38	47		An Act relating to the Oklahoma Central Purchasing
39	48		Act; amending 74 O.S. 2011, Section 85.3, as last
40	49		amended by Section 3, Chapter 98, O.S.L. 2020 (74
41	50		O.S. Supp. 2020, Section 85.3), which relates to the
42	51		Purchasing Division; allowing certain state entities
43	52		to make certain purchases; requiring certain
44	53		documentation; and providing an effective date.

50	59		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
51	60		SECTION 1. AMENDATORY 74 O.S. 2011, Section 85.3, as
52	61		last amended by Section 3, Chapter 98, O.S.L. 2020 (74 O.S. Supp.
53	62		2020, Section 85.3), is amended to read as follows:
54	63		Section 85.3 A. There is hereby created and established in the
55	64		Office of Management and Enterprise Services a Purchasing Division,
56	65		the administrative head of which shall be the State Purchasing
57	66		Director.
58		-	B. The Director of the Office of Management and Enterprise
59		-	Services shall hire the State Purchasing Director. The St ate
60		-	Purchasing Director shall:
61		-	1. Have a thorough knowledge of office practices and buying
62		-	procedures in volume purchasing; and

	94	+	B. The Director of the Office of Management and Enterprise
	95	+	Services shall hire the State Purchasing Director. The State
	96	+	Purchasing Director shall:
	97	+	1. Have a thorough knowledge of office practices and buying
	98	+	procedures in volume purchasing; and
89	99		2. Be a graduate of an accredited college or university with at
90	100		least five (5) years' experience in commercial or governmental
91	101		purchasing, or, in lieu of such education, have at least ten (10)
92	102		years' experience in commercial or governmental purchasing.
93	103		C. The State Purchasing Director, with the approval of the
94	104		Director of the Office of Management and Enterprise Services, may
95	105		employ such personnel as may be necessary to exercise authority and
96	106		perform duties under the Oklahoma Central Purchasing Act.
97	107		D. All activities of any state agency, department, or
98	108		institution relating to purchasing shall be under the direction of
99	109		the Purchasing Division unless otherwise provided by the Oklahoma
100	110		Central Purchasing Act.
101	111		E. The Purchasing Division shall provide qualified personne l to
102	112		assist the purchasing activities of state agencies, departments, and
103	113		institutions, as required by the Oklahoma Central Purchasing Act.
104	114		F. Each state agency, department, and institution shall
105	115		designate personnel to coordinate its purchasing functions with the
106	116		Purchasing Division.
107		-	G. The Purchasing Division may, if the needs of a state agency,
108		-	department, or institu tion are such as to so require, employ, and
109		-	establish a buyer within a state agency. The state agency shall pay
110		-	all expenses incurred for any buyer required to be placed within its

	144	+	G. The Purchasing Division may, if the needs of a state agency,
	145	+	department, or institution are such as to so require, employ, and
	146	+	establish a buyer within a state agency. The state agency shall pay
	147	+	all expenses incurred for any buyer required to be placed within its
	148	+	agency.
138	149		H. Except as provided in Section 34.36 of Title 62 of the
139	150		Oklahoma Statutes, no state agency subject to the Oklahoma Central
140	151		Purchasing Act shall have or maintain a purchasing section without
141	152		the prior approval in writing of the Purchasing Division unless
142	153		otherwise provided in the Oklahoma Central Purchasing Act nor shall
143	154		such purchasing section perform purchasing functions for another
144	155		state agency.
145	156		I. The Purchasing Division shall make acquisitions from
146	157		industries operated by the Department of Corrections pursuant to the
147	158		provisions of Section 549.1 of Title 57 of the Oklahoma Statutes.
148	159		J. None of the personnel authorized by this section shall:
149	160		1. Sell to or otherwise provide acquisitions to any state
150	161		agency subject to the Oklahoma Central Purchasing Act;
151	162		2. Be employees, partners, associates, officers, or
152	163		stockholders in or with any business entity that sells to or
153	164		otherwise provides acquisitions to any state agency subject to the
154	165		Oklahoma Central Purch asing Act;
155	166		3. Be employed in any of the positions authorized by this
156	167		section if a spouse or child owns any stock in any business entity
157		-	which sells to or otherwise provides acquisitions to any agency
158		-	subject to the Oklahoma Central Purchasing Act;
159		-	4. Be employed in any of the positions authorized by this
160		-	section if a relative within the third degree of consanguinity or
161		-	affinity sells to or otherwise provides acquisitions to any state

	195	+	which sells to or otherwise provides acquisitions to any agency
	196	+	subject to the Oklahoma Central Purchasing Act;
	197	+	4. Be employed in any of the positions authorized by this
	198	+	section if a relative within the third degree of consanguinity or
	199	+	affinity sells to or otherwise provides acquisitions to any state
188	200		agency subject to the Oklahoma Central Purchasing Act or is
189	201		interested in any business entity which does so, except that such
190	202		relative, excluding a spouse or child, may own Twenty -five Thousand
191	203		Dollars ($25,000.00) worth or less, or one percent (1%) or less,
192	204		whichever amount is the lesser amount, of the stock of a corporation
193	205		or any business entity which sells to or otherwise provides
194	206		acquisitions to any state agency subject to the Oklahoma Central
195	207		Purchasing Act; or
196	208		5. Violate applicable rules of the Ethics Commission
197	209		promulgated pursuant to Article XXIX of the Oklahoma Const itution
198	210		that relate to accepting gifts from a vendor or a vendor's agent.
199	211		K. Any state agency, department, institution, or satellite
200	212		office thereof that is otherwise subject to the provisions of the
201	213		Oklahoma Central Purchasing Act, but is located in a cou nty without
202	214		contracted vendors, may elect to purchase necessary equipment and
203	215		supplies from a local business without first obtaining a waiver from
204	216		or the permission of the Purchasing Division. Any state agency that
205	217		elects to make purchases from local vend ors pursuant to this
206	218		subsection shall maintain a document file for each acquisition the
207		-	state agency makes which shal l include, at a minimum, justification
208		-	for the acquisition, supporting documentation, copies of all
209		-	contracts, if any, pertaining to the acquisition, evaluations,
210		-	written reports if required by contract and any other information
211		-	the State Purchasing Direct or requires to be kept.

238	251		SECTION 2. This act shall become effective November 1, 2021.
