50 | 49 | | SECTION 1. NEW LAW A new section of law to be codified |

51 | 50 | | in the Oklahoma Statutes as Section 650.12 of Title 21, unless there |

52 | 51 | | is created a duplication in numbering, re ads as follows: |

53 | 52 | | A. Every person who, without justifiable or excusable cause and |

54 | 53 | | with intent to do bodily harm, commits any assault, battery or |
---|
55 | 54 | | assault and battery upon the person of a municipal or county code |
---|
56 | 55 | | official who is in the lawful performance of h is or her duties of |
---|
57 | 56 | | investigating or enforcing the codes, rules or regulations adopted |
---|
58 | 57 | | by county legislation or municipal ordinance, upon conviction, is |
---|
59 | 58 | | guilty of a misdemeanor punishable by imprisonment in a county jail |
---|
60 | 59 | | for a term not to exceed one (1) ye ar, or by a fine not to exceed |

61 | 60 | | Five Hundred Dollars ($500.00), or by both such fine and |

62 | 61 | | imprisonment. Upon conviction for a second or subsequent offense, |
