  STATE OF NEW YORK ________________________________________________________________________ 9648  IN SENATE May 16, 2024 ___________ Introduced by Sen. CHU -- read twice and ordered printed, and when printed to be committed to the Committee on Libraries AN ACT to amend the education law, in relation to a registry for histor- ic libraries and museums The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. The education law is amended by adding a new section 115 to 2 read as follows: 3 § 115. Registry for historic libraries and museums. 1. The department 4 shall establish and maintain a registry of historic libraries and muse- 5 ums in the state and maintain an online registry which includes the name 6 and address of each library or museum that has operated for over fifty 7 years and that has been accepted into the registry. 8 2. A historic library or museum must first be nominated by an assembly 9 member, senator, the governor or the lieutenant governor. Nominations 10 are limited to ten per elected official per term. 11 3. (a) After a library or museum is nominated pursuant to subdivision 12 two of this section, such library or museum shall submit a completed 13 application for final approval. Such application shall be created by the 14 department and shall include the following requirements: 15 (i) The library or museum shall have operated in the state for fifty 16 or more years with no break in operations exceeding two years. The 17 library or museum may have operated in more than one location, but shall 18 have operated in the same municipality for a minimum of fifty years; and 19 (ii) The library or museum has contributed to the municipality's 20 history and/or identity of such municipality. 21 (b) The department, upon receipt of a nomination and accompanying 22 application, shall make a determination of whether the applicant meets 23 the requirements necessary to be accepted into such registry. The nomi- 24 nating elected official and the applicant shall be notified by the 25 department if such applicant is not accepted into the registry and shall 26 explain the reasons for the determination of ineligibility. 27 § 2. This act shall take effect on the one hundred twentieth day after 28 it shall have become a law.
