BENEDETTO -- read once and referred to the Committee on Transportation -- committee discharged, bill amended, ordered reprinted as amended and recommitted to said committee AN ACT to amend the vehicle and traffic law, in relation to proper registration of abandoned vehicles The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Paragraph (b) of subdivision 3 of section 1224 of the vehi- 2 cle and traffic law, as amended by chapter 726 of the laws of 1983, is 3 amended to read as follows: 4 (b) Such local authority shall notify the last owner, if known, that 5 the vehicle in question has been recovered as an abandoned vehicle and 6 that, if unclaimed, it will be sold at public auction or by bid after 7 ten days from the date such notice was given. If the agency described in 8 paragraph (a) of this subdivision also notifies such local authority 9 that a lien or mortgage exists such notice shall also be sent to the 10 lienholder or mortgagee. The commissioner shall prescribe the methods 11 of giving notice. Any person claiming such vehicle shall be required to 12 pay the costs of removal and storage of such vehicle. In a city having a 13 population of one million or more, if an abandoned vehicle is found to 14 have a false or fraudulent certificate of registration or number plate, 15 any person claiming such vehicle shall, in order to claim such vehicle, 16 provide proof to such local authority that such vehicle is now lawfully 17 registered pursuant to section four hundred one of this chapter and 18 proof of insurance in order for a person to claim such vehicle that has 19 been recovered as an abandoned vehicle and to remove such vehicle from 20 the lot where it is being stored. 21 § 2.
