DAVILA -- read once and referred to the Committee on Transportation AN ACT to amend the vehicle and traffic law, in relation to suspending the registration of a vehicle which has been documented multiple times by a photo violation monitoring device for failure of an operator thereof to comply with traffic-control indications The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. The vehicle and traffic law is amended by adding a new 2 section 1118 to read as follows: 3 § 1118. Failure to comply with traffic control signal. (a) The regis- 4 tration of a vehicle which has been documented six times within a twelve 5 month period by a photo violation monitoring device for failure of an 6 operator thereof to comply with traffic-control indications shall be 7 suspended for a period of fifteen days commencing ten days after the 8 notice of liability for the sixth violation has been mailed. 9 (b) The registration of a vehicle which has been documented nine times 10 within a twenty-four month period by a photo violation monitoring device 11 for failure of an operator thereof to comply with traffic-control indi- 12 cations shall be suspended for a period of thirty days commencing ten 13 days after the notice of liability for the ninth violation has been 14 mailed. 15 (c) The registration of a vehicle which has been documented twelve 16 times within a thirty-six month period by a photo violation monitoring 17 device for failure of an operator thereof to comply with traffic-control 18 indications shall be suspended for a period of ninety days commencing 19 ten days after the notice of liability for the twelfth violation has 20 been mailed. 21 (d) This section shall not apply to a rental vehicle, as defined in 22 section one hundred thirty-seven-a of this chapter.  A. 2560 2 1 (e) The department shall, by certified mail, alert the owner of a 2 registered vehicle after the vehicles fourth documentation in twelve 3 months, seventh documentation in twenty-four months, and tenth documen- 4 tation in thirty-six months by a photo violation monitoring device for 5 failure of an operator thereof to comply with traffic-control indi- 6 cations that such vehicle shall be suspended after two more documenta- 7 tions. 8 § 2. This act shall take effect immediately.
