RAJKUMAR -- read once and referred to the Commit- tee on Transportation AN ACT to amend the vehicle and traffic law, in relation to requiring bicycles with electric assist and electric scooters used in deliveries in certain cities be registered with the department of motor vehicles The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. The vehicle and traffic law is amended by adding a new 2 section 1244 to read as follows: 3 § 1244. Registration of bicycles with electric assist used in deliv- 4 eries. 1. In a city of one million or more, every bicycle with electric 5 assist as defined in section one hundred two-c of this chapter which is 6 used by a person to make commercial deliveries, either as an employee or 7 as an independent contractor, shall be registered and issued a number 8 plate by the department. No person shall use a bicycle with electric 9 assist in such city for the purpose of making commercial deliveries 10 unless such bicycle with electric assist shall have a distinctive number 11 assigned to it by the commissioner and a number plate issued by the 12 commissioner with a number corresponding to that of the certificate of 13 registration. 14 2. Such number plates shall be of such material, form, design and 15 dimensions and contain or set forth such distinguishing number or other 16 identification marks as the commissioner shall prescribe, provided, 17 however, that there shall be at all times a marked contrast between the 18 color of the number plates and that of the numerals or letters thereon. 19 3. Each such number plate shall be conspicuously displayed on the rear 20 of the bicycle, securely fastened so as to prevent the same from swing- 21 ing. 22 4. A fee of up to twenty-five dollars for such number plates may be 23 charged by the commissioner. Such fee shall be paid by the company which 24 employs or contracts with the owner or operator of the bicycle with EXPLANATION--Matter in italics (underscored) is new; matter in brackets [ ] is old law to be omitted.  A. 3964 2 1 electric assist to make deliveries of their goods, products or services. 2 A company which is a third-party delivery platform through which the 3 delivery of products or services are arranged shall be responsible for 4 the fee for the number plates under this section for each delivery 5 person it contracts with. Where an owner or operator of a bicycle with 6 electric assist is employed by or contracts with more than one company 7 or third-party delivery platform the commissioner shall prorate the 8 costs and refund each company or platform a portion of such cost. 9 5. Number plates shall be renewed every five years. Where an owner or 10 operator of a bicycle with electric assist terminates employment or 11 ceases their contractual arrangement with a third-party delivery plat- 12 form, such person shall notify the department within ninety days. 13 6. A fine of five hundred dollars shall be imposed upon any company 14 which employs or contracts with the owner or operator of the bicycle 15 with electric assist which fails to register in violation of this 16 section. 17 § 2. The vehicle and traffic law is amended by adding a new section 18 1290 to read as follows: 19 § 1290. Registration of electric scooters used in deliveries. 1. In a 20 city of one million or more, every electric scooter as defined in 21 section one hundred fourteen-e of this chapter which is used by a person 22 to make commercial deliveries, either as an employee or as an independ- 23 ent contractor, shall be registered and issued a number plate by the 24 department. No person shall use an electric scooter in such city for the 25 purpose of making commercial deliveries unless such electric scooter 26 shall have a distinctive number assigned to it by the commissioner and a 27 number plate issued by the commissioner with a number corresponding to 28 that of the certificate of registration. 29 2. Such number plates shall be of such material, form, design and 30 dimensions and contain or set forth such distinguishing number or other 31 identification marks as the commissioner shall prescribe, provided, 32 however, that there shall be at all times a marked contrast between the 33 color of the number plates and that of the numerals or letters thereon. 34 3. Each such number plate shall be conspicuously displayed on the rear 35 of the electric scooter, securely fastened so as to prevent the same 36 from swinging. 37 4. Such fee shall be paid by the company 39 which employs or contracts with the owner or operator of the electric 40 scooter to make deliveries of their goods, products or services. A 41 company which is a third-party delivery platform through which the 42 delivery of products or services are arranged shall be responsible for 43 the fee for the number plates under this section for each delivery 44 person it contracts with. Where an owner or operator of an electric 45 scooter is employed by or contracts with more than one company or third- 46 party delivery platform the commissioner shall prorate the costs and 47 refund each company or platform a portion of such cost. 48 5. This act shall take effect one year after it shall have become a 56 law.
