SOLAGES -- read once and referred to the Commit- tee on Governmental Operations AN ACT to amend the civil rights law, in relation to diaper changing accommodations in certain buildings The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. The civil rights law is amended by adding a new section 2 79-r to read as follows: 3 § 79-r. Diaper changing accommodations. 1. Any public building that 4 installs a baby diaper changing accommodation in a restroom shall ensure 5 that the accommodation is equally available or provided regardless of 6 the gender for which the restroom is designed. 7 2. The provisions of subdivision one of this section shall apply: 8 (a) to restrooms constructed on or after the effective date of this 9 section; 10 (b) to restrooms existing on or before the effective date of this 11 section which undergo substantial renovation; and 12 (c) to the extent that the provisions of subdivision one of this 13 section may be implemented in compliance with local, state, and federal 14 laws regarding access for persons with disabilities and with existing 15 fire, health, and safety standards. 16 3. As used in this section, "substantial renovation" means a 17 construction or renovation project requiring a building permit with an 18 estimated cost of ten thousand dollars or more. 19 § 2.
