24	107		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
25	108		SECTION 1. AMENDATORY 82 O.S. 2011, Section 1085.30, as
26	109		amended by Section 2, Chapter 137, O.S.L. 2018 (82 O.S. Supp. 2020,
27	110		Section 1085.30), is amended to read as follows:

29	111		Section 1085.30 A. 1. In order to effectuate a comprehensi ve
30	112		program to assist in the prevention, control and abatement of
31	113		pollution of the waters of this state, and in order to establish
32	114		state standards which comply with the Federal Water Pollution
33	115		Control Act as amended, the Oklahoma Water Resources Board is
34	116		authorized to promulgate rules to be known as "Oklahoma Water
35	117		Quality Standards" which establish classifications of uses of waters
36	118		of the state, criteria to maintain and protect such classifications,

37	145		and other standards or policies pertaining to the quality of such
38	146		waters.

40	147		2. The Oklahoma Water Quality Standards shall, at a minimum, be
41	148		designed to maintain and protect the quality of the waters of the
42	149		state.

46	150		3. Wherever the Board finds it is practical and in the public
47	151		interest to do so, the rules may be ame nded to upgrade and improve
48	152		progressively the quality of waters of the state.

50	153		4. a. The Board may also amend Oklahoma Water Quality
51	154		Standards to downgrade a designated use of any waters
52	155		of this state which is not an existing use, may
53	156		establish subcategorie s of a use or may provide for
54	157		less stringent criteria or other provisions thereof
55	158		only in those limited circumstances permissible under
56	159		the Federal Water Pollution Control Act as amended or
57	160		federal rules which implement the act.

59	161		b. The Board may amend the Oklahoma Water Quality
60	162		Standards to downgrade a designated use, establish
61	163		subcategories of a use or may provide for less
62	164		stringent criteria or other provisions thereof only to
63	165		the extent as will maintain or improve the existing
64	166		uses and the water quality o f the water affected;
65	167		provided, however, the Board shall not modify the
66	168		Oklahoma Water Quality Standards applicable to scenic

67	195		river areas as such areas are described by Section
68	196		1452 896.5 of this title, to downgrade a designated
69	197		use, establish a subcategor y of a use or provide for
70	198		less stringent criteria or other provisions thereof.

72	199		5. The Board shall propose any necessary rules to allow for the
73	200		development of nutrient trading programs by state environmental
74	201		agencies no later than November 1, 2026.

76	202		B. 1. Prior to adopting such standards or any amendment
77	203		thereof, the Board shall conduct public hearings thereon. Notice of
78	204		such hearing shall be published in accordance with the
79	205		Administrative Procedures Act and shall be mailed at least twenty
80	206		(20) days before such public hearing to the chief executive of each
81	207		municipality and county in the area affected and shall be mailed to
82	208		all affected holders of permits obtained pursuant to the Oklahoma
83	209		Environmental Code, and such other persons that have requested
84	210		notice of hearings on such standard modifications.

86	211		2. If adoption or amendment of a classification to a lower or
87	212		downgraded classification is proposed because treatment controls
88	213		required of the current or a higher or upgraded classification would
89	214		result in substantial and widespread social and economic impact, the
90	215		Board shall, in addition to any hearing required by subsection B of

93	216		this section, conduct a public meeting within a central location
94	217		within the area to be affected. The Board shall cause notice of
95	218		such additional public meeting to be published for at least two (2)

96	245		consecutive weeks in a newspaper of general circulation published in
97	246		the county or counties in the area affected.

99	247		C. 1. The Oklahoma Water Quality Standards, their accompanying
100	248		use support assessment protocols, anti -degradation policy and
101	249		implementation, and policies generally affecting Oklahoma Water
102	250		Quality Standards application and implementation including , but not
103	251		limited to, mixing zones, low flows and variances or any
104	252		modification or change thereof shall be promulgated by the Board in
105	253		compliance with the Administrative Procedures Act and shall be
106	254		enforced by all state agencies within the scope of their
107	255		jurisdiction. All use support assessment protocols promulgated by
108	256		the Board shall be consistent with state and federal law and
109	257		guidance specifically related to beneficial use support
110	258		determinations as set forth in Section 305(b) of the Federal Water
111	259		Pollution Control Act, where applicable.

113	260		2. In promulgating Oklahoma Water Quality Standa rds or making
114	261		any modification or change thereof, the Board shall announce a
115	262		reasonable time for persons discharging waste into the waters of the
116	263		state to comply with such new or modified standards unless such
117	264		discharges create an actual or potential hazar d to public health.

119	265		3. Any discharge in accord with such standards of the Board and
120	266		in compliance with rules, requirements and wasteload allocations
121	267		established by the Department of Environmental Quality and with

123	295		deemed to be pollution.

125	296		4. Notwithstanding the implementation jurisdiction provided to
126	297		the Board in paragraph 1 of subsection C of this section, the
127	298		Department of Environmental Quality shall have jurisdiction to
128	299		develop and utilize policies and requirements, as provided in
129	300		paragraph 22 of subsection B of Section 1 -3-101 of Title 27A of the
130	301		Oklahoma Statutes.
