4040 An Act relating to schools; amending Section 2,
4141 Chapter 272, O.S.L. 2019 (70 O.S. Supp. 2020, Section
4242 5-200), which relates to educat ional management
4343 organizations; subjecting certain public funds to
4444 reporting and auditing requirements and procedures;

5252 BE IT ENACTED BY THE PEOPLE OF THE STAT E OF OKLAHOMA:
5353 SECTION 1. AMENDATORY Section 2, Chapter 272, O.S.L.
5454 2019 (70 O.S. Supp. 2020, Section 5 -200), is amended to read as
5555 follows:
5656 Section 5-200. A. As used in this section, "educational
5757 management organization " means a for-profit or nonprofit
5858 organization that receives public funds to provide administration
5959 and management services for a charter school, statewide virtual
6060 charter school or traditional public school.
6161 B. A charter school that contracts with an educational
6262 management organization shall use the Oklahoma Cost Accounting
6363 System (OCAS) to report the total amount paid to an educational

9090 management organization as well as itemized expenditure information
9191 for the goods or services provided by the management organiz ation as
9292 defined by OCAS expenditure codes, including the total compensation
9393 package of the superintendent including the base salary, insurance,
9494 retirement and other fringe benefits.
9595 C. Any public funds, including, but not limited to, State Aid
9696 allocations, other state-appropriated revenue or other county or
9797 local monies, paid to an educational management organization for
9898 public school functions shall be subject to the same reporting
9999 requirements, financial audits, audit procedures and audit
100100 requirements as a school district. The State Department of
101101 Education or State Auditor and Inspector may conduct financial,
102102 program or compliance audits.
103103 D. Any owner of an educational management organization shall be
104104 required to disclose to the governing board of the school in a
105105 public meeting any ownership position in any business that contracts
106106 or proposes to contract with the same public school that the
107107 educational management organization is managing.
108108 D. E. Whenever any person shall enter into a contract with any
109109 school district or public charter school in the state to teach in
110110 such school district or public charter school the contract shall be
111111 binding on the teacher and on the board of education until the
112112 teacher legally has been discharged from the teaching positi on or
113113 released by the board of education from the contract. Except as

140140 provided in Section 5 -106A of Title 70 of the Oklahoma Statutes this
141141 title, until such teacher has been thus discharged or released, the
142142 teacher shall not have authority to enter into a contract with any
143143 other board of education in Oklahoma for the same time covered by
144144 the original contract. If upon written complaint by the board of
145145 education in a district any teacher is reported to have failed to
146146 obey the terms of the contract previous ly made and to have entered
147147 into a contract with another board of education, including a public
148148 charter school board of education, without having been released from
149149 the former contract except as provided in Section 5 -106A of Title 70
150150 of the Oklahoma Statut es this title, the teacher, upon being found
151151 to be employed full-time for another public school, including a
152152 public charter school in the state, at a hearing held before the
153153 State Board of Education, shall have such teacher 's certificate
154154 suspended for the remainder of the term for which the contract was
155155 made.
156156 SECTION 2. This act shall become effective November 1, 2021.
