DiPIETRO -- read once and referred to the Commit- tee on Transportation AN ACT to amend the parks, recreation and historic preservation law, in relation to the use of snowmobiles in the town of Concord, county of Erie The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Section 25.05 of the parks, recreation and historic preser- 2 vation law is amended by adding a new subdivision 1-e to read as 3 follows: 4 1-e. Notwithstanding the provisions of subdivision one of this 5 section, the commissioner, with the concurrence of the commissioner of 6 transportation, may designate for snowmobile use a trail within the 7 right-of-way of state route two hundred nineteen in the town of Concord 8 in Erie county between reference marker 219-5314-1121 and 219-5314-1127. 9 The commissioner's designation shall include conditions, developed in 10 consultation with the commissioner of transportation, on the use of such 11 trail by snowmobiles to provide for the safe use of state route two 12 hundred nineteen and the safe operation of snowmobiles on the trail. 13 Designations made under this subdivision shall be effective for no long- 14 er than a period of one year and may be renewed with the concurrence of 15 the commissioner of transportation. 16 § 2.
