2859 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

3060 SECTION 1. AMENDATORY 2 O.S. 2011, Section 10 -9.7, as
3161 last amended by Section 5, Chapter 313, O.S.L. 2015 (2 O.S. Supp.
3262 2020, Section 10-9.7), is amended to read as follows:

4095 B. The criteria for Best Management Practices shall be
4196 promulgated by rules by the Board and shall include, but not be
4297 limited to, the following:

4498 1. There shall be no discharge of poultry waste to waters of

48101 drainage by covers, ditches, dikes, berms, terraces or o ther such

51103 3. No waters of the state shall come into direct contac t with
52104 the poultry confined on the poultry feeding operation;

54105 4. Poultry waste handling, treatment, management, and removal
55106 shall:

57107 a. not create an environmental or a public hea lth hazard,

59108 b. not result in the contamination of waters of the
60109 state, and

62110 c. conform to such other handling, treatment and
63111 management and removal requirements deemed necessary
64112 by the Oklahoma Department of Agriculture, Food, and
65113 Forestry to implement the Oklahoma Registered Poultry
66114 Feeding Operations Act and rules promulgated pursu ant
67115 thereto.

69116 The rules promulgated by the Board pursuant to this section
70117 shall provide for exceptions to the storage requirements for poultry
71118 waste in emergency situations. Such exceptions shall include but

73147 actions as are necessary to meet requirements imposed on a grower by
74148 an integrator. In such situations growers shall be required to take
75149 all actions feasible t o prevent pollution from stored poultry waste.

77150 C. Every poultry feeding opera tion shall have a Nutrient
78151 Management Plan which shall include at a minimum:

80152 1. A description of poultry waste handling procedures and
81153 availability of equipment and type of equi pment to be used;
82-
83154 2. The calculations and assumptions used for determining la nd-
84155 application rates if land application is applicable ;
85-
86156 3. All nutrient analysis data , for soil and poultry waste
87157 testing;
88-
89158 4. Legal description of lands to be used by an operat ion for
90159 land-application land application;

92160 5. Land-application rates of poult ry waste shall be based on
93161 the available nitrogen and phosphorous content of the poultry waste
94162 and shall provide controls for runoff and erosion as appropriate for
95163 site conditions;

97164 6. The procedures documented in the Nutrient Management Plan
98165 shall ensure that the handling and utilization of poultry waste
99166 complies with the following requirements:

101167 a. adequate poultry waste storage shall be provided
102168 consistent with rules promulgated by the Oklahoma

108200 Poultry waste shall not be applied to land when the
109201 ground is frozen except in conformance with the
110202 Nutrient Management Plan,

112203 c. poultry waste shall only be applied to suitable land
113204 at appropriate times and rates. Discharge or runoff
114205 of waste from the application site is prohibited.
115206 Timing and rate of applications shall be based on
116207 assimilation capacity of the soil profile, ass uming
117208 usual nutrient losses, expected precipitation, and
118209 soil conditions, and

120210 d. poultry waste application shall be prohibited on land
121211 subject to excessive erosion;

123212 7. Records shall be maintained of all poultry wastes applied on
124213 land owned or controlled b y the operator, and sold or given to other
125214 persons:

127215 a. if the poultry waste is sold or given to other persons
128216 for land application or other use, the poultry feeding
129217 operation shall maintain a log of: date of removal
130218 from the poultry feeding operation; name of recipient
131219 the poultry waste is sold or given to; and amount in

136250 the recipient any nutrient sample analysis from that
137251 year;

139252 8. Any analysis required by the provisions of the Oklahoma
140253 Registered Poultry Feeding Operations Act or rules promulgated
141254 thereto shall be performed by a qualified environmental testing
142255 laboratory certified by the Department of E nvironmental Quality and
143256 approved by the Oklahoma Department of Agriculture, Food, and
144257 Forestry; and
145-
146258 9. Such other information deemed necessary by the Oklahoma
147259 Department of Agriculture, Food, and Forestry to administer the
148260 provisions of the Oklahoma Regi stered Poultry Feeding Operations Act
149261 and rules promulgated pursuant thereto.

151262 D. 1. The Nutrient Management Plan for new or expanding
152263 poultry feeding operations submitted after the effective date of
153264 this act shall be prepared by the operator or designee of the
154265 operator.

156266 2. After the plan is submitted to the Oklahoma Department of
157267 Agriculture, Food, and Forestry may promulgate rules providing
158268 voluntary fees charged to register ed for review and approval if the
159269 Department determines that a submitted plan needs or requires any

160297 corrections or modifications, the Department shall return the
161298 Nutrient Management Plan to the operator for corrections.

163299 3. For a renewal, if the Departme nt determines the Nutrient
164-Management Plan needs or requires corrections or modification s, the

165301 Department shall make any and all appropriate corrections, approve
166302 the plan and notify the poultry feeding operations for the
167303 development and writing of Nutrient Management Plans; operation of
168304 the modifications.

170305 E. 1. Except as otherwise provided in this subsection, a
171306 Nutrient Management Plan for every poultry feeding operation shall
172307 be renewed and an updated plan shall be submitted to the Oklahoma
173308 Department of Agriculture, Food, and Forestry every six (6) years
174309 from the date the initial or previous plan was submitted.

176310 2. The operator shall have the option to submit the renewed or
177311 updated plan through the Department's website or a printable online
178312 form designed by the Department.

180313 3. A current operator may submit a one -page amendment to the
181314 most recently submitted plan in lieu of a renewal plan through the
182315 Department's website, if applicable. Poultry feeding operations
183316 submitting an amendment pursuant to this su bsection shall still be
184317 subject to the soil and poultry waste testing requirem ents under
185318 subsections F and G of this section. The amendment shall contain
186319 the following statements:

189348 occurred since the mo st recently submitted Nutrient

193351 housed since the most recently submitted Nutrient
194352 Management Plan,

196353 c. there has been no expansion in the poultry feeding
197354 operation since the most recently submitted Nutrient
198355 Management Plan, and

200356 d. the entirety of the poultry waste i s:

202-(1) removed off-site as provided in the poultry
357+(1) removed off site as provided in the poultry
203358 feeding operation's annual report, as required by
204359 subsection J of this section, and will continue
205-to be removed off-site for the next six (6)
360+to be removed off site for th e next six (6)

208362 (2) land-applied and will continue to be land -applied
209363 for the next six (6) years.

211364 F. Every poultry feeding operation located in a non -nutrient-
212365 limited watershed and non -nutrient-vulnerable groundwaters shall
213366 perform soil testing o n each land-application area and poultry waste
214367 testing at least once every thr ee (3) years to determine:

216368 1. Soil pH and plant -available nutrients including, at a
217369 minimum, nitrogen, phosphorous and potassium;
370+2. Poultry waste nutrient concentrations and m oisture; and

251448 H. I. 1. Poultry feeding operations shall develop a plan for
252449 the disposal of carcasses associated with normal mortality.

254450 2. In the event there is an outbreak of a major disease or
255451 other emergency resulting in deaths significantly higher than normal
256452 mortality rates, the Oklahoma Department of Agriculture, Food, and
257453 Forestry may approve, in writing, an alternate method of disposal of
258454 carcasses or the storage of poultry waste during the emergency
259455 period.

261456 I. J. Every poultry feeding operation shall file by September 1
262457 of each year an annual report with the Department regarding all
263458 poultry waste removed from or land -applied by the facility for the
264459 period from July 1 of the previous year through June 30 of that
265460 year. The report shall contain the following information:

267461 1. The date and amount of poultry waste removed from or land -
268462 applied at the facility;

270463 2. The type of poultry waste removed or land -applied, whether a
271464 cake out, full clean out, in -house windrow or compost, poultry waste
272465 stack shed, or other type;

274466 3. The county and, if applicable, the name of the Nutrient
275467 Limited Watershed where th e poultry waste was produced; and

277468 4. The location where the poultry waste is removed to:
