  STATE OF NEW YORK ________________________________________________________________________ 8407  IN SENATE January 29, 2024 ___________ Introduced by Sen. SCARCELLA-SPANTON -- read twice and ordered printed, and when printed to be committed to the Committee on Insurance AN ACT to amend the insurance law, in relation to requiring postpartum pelvic floor physical therapy be covered under maternity care The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Item (ii) of subparagraph (A) of paragraph 10 of subsection 2 (i) of section 3216 of the insurance law, as added by chapter 56 of the 3 laws of 1996, is amended to read as follows: 4 (ii) Maternity care coverage shall also include, at minimum, parent 5 education, assistance and training in breast or bottle feeding, postpar- 6 tum pelvic floor physical therapy, and the performance of any necessary 7 maternal and newborn clinical assessments. 8 § 2. Item (ii) of subparagraph (A) of paragraph 5 of subsection (k) of 9 section 3221 of the insurance law, as added by chapter 56 of the laws of 10 1996, is amended to read as follows: 11 (ii) Maternity care coverage shall also include, at minimum, parent 12 education, assistance and training in breast or bottle feeding, postpar- 13 tum pelvic floor physical therapy, and the performance of any necessary 14 maternal and newborn clinical assessments. 15 § 3. Subparagraph (B) of paragraph 1 of subsection (c) of section 4303 16 of the insurance law, as amended by chapter 661 of the laws of 1997, is 17 amended to read as follows: 18 (B) Maternity care coverage also shall include, at minimum, parent 19 education, assistance and training in breast or bottle feeding, postpar- 20 tum pelvic floor physical therapy, and the performance of any necessary 21 maternal and newborn clinical assessments. 22 § 4. This act shall take effect one year after it shall have become a 23 law and shall apply to policies or contracts issued, renewed, modified, 24 altered, or amended on or after such date. Effective immediately, the 25 addition, amendment and/or repeal of any rule or regulation necessary 26 for the implementation of this act on its effective date are authorized 27 to be made and completed on or before such date.
