CARROLL, MITAYNES, SIMONE, GONZALEZ-ROJAS, GALLAGHER, SHRESTHA, SEPTIMO, SEAWRIGHT, DE LOS SANTOS, MAMDANI, CUNNINGHAM, REYES, FORREST -- read once and referred to the Committee on Corporations, Authorities and Commissions AN ACT to amend the public authorities law, in relation to requiring the metropolitan transportation authority to publish certain information pertaining to capital project data for projects that are committed for construction on the capital program dashboard The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Subparagraphs (vii) and (viii) of paragraph (d) of subdivi- 2 sion 2-a of section 1269-b of the public authorities law, as added by 3 section 1 of part LLL of chapter 58 of the laws of 2022, are amended and 4 two new subparagraphs (ix), (x) and two undesignated paragraphs are 5 added to read as follows: 6 (vii) budget information including the original budget at the time of 7 project commitment when scope and budget are defined, all amendments, 8 the current budget and planned annual allocations; [and] 9 (viii) a schedule for project delivery including original, amended and 10 current start and completion dates as projects develop at each phase[.]; 11 (ix) a listing of all contract numbers, vendors, and contractors asso- 12 ciated with the project; and 13 (x) all sources of funding for the project as expended to date. 14 For the purposes of this paragraph, sources of funding shall be speci- 15 fied as from the state of New York, the federal government, the city of 16 New York, or any other relevant source. Funding from the state of New 17 York shall further specify whether it has been obtained from the central 18 business district tolling lockbox as established by section five hundred 19 fifty-three-j of this chapter or any successor fund or account provided 20 by law. A. 6980 2 1 For the purposes of this paragraph, the status of projects shall be 2 provided and state the current phase of the project, such as planning, 3 design, construction or completion, and shall state how far the project 4 has progressed as measured in percentage by expenditure. The dashboard 5 shall measure progress based on original budgets at the time of project 6 commitment when scope and budget are defined. At a minimum, all changes 7 to planned budgets of greater than ten percent, significant project 8 scope or a three month or more change in schedule shall be provided in 9 narrative form and describe the reason for each change or amendment. The 10 dashboard shall include a glossary or data dictionary which contains 11 plain language descriptions of the data, including individual project 12 data, and any other information provided on the dashboard. The authority 13 shall provide a definition of resiliency in the glossary or data 14 dictionary. The dashboard shall be updated, at a minimum, on a quarterly 15 basis, and all data fields available on the dashboard shall be made 16 available for download on the authority's website in a single tabular 17 data file in a common, machine readable format. Capital dashboard data 18 shall also be made available on the data.ny.gov website or such other 19 successor website maintained by, or on behalf of, the state, as deemed 20 appropriate by the New York state office of information technology 21 services under executive order number ninety-five of two thousand thir- 22 teen, or any successor agency or order. 23 § 2. Subdivision 2-a of section 1269-b of the public authorities law 24 is amended by adding a new paragraph (g) to read as follows: 25 (g) The authority shall create and maintain a separate section on its 26 capital program dashboard website for projects funded by the central 27 business district tolling lockbox as established by section five hundred 28 fifty-three-j of this chapter or any successor fund or account provided 29 by law. 30 § 3. This act shall take effect immediately.
