Amends elements of the felony murder rule to require that defendant directly causes death or be an accomplice with the intent to cause death; permits vacating conviction or resentencing of defendants convicted of felony murder; amends maximum sentence; permits the defense of duress for victims of domestic violence; requires reporting of certain crime statistics and information.
Relates to the right of defendants in misdemeanor or felony cases to have such matter appear before a judge or justice admitted to practice law in New York; creates an automatic right to have a case reassigned to an attorney judge.
Provides that in order to present the claim for unjust conviction and imprisonment, claimant must establish by documentary evidence that: they has been convicted of one or more felonies or misdemeanors against the state and subsequently sentenced to a term of imprisonment, and has served all or any part of the sentence; and they have had the one or more felonies and misdemeanors dismissed with prejudice following serving all or part of the sentence; and their claim is not time-barred.
Prohibits recording of the entrance or exit of a school ground or the entrance or exit to a property that contains school grounds within its boundaries.
Directs the commissioner of education, in conjunction with the superintendent of state police and the commissioner of the division of homeland security and emergency services, to establish standards for the security and safety of school grounds.
Establishes a legislative commission on article V conventions of the states to represent the state of New York at article V conventions; provides penalties for commissioners who exceed their scope of authority and individuals who interfere with the duties of a commissioner.
