49	48		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
50	49		SECTION 1. NEW LAW A new section of law to be codified
51	50		in the Oklahoma Statutes as Section 650.12 of Title 21, unless there
52	51		is created a duplication in numbering, re ads as follows:
53	52		A. Every person who, without justifiable or excusable cause and
54	53		with intent to do bodily harm, commits any assault, battery or
55	54		assault and battery upon the person of a municipal or county code
56	55		official who is in the lawful performance of h is or her duties of
57	56		investigating or enforcing the codes, rules or regulations adopted
58	57		by county legislation or municipal ordinance, upon conviction, is
59	58		guilty of a misdemeanor punishable by imprisonment in a county jail
60	59		for a term not to exceed one (1) ye ar, or by a fine not to exceed
61	60		Five Hundred Dollars ($500.00), or by both such fine and
62	61		imprisonment. Upon conviction for a second or subsequent offense,

90	88		the person shall be guilty of a felony punishable by imprisonment in
91	89		the custody of the Department of Corrections for a term not to
92	90		exceed two (2) years, or by a fine not to exceed Three Thousand
93	91		Dollars ($3,000.00), or by both such fine and imprisonment.
94	92		B. As used in this section, "code official" means any code
95	93		enforcement official, zoning official, he alth official, building
96	94		official or deputies thereof, or other person designated by county
97	95		legislation or municipal ordinance to lawfully investigate and
98	96		enforce such legislation or ordinance as adopted by the governing
99	97		body thereof.
