HEVESI -- read once and referred to the Committee on Children and Families AN ACT to amend the social services law, in relation to clarifying when and how a child protective services report is determined The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Subdivision 7 of section 424 of the social services law, as 2 amended by chapter 164 of the laws of 1991, is amended to read as 3 follows: 4 7. determine, within sixty days or as soon as it deems appropriate, 5 whether the report is "indicated" or "unfounded", if, after conducting 6 its initial investigation of the current report and thoroughly reviewing 7 the family's history with the local child protective agency, (a) it 8 determines that there is a history of prior unfounded reports or that 9 the report appears to have been made for the purpose of harassment, and 10 (b) it has not uncovered any new concerns about the safety of the chil- 11 dren during its initial investigation and determined that the new report 12 is likely unfounded; 13 § 2.
