55	55	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
56	56	SECTION 1. AMENDATORY 47 O.S. 2011, Section 6 -111, as
57	57	last amended by Section 5, Chapter 1, O.S.L. 2017 (47 O.S. Supp.
58	58	2020, Section 6-111), is amended to read as f ollows:
59	59	Section 6-111. A. 1. The Department of Public Safety shall,
60	60	upon payment of the required fee, issue to every applicant
61	61	qualifying therefor a Class A, B, C or D driver license or
62	62	identification card as applied for, which license or card shall bea r
63	63	thereon a distinguishing alphanumeric identification assigned to the
64	64	licensee or cardholder, date of issuance and date of expiration of

91	91	the license or card, the full legal name, signature or computerized
92	92	signature, date of birth, residence address , unless specified as an
93	93	exception in the Code of Federal Regulations per 6 C.F.R., Section
94	94	37.17, sex, a computerized color image of the licensee or cardholder
95	95	taken in accordance with Department rules and security features as
96	96	determined by the Department. The image shall depict a full front
97	97	unobstructed view of the entire face of the licensee or cardholder;
98	98	provided, a commercial learner permit shall not bear the image of
99	99	the licensee. When any person is issued both a driver license and
100	100	an identification card, the Department shall ensure the information
101	101	on both the license and the card are the same, unless otherwise
102	102	provided by law.
103	103	2. A driver license or identification card issued by the
104	104	Department on or after March 1, 2004, shall bear thereon the county
105	105	of residence of the licensee or cardholder.
106	106	3. The Department may cancel the distinguishing number, when
107	107	that distinguishing number is another person's Social Security
108	108	number, assign a new distinguishing alphanumeric identification, and
109	109	issue a new license or identification card without charge to the
110	110	licensee or cardholder.
111	111	4. The Department may promulgate rules for inclusion of the
112	112	height and a brief description of the licensee or cardholder on the
113	113	face of the card or license identifying the licensee or card holder
114	114	as deaf or hard-of-hearing.

141	141	5. It is unlawful for any person to apply, adhere, or otherwise
142	142	attach to a driver license or identification card any decal,
143	143	sticker, label, or other attachment. Any law enforcement officer is
144	144	authorized to remove and d ispose of any unlawful decal, sticker,
145	145	label, or other attachment from the driver license of a person. The
146	146	law enforcement officer, the employing agency of the officer, the
147	147	Department of Public Safety, and the State of Oklahoma shall be
148	148	immune from any liability for any loss suffered by the licensee,
149	149	cardholder, or the owner of the decal, sticker, label, or other
150	150	attachment caused by the removal and destruction of the decal,
151	151	sticker, label, or other attachment.
152	152	6. The Department of Public Safety may devel op by rule a
153	153	procedure which complies with the provisions of subsection G of
154	154	Section 6-101 of this title whereby a person may apply for a renewal
155	155	or replacement Oklahoma Class D license or Oklahoma identification
156	156	card.
157	157	7. The Department of Public Safety s hall promulgate rules and
158	158	procedures whereby a person may apply for a renewal or replacement
159	159	Oklahoma commercial driver license through a tag agency. However, a
160	160	commercial driver license holder shall be required to renew or
161	161	replace a hazardous material en dorsement at the Department.
162	162	B. 1. The Department may issue or authorize the issuance of a
163	163	temporary permit or license to an applicant for a driver license
164	164	permitting such applicant to operate a motor vehicle while the

191	191	Department is completing its invest igation and determination of all
192	192	facts relative to such applicant's privilege to receive a license,
193	193	or while a permanent driver license is being produced and delivered
194	194	to the applicant. Such permit or license must be in the immediate
195	195	possession of the dri ver while operating a motor vehicle, and it
196	196	shall be invalid when the applicant's permanent driver license has
197	197	been issued and delivered or for good cause has been refused.
198	198	2. The Department may issue or authorize the issuance of a
199	199	temporary identificatio n card to an applicant, permitting the holder
200	200	the privileges otherwise granted by identification cards, while a
201	201	permanent driver license is being provided and delivered to the
202	202	applicant. Such card shall be invalid when the applicant's
203	203	permanent identifica tion card has been issued and delivered, or for
204	204	good cause has been refused .
205	205	C. 1. The Department may issue a restricted commercial driver
206	206	license to drivers eighteen (18) years of age or older for any of
207	207	the following specific farm -related service indus tries:
208	208	a. farm retail outlets and suppliers,
209	209	b. agri-chemical businesses,
210	210	c. custom harvesters, and
211	211	d. livestock feeders.
212	212	The applicant shall hold a valid Oklahoma driver license and
213	213	shall meet all the requirements for a commercial driver license.

240	240	The restricted commercial driver license shall not exceed a total of
241	241	one hundred eighty (180) days within any twelve -month period.
242	242	2. The restricted commercial driver license shall not be valid
243	243	for operators of commercial motor vehicles beyond one hundred fifty
244	244	(150) miles from the place of business or the farm currently being
245	245	served. Such license shall be limited to Class B vehicles. Holders
246	246	of such licenses who transport hazardous materials which are
247	247	required to be placarded shall be limited to the following:
248	248	a. diesel fuel in quantities of one thousand (1,000)
249	249	gallons or less,
250	250	b. liquid fertilizers in vehicles with total capacities
251	251	of three thousand (3,000) gallons or less, and
252	252	c. solid fertilizers that are not mixed with any organic
253	253	substance.
254	254	No other placarded hazardous materials shall be transported by
255	255	holders of such licenses.
256	256	D. The Department may issue a non -domiciled commercial learner
257	257	permit or a non-domiciled commercial driver license to:
258	258	1. An H2A-Temporary Agricultural worker lawfully present in the
259	259	United States as indicated on an original, valid and unexpired I -94
260	260	immigration status document issued by the United States Customs
261	261	Citizenship and Immigration Service Services; and
262	262	2. A J-1 Exchange Visitor Program participant lawfully present
263	263	in the United States as indicated on a valid and unexpired J -1

290	290	Visitor Visa issued by the United States Customs Citizenship and
291	291	Immigration Service Services and who is enrolled in an agricultural
292	292	education training program.
293	293	A person applying for such permit or l icense must comply with
294	294	all testing and licensing requirements in accordance with applicable
295	295	federal regulations, state laws and Department rules. The issued
296	296	license shall be valid until the expiration of the visa for the non -
297	297	domiciled worker. The Depart ment may promulgate rules for the
298	298	implementation of the process to carry out the provisions of this
299	299	section.
300	300	E. 1. The Department shall develop a procedure whereby a
301	301	person applying for an original, renewal or replacement Class A, B,
302	302	C or D driver licens e or identification card who is required to
303	303	register as a convicted sex offender with the Department of
304	304	Corrections pursuant to the provisions of the Sex Offenders
305	305	Registration Act and who the Department of Corrections designates as
306	306	an aggravated or habitu al offender pursuant to subsection J of
307	307	Section 584 of Title 57 of the Oklahoma Statutes shall be issued a
308	308	license or card bearing the words "Sex Offender".
309	309	2. The Department shall notify every person subject to
310	310	registration under the provisions of Sectio n 1-101 et seq. of this
311	311	title who holds a current Class A, B, C or D driver license or
312	312	identification card that such person is required to surrender the

339	339	license or card to the Department within one hundred eighty (180)
340	340	days from the date of the notice.
341	341	3. Upon surrendering the license or card for the reason set
342	342	forth in this subsection, application may be made with the
343	343	Department for a replacement license or card bearing the words "Sex
344	344	Offender".
345	345	4. Failure to comply with the requirements set forth in suc h
346	346	notice shall result in cancellation of the person's license or card.
347	347	Such cancellation shall be in effect for one (1) year, after which
348	348	time the person may make application with the Department for a new
349	349	license or card bearing the words "Sex Offender". Continued use of
350	350	a canceled license or card shall constitute a misdemeanor and shall,
351	351	upon conviction thereof, be punishable by a fine of not less than
352	352	Twenty-five Dollars ($25.00), nor more than Two Hundred Dollars
353	353	($200.00). When an individual is no lo nger required to register as
354	354	a convicted sex offender with the Department of Corrections pursuant
355	355	to the provisions of the Sex Offenders Registration Act, the
356	356	individual shall be eligible to receive a driver license or
357	357	identification card which does not be ar the words "Sex Offender".
358	358	F. Nothing in subsection E of this section shall be deemed to
359	359	impose any liability upon or give rise to a cause of action against
360	360	any employee, agent or official of the Department of Corrections for
361	361	failing to designate a sex offender as an aggravated or habitual

388	388	offender pursuant to subsection J of Section 584 of Title 57 of the
389	389	Oklahoma Statutes.
390	390	G. A person subject to an order for the installation of an
391	391	ignition interlock device shall be required by the Department to
392	392	submit their driver license for a replacement. The replacement
393	393	driver license shall bear the words "Interlock Required" and such
394	394	designation shall remain on the driver license for the duration of
395	395	the order requiring the ignition interlock device. The replaceme nt
396	396	license shall be subject to the same expiration and renewal
397	397	procedures provided by law. Upon completion of the requirements for
398	398	the interlock device, a person may apply for a replacement driver
399	399	license.
400	400	H. The Department shall develop a procedure wher eby a person
401	401	applying for an original, renewal or replacement Class D driver
402	402	license who has been granted modified driving privileges under this
403	403	title shall be issued a Class D driver license which identifies the
404	404	license as a modified license.
405	405	SECTION 2. This act shall become effective November 1, 2021.
