BROWN -- read once and referred to the Commit- tee on Health AN ACT to amend the public health law, in relation to requiring the distribution of an information card or sheet with Schedule II opioids The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Subdivision 3-a of section 3309 of the public health law, 2 as amended by chapter 504 of the laws of 2019, the opening paragraph and 3 paragraphs (e) and (f) as amended and paragraph (g) as added by chapter 4 600 of the laws of 2024, and paragraphs (c) and (d) as amended by chap- 5 ter 741 of the laws of 2021, is amended to read as follows: 6 3-a. Any distribution of opioid antagonists or opioids listed under 7 Schedule II of section thirty-three hundred six of this title through 8 this program shall include an informational card or sheet, and fentanyl 9 test strips. The informational card or sheet shall include, at a mini- 10 mum, information on: 11 (a) how to recognize symptoms of an opioid overdose; 12 (b) steps to take prior to and after an opioid antagonist is adminis- 13 tered, including calling first responders; 14 (c) opioid addiction and withdrawal symptoms; 15 (d) safe disposal and storage measures for opioids and opioid antag- 16 onists; 17 (e) the number for the toll free office of addiction services and 18 supports' HOPE line; 19 [(d)] (f) how to access the office of addiction services and supports' 20 website; 21 [(e)] (g) the application of good samaritan protections provided in 22 section three thousand-a of this chapter; and 23 [(f)] (h) any other information deemed relevant by the commissioner; 24 and 25 [(g)] (i) information about fentanyl test strips and their uses. A. 6474 2 1 The educational card shall be provided in languages other than English 2 as deemed appropriate by the commissioner. The department shall make 3 such informational cards available to the opioid overdose prevention 4 programs. 5 § 2. This act shall take effect on the ninetieth day after it shall 6 have become a law; provided, however, that if chapter 600 of the laws 7 of 2024 shall not have taken effect on or before such date then section 8 one of this act shall take effect on the same date and in the same 9 manner as such chapter of the laws of 2024 takes effect. Effective 10 immediately, the addition, amendment and/or repeal of any rule or regu- 11 lation necessary for the implementation of this act on its effective 12 date are authorized to be made and completed on or before such effective 13 date.
