KELLES -- read once and referred to the Committee on Alcoholism and Drug Abuse -- committee discharged, bill amended, ordered reprinted as amended and recommitted to said committee AN ACT to amend the mental hygiene law, in relation to the payment for services at addiction treatment centers operated by the office of addiction services and supports The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Section 25.17 of the mental hygiene law, as amended by 2 section 12 of part G of chapter 56 of the laws of 2013, is amended to 3 read as follows: 4 § 25.17 Fees for services. 5 Voluntary agencies and programs operated by local governmental units 6 funded in whole or in part by the office shall establish, subject to the 7 approval of the office, fee schedules for substance use disorder and/or 8 compulsive gambling services, including for such services at addiction 9 treatment centers operated by the office of addiction services and 10 supports, not specifically covered by the rates established pursuant to 11 article twenty-eight of the public health law or title two of article 12 five of the social services law. Such fees shall be charged for 13 substance use disorder and/or compulsive gambling services furnished to 14 persons who are financially able to pay the same, provided, that such 15 services shall not be refused to any person because of [his] their 16 inability to pay therefor. 17 § 2. This act shall take effect on the ninetieth day after it shall 18 have become a law. Effective immediately, the addition, amendment and/or 19 repeal of any rule or regulation necessary for the implementation of 20 this act on its effective date are authorized to be made and completed 21 on or before such effective date.
