PHEFFER AMATO -- read once and referred to the Committee on Transportation AN ACT to amend the vehicle and traffic law, in relation to offering installment payment plans as an option for persons with violations of toll collection regulations The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Subdivision 4-d of section 510 of the vehicle and traffic 2 law, as added by chapter 379 of the laws of 1992, is amended to read as 3 follows: 4 4-d. Suspension of registration for failure to [answer or] pay penal- 5 ties under an installment payment plan with respect to certain 6 violations. Upon the receipt of a notification from a court or an admin- 7 istrative tribunal that an owner of a motor vehicle failed to appear on 8 the return date or dates or a new subsequent adjourned date or dates or 9 failed to pay any penalty imposed by a court or failed to comply with 10 the rules and regulations of an administrative tribunal following entry 11 of a final decision or decisions, in response to five or more notices of 12 liability or other process, issued within an eighteen month period 13 charging such owner with a violation of toll collection regulations in 14 accordance with the provisions of section two thousand nine hundred 15 eighty-five of the public authorities law or sections sixteen-a, 16 sixteen-b and sixteen-c of chapter seven hundred seventy-four of the 17 laws of nineteen hundred fifty, the commissioner or [his] their agent 18 shall offer such person the opportunity to enter into an installment 19 payment plan, pursuant to subdivision two of section eighteen hundred 20 two of this chapter, at no charge for the payment of such fines and/or 21 surcharges and any related fees. If such person fails to meet their 22 obligations under the installment plan, the commissioner or their agent 23 shall suspend the registration of the vehicle or vehicles involved in EXPLANATION--Matter in italics (underscored) is new; matter in brackets [ ] is old law to be omitted. A. 97 2 1 the violation or the privilege of operation of any motor vehicle owned 2 by the registrant. Such suspension shall take effect no less than thirty 3 days from the date on which notice thereof is sent by the commissioner 4 to the person whose registration or privilege is suspended and shall 5 remain in effect until such registrant has appeared in response to such 6 notices of liability or has paid such penalty or in the case of an 7 administrative tribunal, the registrant has complied with the rules and 8 regulations following the entry of a final decision or decisions. 9 § 2. This act shall take effect on the ninetieth day after it shall 10 have become a law.
