55 | 52 | | BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: |

56 | 53 | | SECTION 1. NEW LAW A new section of law to be codified |
---|
57 | 54 | | in the Oklahoma Statutes as Section 3 -601 of Title 2, unless there |
---|
58 | 55 | | is created a duplication in numbering, reads as follows: |

59 | 56 | | A. This act shall be known and may be cited as the "Oklaho ma |
---|
60 | 57 | | Industrial Hemp Remediation Program". |
---|
61 | 58 | | B. As used in the Oklahoma Industrial Hemp Remediation Program, |
---|
62 | 59 | | the following words and terms, and any derivative of such words or |
---|
63 | 60 | | terms, shall have the following meanings, unless the context clearly |
---|
64 | 61 | | indicates otherwise: |
---|
94 | 90 | | indica and Cannabis ruderalis are subspecies thereof. Cannabis |
---|
95 | 91 | | refers to any form of the plant in which the delta -9 |
---|
96 | 92 | | tetrahydrocannabinol concentration on a dry -weight basis has not yet |
---|
97 | 93 | | been determined; |
---|
98 | 94 | | 2. "Certified laboratory" means the laboratory operated by the |
---|
99 | 95 | | Oklahoma Department of Agriculture, Food , and Forestry or a |
---|
100 | 96 | | laboratory located in Oklahoma that is certified by the Department; |
---|
101 | 97 | | 3. "Commercial sale" means the sale of a product in the stream |
---|
102 | 98 | | of commerce at retail, at wholesale or on the Internet ; |
---|
103 | 99 | | 4. "CSA" means the federal Controlled Substances Act ; |
---|
104 | 100 | | 5. "DEA" means the United States Drug Enforcement |
---|
105 | 101 | | Administration; |
---|
106 | 102 | | 6. "Department" means the Oklahoma Department of Agriculture, |
---|
107 | 103 | | Food, and Forestry; |
---|
108 | 104 | | 7. "Hemp" means the plant Cannabis sativa L. and any part of |
---|
109 | 105 | | such plant including, but not limited to, the seeds and all |
---|
110 | 106 | | derivatives, extracts, cannabinoids, isomers, ac ids, salts and salts |
---|
111 | 107 | | of isomers, whether growing or not, and grown from a certified seed |
---|
112 | 108 | | with a delta-9 tetrahydrocannabinol concentration of not more than |
---|
113 | 109 | | three-tenths of one percent (0.3%) on a dry -weight basis. Hemp and |
---|
114 | 110 | | hemp-derived cannabinoids, inclu ding cannabidiol, shall be |
---|
144 | 139 | | 8. "Hemp Program" means the Oklahoma Hemp Industrial Reform |
---|
145 | 140 | | Program and any final ruling from the USDA ; |
---|
146 | 141 | | 9. "Law enforcement" means any federal, state or local agencies |
---|
147 | 142 | | responsible for maintaining public order and enforcing the law ; |
---|
148 | 143 | | 10. "License" means the written authorization by the Department |
---|
149 | 144 | | for any person to grow, process, handle or transport certifi ed seeds |
---|
150 | 145 | | or hemp in this state ; |
---|
151 | 146 | | 11. "Person" means any natural person or any corporation, |
---|
152 | 147 | | general partnership, limited partnership, limited liability |
---|
153 | 148 | | partnership, limited liability company, trust, estate, charitable |
---|
154 | 149 | | organization, joint stock company, join t venture, association or any |
---|
155 | 150 | | other business or similar organization recognized by the state ; |
---|
156 | 151 | | 12. "Processor" means any person who is licensed by the |
---|
157 | 152 | | Department to process hemp in this state ; |
---|
158 | 153 | | 13. "State" means the State of Oklahoma ; |
---|
159 | 154 | | 14. "THC" means delt a-9 tetrahydrocannabinol, which is a |
---|
160 | 155 | | psychoactive component in cannabis plants ; |
---|
161 | 156 | | 15. "Tracking software" means software that is approved by the |
---|
162 | 157 | | Department and is capable of transparently tracking hemp in any |
---|
163 | 158 | | state or form whatsoever including, but not limi ted to, a certified |
---|
164 | 159 | | seed, any stage of growth, processing or handling, and any hemp |
---|
165 | 160 | | product; and |
---|
194 | 188 | | C. In the event that any hemp produced under the Hemp Program |
---|
195 | 189 | | is determined by testing results to be noncompliant with the Hemp |
---|
196 | 190 | | Program, the person holding the license for the noncompliant hemp |
---|
197 | 191 | | may request approval from the Department to remediate the |
---|
198 | 192 | | noncompliant hemp. |
---|
199 | 193 | | D. If the Department approves the remediation of the |
---|
200 | 194 | | noncompliant hemp, the per son holding the license shall promptly |
---|
201 | 195 | | have the noncompliant hemp extracted by a licensed processor into |
---|
202 | 196 | | concentrated form and the hemp concentrate shall be sampled by a |
---|
203 | 197 | | certified laboratory for compliance with USDA levels for THC in |
---|
204 | 198 | | concentrated form. |
---|
205 | 199 | | E. If the samples of the hemp concentrate are below USDA levels |
---|
206 | 200 | | for THC, the hemp concentrate shall be co mpliant as a hemp product |
---|
207 | 201 | | with the Hemp Program and may be used in commercial sales. |
---|
208 | 202 | | F. If the samples of the hemp concentrate are above the USDA |
---|
209 | 203 | | levels for THC, the hemp concentrate shall be noncompliant with the |
---|
210 | 204 | | Hemp Program and shall be destroyed in accordance with the CSA and |
---|
211 | 205 | | DEA regulations found at 21 CFR 1317.15 as enforced by federal, |
---|
212 | 206 | | state and local law enforcement. The person holding the licens e for |
---|
213 | 207 | | the noncompliant hemp concentrate shall promptly notify the |
---|
214 | 208 | | Department and USDA of its intent to destroy the noncompliant hemp |
---|
215 | 209 | | concentrate and verify destruction by submitting required |
---|
216 | 210 | | documentation using the tracking software. |
