3195 Section 1835. A. Whoever shall willfully or maliciously enter
3296 the garden, yard, pasture or field of another after being expressly
3397 forbidden to do so or without permission by the owner or lawful
3498 occupant thereof when such property is posted shall be deemed guilty
3599 of trespass and upon conviction thereof shall be fined in any sum
36100 punished by a fine of not to exceed more than Two Hundred Fifty
37101 Dollars ($250.00); provided, that this provision shall not apply to
38102 registered land surveyors and registered professional engineers for
39103 the purpose of land surveying in the performance of their
40104 professional services; and, provided further, that anyone who

61147 in the performance of their duties ,

63148 c. firefighters, emergency medical personne l or public
64149 utility employees engaged in addressing an emergency
65150 that presents an imminent danger to health , safety or
66151 the environment in the performance of their duties , or

68152 d. parties engaged in oil and gas operations, which shall
69153 include, without limitat ion, exploration, drilling,
70154 production and sales activities, under authority of
71-mineral ownership, an oil and gas lease, seismic
155+mineral ownership, an oil and gas ease, seismic
72156 agreement or permit, gas gathering, purchase,
73157 transportation or treating contracts, Corporation

77160 2. The provisions of this section shall not prohibit:

79161 a. railroad employees and emergency equipment from
80162 entering such land to restore rail service following
81163 an accident, derailment or natural disaster ,

83164 b. the entrance of utility employees or contractors while
84165 acting in the scope of their employment , or

86166 c. employees or contractors of valid easement or license
87167 holders while acting in the scope of their employment;

89194 3. The following persons may enter such land of another unless
90195 forbidden to do so, either orally or in writing, by the owner or
91196 lawful occupier thereof:

93197 a. registered land surveyors and registered professional
94198 engineers for the purpose of land surveying in the
95199 performance of their professional services ,

97200 b. persons making a delivery, selling a product or
98201 service, conducting a survey or poll, working on
99202 behalf of a candidate for political office, or
100-
101203 c. persons who have a legitimate reason for entering and
102204 who, immediately upon entering, seek to conduct
103205 business.

105206 B. Anyone who willfully or maliciously enters any such land of
106207 another and commits or attempts to commit waste, theft or damage
107-shall be deemed guilty of a misdemeanor and upon conviction shall be
108-punished by imprisonme nt in the county jail for a term of not less
109-than thirty (30) days nor more than six (6) months, by a fine of not
110-less than Fifty Dollars ($50.00) nor more than Five Hundred Dollars
111-($500.00), or by both such fine and imprisonment.

255+property owned or managed by the Grand River Dam Authority without
256+permission when such property is posted shall be deemed guilty of
257+misdemeanor trespass and upon conviction thereof shall be fined in
258+any sum punished by a fine of not to exceed more than Two Hundred
259+Fifty Dollars ($250.00); provided, that this provision shall not
260+apply to registered land surveyors and registered professional

304+Governor’s Mansion and its grounds and appurtenances shall not be
305+required to be posted with signs warning against trespass. Any
306+person who shall willfully or maliciously enter the grounds of the
307+Governor’s Mansion within the State Capitol Park, as defined in
308+Section 1811.4 of Title 74 of the Oklahoma Statutes, except at a
309+place where entry to the property is normally expected shall be
310+deemed guilty of a misdemeanor and upon conviction shall be fined in
311+a sum punished by a fine of not more than Five Hundred Dollars
312+($500.00), or by confinement imprisonment in the county jail for not
313+less than thirty (30) days nor more than six (6) months, or by both
314+such fine and imprisonment.
315+SECTION 2. This act shall become effective November 1, 2021. ”

404+SECTION 3. AMENDATORY 21 O.S. 2011, Section 1835, is
405+amended to read as follows:
406+Section 1835. A. Whoever shall willfully or maliciously enter

462+feet from the ground, and
463+c. placed at locations that are readily visible to any
464+person approaching the property and no more than one

492+and one hundred (100) feet apart on forest land .
493+B. Beginning November 1, 2021, when a landowner uses the purple
494+posting to indicate no trespassin g, such marks shall be accompanied
495+by signs placed conspicuously and at all places where entry to the
496+property is normally expected explaining that the purple stripe
497+means no trespassing, property restricted, or similar explanation of
498+what the purple strip e indicates. On and after November 1, 2022, no
499+sign shall be required to explain the purple posting.
500+C. No provisions of this act section shall be construed to
501+conflict with Section 5 -202 or 6-304 of Title 29 of the Oklahoma
502+Statutes.
