RAJKUMAR, ALVAREZ, REYES -- read once and referred to the Committee on Transportation -- committee discharged, bill amended, ordered reprinted as amended and recommitted to said committee AN ACT to amend the transportation law, in relation to requiring certain for-hire vehicles to install and maintain an interior rear-facing video camera The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Section 140 of the transportation law is amended by adding 2 a new subdivision 11 to read as follows: 3 11. a. All commercial motor vehicles that transport passengers for- 4 hire with a seating capacity of six passengers or less in a city with a 5 population of one million or more, except for a black car, limousine, or 6 luxury limousine, as such terms are defined in section 19-502 of the 7 administrative code of the city of New York, or as otherwise defined in 8 local law, shall be required to install and maintain an interior rear- 9 facing video camera. Such video camera shall be recording at all times 10 the vehicle is being operated for the purpose of for-hire transporta- 11 tion, and at minimum shall: 12 (i) capture and record any operator or passenger who enters or exits 13 the vehicle; 14 (ii) store, at a minimum, the sixty most recent hours of operation; 15 and 16 (iii) have the ability to transmit data or otherwise provide access to 17 local law enforcement and the local regulatory authority which has 18 licensed the motor vehicle for for-hire transportation services. 19 b. The requirement set forth in this subdivision shall not limit the 20 brand or provider of video cameras which can be utilized to comply with 21 this subdivision. Rather, any commercial video camera that meets the EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. The requirement set forth in this subdivision shall supersede any 4 local regulation in a city with a population of one million or more of 5 video cameras installed in commercial motor vehicles engaged in the 6 for-hire transport of passengers. 7 § 2. This act shall take effect on the ninetieth day after it shall 8 have become a law.
