RAMOS -- read twice and ordered printed, and when printed to be committed to the Committee on Transportation AN ACT to amend the public authorities law, in relation to requiring the metropolitan transportation authority to publish certain information pertaining to capital project data for projects that are committed for construction on the capital program dashboard The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Subparagraphs (vii) and (viii) and the closing paragraph of 2 paragraph (d) of subdivision 2-a of section 1269-b of the public author- 3 ities law, as added by section 1 of part LLL of chapter 58 of the laws 4 of 2022, is amended and three new subparagraphs (ix), (x), (xi) and an 5 undesignated paragraph are added to read as follows: 6 (vii) budget information including the original budget at the time of 7 project commitment when scope and budget are defined, all amendments, 8 the current budget and planned annual allocations; [and] 9 (viii) a schedule for project delivery including original, amended and 10 current start and completion dates as projects develop at each phase[.]; 11 (ix) a listing of all contract numbers, vendors, and contractors asso- 12 ciated with the project; 13 (x) all sources of funding for the project; and 14 (xi) coding regarding whether the project is related to accessibility 15 or resiliency. 16 For the purposes of this paragraph, sources of funding shall be speci- 17 fied as from the state of New York, the federal government, the city of 18 New York, or any other relevant source. Funding from the state of New 19 York shall further specify whether it has been obtained from the central 20 business district tolling lockbox as established by section five hundred 21 fifty-three-j of this chapter or any successor fund or account provided 22 by law. S. 3545 2 1 with Disabilities Act of 1990, as amended, and corresponding guidelines. 2 Resiliency shall have the same meaning as defined by the authority in 3 its twenty-year needs assessment released in two thousand twenty-three 4 as required by subdivision c of section twelve hundred sixty-nine-c of 5 this title. 6 The status of projects shall be provided and state the current phase 7 of the project, such as planning, design, construction or completion, 8 and shall state how far the project has progressed as measured in 9 percentage by expenditure. The dashboard shall measure progress based on 10 original budgets at the time of project commitment when scope and budget 11 are defined. At a minimum, all changes to planned budgets of greater 12 than ten percent, significant project scope or a three month or more 13 change in schedule shall be provided in narrative form and describe the 14 reason for each change or amendment. The dashboard shall include a glos- 15 sary or data dictionary which contains plain language descriptions of 16 the data, including individual project data, and any other information 17 provided on the dashboard. The authority shall provide a definition of 18 resiliency in the glossary or data dictionary. The dashboard shall be 19 updated, at a minimum, on a quarterly basis, and all data fields avail- 20 able on the dashboard shall be made available for download on the 21 authority's website in a single tabular data file in a common, machine 22 readable format. Capital dashboard data shall also be made available on 23 the data.ny.gov website or such other successor website maintained by, 24 or on behalf of, the state, as deemed appropriate by the New York state 25 office of information technology services under executive order number 26 ninety-five of two thousand thirteen, or any successor agency or order. 27 § 2. This act shall take effect immediately.
