4948 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5049 SECTION 1. NEW LAW A new section of law to be codified
5150 in the Oklahoma Statutes as Section 650.12 of Title 21, unless there
5251 is created a duplication in numbering, re ads as follows:
5352 A. Every person who, without justifiable or excusable cause and
5453 with intent to do bodily harm, commits any assault, battery or
5554 assault and battery upon the person of a municipal or county code
5655 official who is in the lawful performance of h is or her duties of
5756 investigating or enforcing the codes, rules or regulations adopted
5857 by county legislation or municipal ordinance, upon conviction, is
5958 guilty of a misdemeanor punishable by imprisonment in a county jail
6059 for a term not to exceed one (1) ye ar, or by a fine not to exceed
6160 Five Hundred Dollars ($500.00), or by both such fine and
6261 imprisonment. Upon conviction for a second or subsequent offense,

9088 the person shall be guilty of a felony punishable by imprisonment in
9189 the custody of the Department of Corrections for a term not to
9290 exceed two (2) years, or by a fine not to exceed Three Thousand
9391 Dollars ($3,000.00), or by both such fine and imprisonment.
9492 B. As used in this section, "code official" means any code
9593 enforcement official, zoning official, he alth official, building
9694 official or deputies thereof, or other person designated by county
9795 legislation or municipal ordinance to lawfully investigate and
9896 enforce such legislation or ordinance as adopted by the governing
9997 body thereof.
100-SECTION 2. This act shall become effective November 1, 2022.
