43	40		An Act relating to environment and natural resources;
44	41		allowing a county or municipality to create a
45	42		landfill utilization district; req uiring a vote of
46	43		the people; providing election procedure; describing
47	44		district limits; levying an annual fee; requiring the
48	45		annual fee to be used for certain operations;
49	46		prohibiting certain fees for use; defining term;
50	47		providing for codification; and provi ding an

57	54		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
58	55		SECTION 1. NEW LAW A new section of law to be codified
59	56		in the Oklahoma Statutes as Section 2-10-2001 of Title 27A, unless
60	57		there is created a d uplication in numbering, reads as follows:
61	58		A. The governing body of a county or municipality which owns a
62	59		landfill may initiate the creation of a landfill utilization
63	60		district by the adoption of a resolution calling for the question of
64	61		whether to organize a landfill utilization district to be placed
65	62		before the registered voters of the county or municipality. The
66	63		resolution shall be submitted to registered voters of the county or

94		-	municipality at a special or genera l election. The costs of an
95	91		election to establish a hazard mitigation assessment district shall
96	92		be paid by the county as determined by the county election board
97	93		conducting the countywide special or general election.
98	94		B. The election to determine whether a district shall be
99	95		established, and the not ice thereof, shall be conducted in the same
100	96		manner as other county or municipal questions. The notice shall
101	97		require the registered voters of the county to cast ballots which
102	98		contain the words:
103	99		1. "Landfill Utilization District - Yes"; and
104	100		2. "Landfill Utilization District - No",
105	101		or words equivalent thereto. All residents of the county or
106	102		municipality who are qualified electors shall be qualified to vote
107	103		on the proposition. The election shall be conducted in accordance
108	104		with the general or special electi on laws of the state, and the
109	105		regular election officials shall be in charge at the usual polling
110	106		place of each regular precinct, or part of a precinct, which shall
111	107		include lands within the boundaries of the county or municipality.
112	108		C. A landfill utilizati on district shall include all
113	109		territories located within the county or municipality.
114	110		D. There shall be levied an annual fee no greater than the
115	111		total of the immediately preceding annual operating expenses of any
116	112		county- or municipal-owned landfills located within the district
	113	+	when divided and equally levied on each property within the
	114	+	district.

146	141		E. The proceeds of the annual fee shall be used for the general
147	142		operations of any county- or municipal-owned landfill within the
148	143		district and for the utilization o f the landfill by the residents of
149	144		the district. The county or municipality shall not charge a fee for
150	145		use to a resident of the district.
151	146		F. As used in this section, "landfill" shall mean any site or
152	147		facility at which solid waste is disposed and issued a permit for
153	148		solid or hazardous waste disposal by the Department of Environmental
154	149		Quality pursuant to the Solid Waste Management Act.
155	150		SECTION 2. This act shall become effective November 1, 2021.
