KENNEDY, SALAZAR -- read twice and ordered printed, and when printed to be committed to the Committee on Finance AN ACT to amend chapter 53 of the laws of 2019, enacting the aid to localities budget, in relation to state HIV rental assistance funding The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Section 1 of chapter 53 of the laws of 2019, enacting the 2 aid to localities budget, is amended by repealing the items hereinbelow 3 set forth in brackets and by adding to such section the other items 4 underscored in this section. 5 DEPARTMENT OF FAMILY ASSISTANCE 6 OFFICE OF TEMPORARY AND DISABILITY ASSISTANCE 7 AID TO LOCALITIES 2019-20 8 Notwithstanding any inconsistent provision 9 of law, for state reimbursement of a 10 program in social services districts with 11 a population over five million for shelter 12 supplements in order to prevent eviction 13 and to address homelessness in accordance 14 with a plan approved by the office of 15 temporary and disability assistance and 16 the director of the budget. Expenditures 17 for such shelter supplements for individ- 18 uals and families in receipt of safety net 19 assistance shall be reimbursed at 29 20 percent by this appropriation. Expendi- 21 tures for any other such shelter supple- 22 ments shall be fully reimbursed by this EXPLANATION--Matter in italics (underscored) is new; matter in brackets [ ] is old law to be omitted. Such reimbursement shall 2 constitute total reimbursement for activ- 3 ities funded herein for state fiscal year 4 2019-20 (52221) ............................. 15,000,000 5 For services and expenses of a voluntary 6 initiative in social services districts 7 with a population of five million or fewer 8 to fund emergency shelter allowance 9 payments in excess of those promulgated by 10 the office of temporary and disability 11 assistance, but not exceeding an amount 12 reasonably approximate to 100 percent of 13 fair market rent, and to reimburse 100 14 percent of the additional rental costs 15 determined based on limiting such person's 16 earned and/or unearned income contribution 17 to 30 percent, which the district deter- 18 mines are necessary to establish or main- 19 tain independent living arrangements among 20 persons eligible for or in receipt of 21 public assistance who are living with 22 medically diagnosed HIV infection as 23 defined by the AIDS institute of the State 24 department of health and who are homeless 25 or facing homelessness and for whom no 26 viable and less costly alternative to 27 housing is available; provided, however, 28 that funds appropriated herein may only be 29 used for such purposes if the cost of such 30 allowances are not eligible for reimburse- 31 ment under medical assistance or other 32 programs, and further provided that such 33 payments shall not be part of the standard 34 of need pursuant to section 131-a of the 35 social services law. Such funds may be 36 provided by the commissioner of the office 37 of temporary and disability assistance to 38 participating social services districts 39 with a population of five million or fewer 40 in accordance with a plan submitted by 41 such social services district and approved 42 by the office of temporary and disability 43 assistance and the director of the budget. 44 Up to $1,000,000 may be made available, 45 without local participation, to selected 46 social services districts that submit an 47 approved plan, which includes one or more 48 agreements with medicaid managed care 49 organizations, performing provider 50 systems, and/or other third-party payors 51 to provide dollar for dollar matching 52 funding and an agreement with a qualified 53 not-for-profit entity to provide services, 54 including case management, to those 55 persons in receipt of the emergency shel- 56 ter allowance in excess of that promulgat- 

 S. 5720 3 1 ed by the office of temporary and disabil- 2 ity assistance and the 30 percent income 3 contribution identified in this paragraph. 4 To the extent that savings are realized 5 over the course of the designated period 6 set forth in the plan, at the end of the 7 period set forth in the plan, the savings 8 shall be shared among the social services 9 district and the medicaid managed care 10 organization, performing provider system, 11 and/or other third-party payor [shall 12 continue to fully fund such ongoing excess 13 shelter allowance payments and services 14 for the participating public assistance 15 recipients] to cover administrative costs 16 of the initiative and to continue to 17 provide ongoing funding to ensure housing 18 stability for persons eligible for or in 19 receipt of public assistance who are 20 living with medically diagnosed HIV 21 infection .................................... 5,000,000 22 For services and expenses related to the 23 continuation of the empire state poverty 24 reduction initiative ......................... 4,500,000 25 For services and expenses of Ibero-American 26 Action League ................................... 50,000 27 For services and expenses of Mohawk Valley 28 Latino Association .............................. 50,000 29 For services and expenses of Family Resi- 30 dences and Essential Enterprises, Inc ........... 50,000 31 For services and expenses of Centro Civico 32 of Amsterdam .................................... 50,000 33 For services and expenses of Spanish Action 34 League in Onondaga .............................. 50,000 35 For services and expenses of Hempstead 36 Hispanic Civic Association ...................... 50,000 37 For services and expenses of the Hispanic 38 Federation ...................................... 50,000 39 § 2.
