  STATE OF NEW YORK ________________________________________________________________________ 9659  IN SENATE May 16, 2024 ___________ Introduced by Sen. ASHBY -- read twice and ordered printed, and when printed to be committed to the Committee on Finance AN ACT to amend the state finance law, in relation to establishing a local government salt brine equipment grant program; and making an appropriation therefor The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Subdivision 10 of section 54 of the state finance law is 2 amended by adding a new paragraph w to read as follows: 3 w. Local government salt brine equipment grant program. (1) For the 4 purposes of this paragraph, the term "total expenditures" shall mean the 5 total expenditures for a municipality as reported to the state comp- 6 troller. 7 (2) Within the annual amounts appropriated therefor, the secretary of 8 state may award matching grants to municipalities to cover costs associ- 9 ated with purchasing salt brine equipment. 10 (3) The maximum cumulative grant award for a local government capital 11 improvement grant shall not exceed thirty thousand dollars. 12 (4) Matching funds equal to at least fifty percent of the total cost 13 of the capital improvement project under the grant approved by the 14 department of state shall be required to receive a local government salt 15 brine equipment grant. 16 (5) Within one week of the receipt of an application, the department 17 of state shall review the application to ensure the applicant has filed 18 the correct application, and to determine if any required sections of 19 the application require additional information. Within one business day 20 of determining an applicant has filed an incorrect application, or 21 determining an application requires additional information, the depart- 22 ment shall so notify the applicant. Applicants shall be permitted to 23 amend an application found to be missing information, and such applica- 24 tion shall be reconsidered for approval if it is amended by the applica- 25 tion deadline. If an applicant has submitted an incorrect application, 26 the applicant may submit the correct application to the appropriate 27 program by the deadline to such program for consideration.  S. 9659 2 1 circumstances shall this subparagraph be deemed to require the extension 2 of any application deadline established by the department, nor shall it 3 obligate the department to conduct a substantive review of the contents 4 of any application outside of the procedures established by the depart- 5 ment for the purposes of maintaining the competitive integrity of the 6 grant program. 7 § 2. The sum of six million dollars ($6,000,000), or so much thereof 8 as may be necessary, is hereby appropriated to the department of state 9 out of any moneys in the state treasury in the general fund to the cred- 10 it of the local government salt brine equipment grant program, not other 11 wise appropriated, and made immediately available, for the purpose of 12 carrying out the provisions of this act. Such moneys shall be payable on 13 the audit and warrant of the comptroller on vouchers certified or 14 approved by the commissioner of the department of environmental conser- 15 vation in the manner prescribed by law. 16 § 3. This act shall take effect immediately.
