STAVISKY -- read twice and ordered printed, and when printed to be committed to the Committee on Transportation AN ACT to amend the vehicle and traffic law, in relation to the display- ing of a bus driver's credentials while he or she is on duty and the review of his or her files The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. The vehicle and traffic law is amended by adding a new 2 section 509-dd to read as follows: 3 § 509-dd. Passenger motor carrier information. The commissioner of 4 transportation, in consultation with the commissioner, shall establish 5 requirements for motor carriers required to obtain approval to operate 6 as a common or contract carrier of passengers by motor vehicle from the 7 commissioner of transportation for purposes of establishing conspicuous 8 display of valid operating authority, inspection information, and driver 9 qualifications at locations where such persons or entities perform 10 contract or common carrier services with such motor vehicles and within 11 any motor vehicle used to provide such services. For the purposes of 12 this section, "motor carriers" shall not include buses referenced in 13 paragraph (a) or (e) of subdivision one of section five hundred nine-a 14 of this article. 15 § 2. Subdivision 1 of section 509-m of the vehicle and traffic law, as 16 amended by chapter 12 of the laws of 2020, is amended and a new subdivi- 17 sion 9 is added to read as follows: 18 1. At least once [every three years] annually, review the bus driver 19 files of each motor carrier, provided, however, that the commissioner 20 may review such bus driver files at his discretion at any other time 21 during regular business hours. Provided, however, that the commissioner 22 shall review at least annually the bus driver files of each driver 23 employed by a motor carrier who operates an altered motor vehicle 24 commonly referred to as a "stretch limousine" designed to carry nine or EXPLANATION--Matter in italics (underscored) is new; matter in brackets [ ] is old law to be omitted. S. 1817 2 1 more passengers including the driver pursuant to operating authority 2 issued by the commissioner of transportation, and annually verify wheth- 3 er each such driver holds a valid driver's license valid for the opera- 4 tion of such altered motor vehicle. 5 9. Issue new credentials, designed for public display, which shall 6 serve as proof that a bus driver is qualified under sections five 7 hundred nine-b and five hundred nine-dd of this article. Such creden- 8 tials shall be re-issued annually. 9 § 3. This act shall take effect on the first of April next succeeding 10 the date on which it shall have become a law. Effective immediately, the 11 addition, amendment and/or repeal of any rule or regulation necessary 12 for the implementation of this act on its effective date are authorized 13 to be made and completed on or before such effective date.
