BROWN -- read once and referred to the Commit- tee on Energy AN ACT to amend the energy law, in relation to directing the state ener- gy planning board to conduct a study of the future of power plants in New York state; and providing for the repeal of such provisions upon expiration thereof The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. The energy law is amended by adding a new section 6-110 to 2 read as follows: 3 § 6-110. Supplemental study on the future of power plants. 1. For 4 purposes of this section, the following terms will have the following 5 meanings: 6 (a) "Power plant" means a major electric generating facility, as 7 defined by subdivision two of section one hundred sixty of the public 8 service law. 9 (b) "Electric power system" means the network of power plants, trans- 10 mission systems, and distribution systems that generates and delivers 11 electric power to residential, commercial, manufacturing, and industrial 12 sectors in New York state. 13 2. On or before January first, two thousand twenty-six, the board 14 shall undertake to study the future of power plants in New York state. 15 3. Such study shall include, at a minimum, an assessment of each of 16 the following: 17 (a) The factors enumerated in subdivision two of section 6-108 of this 18 article; 19 (b) The integrity and impacts of new electric power system infrastruc- 20 ture; 21 (c) Constraints in the supply of natural gas as it relates to the 22 electric power system; EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. LBD08054-01-5A. 5136 2 1 (d) Demand for additional electric power systems in New York state; 2 and 3 (e) The status of and future opportunities for investment in and 4 expansion of the electric power system in New York state under the state 5 energy plan. 6 3. The board shall consult with entities that have resources and 7 expertise to assist in such study, including, but not limited to, 8 academic partners, electric corporations, electricity generating compa- 9 nies, trade organizations, and other stakeholders, as the board shall 10 deem appropriate. 11 4. The board shall prepare a report on such study's findings. The 12 board shall deliver such report to the governor, the speaker of the 13 assembly, and the temporary president of the senate on or before Decem- 14 ber thirty-first, two thousand twenty-six. 15 § 2. This act shall take effect immediately and shall expire January 16 1, 2028 when upon such date the provisions of this act shall be deemed 17 repealed.
