4040 An Act relating to firearms; amending 21 O.S. 2011,
4141 Section 1289.24, as last amended by Section 8,
4242 Chapter 1, O.S.L. 2019 (21 O.S. Supp. 2020, Section
4343 1289.24), which relates to the Oklahoma Firearms Act
4444 of 1971; clarifying preemption provision and certain
4545 mandate; specifying circumstances that au thorize the
4646 filing of civil actions against certain persons or
4747 entities; providing for the awar d of reasonable
4848 expenses under certain circumstances; providing
4949 procedures; defining term; and providing an effective
5050 date.

5656 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5757 SECTION 1. AMENDATORY 21 O.S. 2011, Sect ion 1289.24, as
5858 last amended by Section 8, Chapter 1, O.S.L. 2019 (21 O.S. Supp.
5959 2020, Section 1289.24), is amended to read as follows:

6161 FIREARM REGULATION – STATE PREEMPTION

6363 A. 1. The State Legislature hereby occupies and preempts the
6464 entire field of legislation in this state touching in any way
6565 firearms, knives, firearm and ammunition components, ammunition , and
6666 supplies to the complete exclusion of any order, policy, ordinance,

9393 or regulation by any municipality , or other political subdi vision of
9494 this state. Any existing or future orders, policies, ordinances, or
9595 regulations in this field, except as provided for in paragraph 2 of
9696 this subsection and subsection C of this section, are null and void.
9797 2. A municipality may adopt any ordinan ce:
9898 a. relating to the discharge of firearms within the
9999 jurisdiction of the municipality, and
100100 b. allowing the municipality to issue a traffic citation
101101 for transporting a firearm improperly as provided for
102102 in Section 1289.13A of this title, provided, howeve r,
103103 that penalties contained for violation of any
104104 ordinance enacted pursuant to the provisions of this
105105 subparagraph shall not exceed the penalties
106106 established in the Oklahoma Self -Defense Act.
107107 3. As provided in the preemption provisions of this section,
108108 the otherwise lawful carrying or possession of a firearm under the
109109 provisions of Chapter 53 of this title shall not be punishable by
110110 any municipality or other political subdivision of this state as
111111 disorderly conduct, disturbing the peace or similar offense against
112112 public order.
113113 4. A public or private school may create a policy regulating
114114 the possession of knives on school property or in any school bus or
115115 vehicle used by the school for purposes of transportation.

142142 B. No municipality or other political subdiv ision of this state
143143 shall adopt any order, policy, ordinance, or regulation concerning
144144 in any way the sale, purchase, purchase delay, transfer, ownership,
145145 use, keeping, possession, carrying, bearing, transportation,
146146 licensing, permit, registration, taxatio n other than sales and
147147 compensating use taxes , or other controls on firearms, knives,
148148 firearm and ammunition components, ammunition , and supplies.
149149 C. Except as hereinafter provided, this section shall not
150150 prohibit any order, policy, ordinance, or regulation by any
151151 municipality concerning the confiscation of property used in
152152 violation of the ordinances of the municipality as provided for in
153153 Section 28-121 of Title 11 of the Oklahoma Statutes. Provided,
154154 however, no municipal ordinance relating to transporti ng a firearm
155155 or knife improperly may include a provision for confiscation of
156156 property.
157157 D. When a person's rights pursuant to the protection of the
158158 preemption provisions of this section have been violated pursuant to
159159 any order, policy, ordinance or regulat ion promulgated or enforced
160160 by any person, municipality, agency or other political subdivision
161161 of this state, the person shall have the right to bring a civil
162162 action against the persons, municipality, agency and political
163163 subdivision jointly and severally for injunctive relief or monetary
164164 damages or both.

191191 E. A court may require the person, municipality, agency or
192192 political subdivision to pay reasonable expenses to the aggrieved
193193 party in an action filed pursuant to the provisions of subsection D
194194 of this section if:
195195 1. The aggrieved party first provides written notice of the
196196 unlawful order, policy, ordinance or regulation by certified first-
197197 class mail or service of process and allows the person,
198198 municipality, agency or political subdivision ninety (90) days to
199199 rescind, repeal or otherwise abrogate the order, policy, ordinance
200200 or regulation; and
201201 2. A court grants final determination in favor of the aggrieved
202202 party.
203203 If the person, municipality, agency or political subdivision
204204 fails to rescind, repeal or otherwise abrogate the unlawful order,
205205 policy, ordinance or regulation within ninety (90) days of required
206206 notice as provided in paragraph 1 of this subsection and the order,
207207 policy, ordinance or regulation is subsequently rescinded, repealed
208208 or otherwise abrogated after the aggrieved party files suit, the
209209 aggrieved party shall retain standing in the suit and may recover
210210 damages or reasonable expenses.
211211 F. As used in this section, "reasonable expenses" includes, but
212212 shall not be limited to, attorney fees, expert witness fees and
213213 court costs.
