to 13 have been in full force and effect on January 1, 2023.
