  STATE OF NEW YORK ________________________________________________________________________ 2675 2023-2024 Regular Sessions  IN ASSEMBLY January 26, 2023 ___________ Introduced by M. of A. VANEL -- read once and referred to the Committee on Governmental Operations AN ACT in relation to establishing a commission to study and report on the potential implementation of legislation, rules and regulations for an open internet for New Yorkers; and providing for the repeal of such provisions upon expiration thereof The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. A ten-member commission is hereby established to assess the 2 potential implementation of legislation, rules and regulations for an 3 open internet for New Yorkers. 4 § 2. The commission shall be comprised of: 5 (a) two members appointed by the temporary president of the senate; 6 (b) two members appointed by the speaker of the assembly; 7 (c) two members appointed by the governor; 8 (d) two members appointed by the chief information officer of the 9 office of information technology services; 10 (e) one member appointed by the minority leader of the senate; and 11 (f) one member appointed by the minority leader of the assembly. 12 § 3. The commission shall provide a report to the governor, the speak- 13 er of the assembly and the temporary president of the senate on or 14 before January 1, 2025. Such report shall include: 15 (a) any impacts in the New York state internet market of the Federal 16 Communications Commission's repeal of open internet regulations; 17 (b) an analysis of potential legislation, rules and regulations to 18 advance an open internet in New York state; 19 (c) any incidences of throttling, blocking, or paid prioritization 20 that have occurred by the internet service providers serving New York 21 state; and EXPLANATION--Matter in italics (underscored) is new; matter in brackets [ ] is old law to be omitted.  A. 2675 2 1 (d) recommendations regarding the advancement of an open internet, 2 along with legislative and regulatory proposals as the commission deems 3 necessary to implement such recommendations. 4 § 4. This act shall take effect immediately and shall expire and be 5 deemed repealed January 1, 2025.
