40	40	An Act relating to schools; amending Section 2,
41	41	Chapter 272, O.S.L. 2019 (70 O.S. Supp. 2020, Section
42	42	5-200), which relates to educat ional management
43	43	organizations; subjecting certain public funds to
44	44	reporting and auditing requirements and procedures;
45	45	authorizing financial, program or compliance audits ;

52	52	BE IT ENACTED BY THE PEOPLE OF THE STAT E OF OKLAHOMA:
53	53	SECTION 1. AMENDATORY Section 2, Chapter 272, O.S.L.
54	54	2019 (70 O.S. Supp. 2020, Section 5 -200), is amended to read as
55	55	follows:
56	56	Section 5-200. A. As used in this section, "educational
57	57	management organization " means a for-profit or nonprofit
58	58	organization that receives public funds to provide administration
59	59	and management services for a charter school, statewide virtual
60	60	charter school or traditional public school.
61	61	B. A charter school that contracts with an educational
62	62	management organization shall use the Oklahoma Cost Accounting
63	63	System (OCAS) to report the total amount paid to an educational

90	90	management organization as well as itemized expenditure information
91	91	for the goods or services provided by the management organiz ation as
92	92	defined by OCAS expenditure codes, including the total compensation
93	93	package of the superintendent including the base salary, insurance,
94	94	retirement and other fringe benefits.
95	95	C. Any public funds, including, but not limited to, State Aid
96	96	allocations, other state-appropriated revenue or other county or
97	97	local monies, paid to an educational management organization for
98	98	public school functions shall be subject to the same reporting
99	99	requirements, financial audits, audit procedures and audit
100	100	requirements as a school district. The State Department of
101	101	Education or State Auditor and Inspector may conduct financial,
102	102	program or compliance audits.
103	103	D. Any owner of an educational management organization shall be
104	104	required to disclose to the governing board of the school in a
105	105	public meeting any ownership position in any business that contracts
106	106	or proposes to contract with the same public school that the
107	107	educational management organization is managing.
108	108	D. E. Whenever any person shall enter into a contract with any
109	109	school district or public charter school in the state to teach in
110	110	such school district or public charter school the contract shall be
111	111	binding on the teacher and on the board of education until the
112	112	teacher legally has been discharged from the teaching positi on or
113	113	released by the board of education from the contract. Except as

140	140	provided in Section 5 -106A of Title 70 of the Oklahoma Statutes this
141	141	title, until such teacher has been thus discharged or released, the
142	142	teacher shall not have authority to enter into a contract with any
143	143	other board of education in Oklahoma for the same time covered by
144	144	the original contract. If upon written complaint by the board of
145	145	education in a district any teacher is reported to have failed to
146	146	obey the terms of the contract previous ly made and to have entered
147	147	into a contract with another board of education, including a public
148	148	charter school board of education, without having been released from
149	149	the former contract except as provided in Section 5 -106A of Title 70
150	150	of the Oklahoma Statut es this title, the teacher, upon being found
151	151	to be employed full-time for another public school, including a
152	152	public charter school in the state, at a hearing held before the
153	153	State Board of Education, shall have such teacher 's certificate
154	154	suspended for the remainder of the term for which the contract was
155	155	made.
156	156	SECTION 2. This act shall become effective November 1, 2021.
