LANZA -- read twice and ordered printed, and when printed to be committed to the Committee on Codes AN ACT to amend the penal law, in relation to establishing an offense for fraud relating to voter registration forms The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. The penal law is amended by adding a new section 190.90 to 2 read as follows: 3 § 190.90 Fraud relating to voter registration forms. 4 1. A person shall be guilty of fraud relating to voter registration 5 forms if they knowingly distribute a voter registration form, by mail, 6 electronically, or by any other means to a voter or applicant, with 7 knowledge that the boxes or circles for party enrollment on such form 8 have been marked by a person other than such voter or applicant before 9 such form is distributed. 10 2. Notwithstanding any contrary provision of this article or of any 11 other law, any person convicted under this section shall be punished by 12 a fine of one thousand dollars for each such offense in addition to any 13 other applicable penalties. 14 3. For the purposes of this section, the term "person" includes a 15 natural person, a party organization, an association, board, any corpo- 16 ration, whether municipal, stock or non-stock, court, governmental agen- 17 cy, authority or subdivision, partnership or other firm and the state. 18 Fraud relating to voter registration forms is a class B misdemeanor. 19 § 2.
