An Act relating to crimes and punishments; making 
certain acts unlawful; providing penalties; defining 
term; providing for codification; and providing an 
effective date. 
 
 
 
 
BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: 
SECTION 1.     NEW LAW     A new section of law to be codified 
in the Oklahoma Statutes as Section 650.12 of Title 21, unless there 
is created a duplication in numbering, re ads as follows: 
A.  Every person who, without justifiable or excusable cause and 
with intent to do bodily harm, commits any assault, battery or 
assault and battery upon the person of a municipal or county code 
official who is in the lawful performance of h is or her duties of 
investigating or enforcing the codes, rules or regulations adopted 
by county legislation or municipal ordinance, upon conviction, is 
guilty of a misdemeanor punishable by imprisonment in a county jail 
for a term not to exceed one (1) ye ar, or by a fine not to exceed 
Five Hundred Dollars ($500.00), or by both such fine and 
imprisonment.  Upon conviction for a second or subsequent offense,

the person shall be guilty of a felony punishable by imprisonment in 
the custody of the Department of Corrections for a term not to 
exceed two (2) years, or by a fine not to exceed Three Thousand 
Dollars ($3,000.00), or by both such fine and imprisonment. 
B.  As used in this section, "code official" means any code 
enforcement official, zoning official, he alth official, building 
official or deputies thereof, or other person designated by county 
legislation or municipal ordinance to lawfully investigate and 
enforce such legislation or ordinance as adopted by the governing 
body thereof. 
SECTION 2.  This act shall become effective November 1, 2021.
