28	59		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

30	60		SECTION 1. AMENDATORY 2 O.S. 2011, Section 10 -9.7, as
31	61		last amended by Section 5, Chapter 313, O.S.L. 2015 (2 O.S. Supp.
32	62		2020, Section 10-9.7), is amended to read as follows:

34		-	Section 10-9.7 A. All poultry feeding operations shall utilize
35		-	Best Management Practices and shall meet the conditions and

40	95		B. The criteria for Best Management Practices shall be
41	96		promulgated by rules by the Board and shall include, but not be
42	97		limited to, the following:

44	98		1. There shall be no discharge of poultry waste to waters of
45	99		the state;

47	100		2. Stored poultry waste shall be isolated from outside surface
48	101		drainage by covers, ditches, dikes, berms, terraces or o ther such
49	102		structures;
50		-
51	103		3. No waters of the state shall come into direct contac t with
52	104		the poultry confined on the poultry feeding operation;
53		-
54	105		4. Poultry waste handling, treatment, management, and removal
55	106		shall:
56		-
57	107		a. not create an environmental or a public hea lth hazard,
58		-
59	108		b. not result in the contamination of waters of the
60	109		state, and
61		-
62	110		c. conform to such other handling, treatment and
63	111		management and removal requirements deemed necessary
64	112		by the Oklahoma Department of Agriculture, Food, and
65	113		Forestry to implement the Oklahoma Registered Poultry
66	114		Feeding Operations Act and rules promulgated pursu ant
67	115		thereto.

69	116		The rules promulgated by the Board pursuant to this section
70	117		shall provide for exceptions to the storage requirements for poultry
71	118		waste in emergency situations. Such exceptions shall include but

73	147		actions as are necessary to meet requirements imposed on a grower by
74	148		an integrator. In such situations growers shall be required to take
75	149		all actions feasible t o prevent pollution from stored poultry waste.

77	150		C. Every poultry feeding opera tion shall have a Nutrient
78	151		Management Plan which shall include at a minimum:
79		-
80	152		1. A description of poultry waste handling procedures and
81	153		availability of equipment and type of equi pment to be used;
82		-
83	154		2. The calculations and assumptions used for determining la nd-
84	155		application rates if land application is applicable ;
85		-
86	156		3. All nutrient analysis data , for soil and poultry waste
87	157		testing;
88		-
89	158		4. Legal description of lands to be used by an operat ion for
90	159		land-application land application;

92	160		5. Land-application rates of poult ry waste shall be based on
93	161		the available nitrogen and phosphorous content of the poultry waste
94	162		and shall provide controls for runoff and erosion as appropriate for
95	163		site conditions;

97	164		6. The procedures documented in the Nutrient Management Plan
98	165		shall ensure that the handling and utilization of poultry waste
99	166		complies with the following requirements:

101	167		a. adequate poultry waste storage shall be provided
102	168		consistent with rules promulgated by the Oklahoma

108	200		Poultry waste shall not be applied to land when the
109	201		ground is frozen except in conformance with the
110	202		Nutrient Management Plan,

112	203		c. poultry waste shall only be applied to suitable land
113	204		at appropriate times and rates. Discharge or runoff
114	205		of waste from the application site is prohibited.
115	206		Timing and rate of applications shall be based on
116	207		assimilation capacity of the soil profile, ass uming
117	208		usual nutrient losses, expected precipitation, and
118	209		soil conditions, and
119		-
120	210		d. poultry waste application shall be prohibited on land
121	211		subject to excessive erosion;
122		-
123	212		7. Records shall be maintained of all poultry wastes applied on
124	213		land owned or controlled b y the operator, and sold or given to other
125	214		persons:
126		-
127	215		a. if the poultry waste is sold or given to other persons
128	216		for land application or other use, the poultry feeding
129	217		operation shall maintain a log of: date of removal
130	218		from the poultry feeding operation; name of recipient
131	219		the poultry waste is sold or given to; and amount in

136	250		the recipient any nutrient sample analysis from that
137	251		year;

139	252		8. Any analysis required by the provisions of the Oklahoma
140	253		Registered Poultry Feeding Operations Act or rules promulgated
141	254		thereto shall be performed by a qualified environmental testing
142	255		laboratory certified by the Department of E nvironmental Quality and
143	256		approved by the Oklahoma Department of Agriculture, Food, and
144	257		Forestry; and
145		-
146	258		9. Such other information deemed necessary by the Oklahoma
147	259		Department of Agriculture, Food, and Forestry to administer the
148	260		provisions of the Oklahoma Regi stered Poultry Feeding Operations Act
149	261		and rules promulgated pursuant thereto.

151	262		D. 1. The Nutrient Management Plan for new or expanding
152	263		poultry feeding operations submitted after the effective date of
153	264		this act shall be prepared by the operator or designee of the
154	265		operator.
155		-
156	266		2. After the plan is submitted to the Oklahoma Department of
157	267		Agriculture, Food, and Forestry may promulgate rules providing
158	268		voluntary fees charged to register ed for review and approval if the
159	269		Department determines that a submitted plan needs or requires any

161	298		Nutrient Management Plan to the operator for corrections.

163	299		3. For a renewal, if the Departme nt determines the Nutrient
164		-	Management Plan needs or requires corrections or ~~modification s~~, the
	300	+	Management Plan needs or requires corrections or mo dification, the
165	301		Department shall make any and all appropriate corrections, approve
166	302		the plan and notify the poultry feeding operations for the
167	303		development and writing of Nutrient Management Plans; operation of
168	304		the modifications.

170	305		E. 1. Except as otherwise provided in this subsection, a
171	306		Nutrient Management Plan for every poultry feeding operation shall
172	307		be renewed and an updated plan shall be submitted to the Oklahoma
173	308		Department of Agriculture, Food, and Forestry every six (6) years
174	309		from the date the initial or previous plan was submitted.

176	310		2. The operator shall have the option to submit the renewed or
177	311		updated plan through the Department's website or a printable online
178	312		form designed by the Department.

180	313		3. A current operator may submit a one -page amendment to the
181	314		most recently submitted plan in lieu of a renewal plan through the
182	315		Department's website, if applicable. Poultry feeding operations
183	316		submitting an amendment pursuant to this su bsection shall still be
184	317		subject to the soil and poultry waste testing requirem ents under
185	318		subsections F and G of this section. The amendment shall contain

196	353		c. there has been no expansion in the poultry feeding
197	354		operation since the most recently submitted Nutrient
198	355		Management Plan, and

200	356		d. the entirety of the poultry waste i s:

202		-	(1) removed off-site as provided in the poultry
	357	+	(1) removed off site as provided in the poultry
203	358		feeding operation's annual report, as required by
204	359		subsection J of this section, and will continue
205		-	to be removed off-site for ~~the~~ next six (6)

209	363		for the next six (6) years.

211	364		F. Every poultry feeding operation located in a non -nutrient-
212	365		limited watershed and non -nutrient-vulnerable groundwaters shall
213	366		perform soil testing o n each land-application area and poultry waste
214	367		testing at least once every thr ee (3) years to determine:
215		-
216	368		1. Soil pH and plant -available nutrients including, at a
217	369		minimum, nitrogen, phosphorous and potassium;
	370	+	2. Poultry waste nutrient concentrations and m oisture; and

219		-	2. Poultry waste nutrient concentration s and moisture; and

229	405		application of the calendar year. Poultry waste testing shal l be
230	406		performed annually prior to the first application of the calendar
231	407		year. Soil and poultry waste testing shall be performed to
232	408		determine:

235	410		nitrogen, phosphorous and potassium;

237	411		2. Poultry waste nutrient concentrations and moisture; and

244	416		G. H. 1. Soil and poultry waste analysis data sh all be
245	417		retained by the poultry feeding operation for a minimum of six (6)
246	418		years.

248	419		2. All soil and poultry waste analysis data shall be dated
249	420		prior to land application.

251	448		H. I. 1. Poultry feeding operations shall develop a plan for
252	449		the disposal of carcasses associated with normal mortality.

254	450		2. In the event there is an outbreak of a major disease or
255	451		other emergency resulting in deaths significantly higher than normal
256	452		mortality rates, the Oklahoma Department of Agriculture, Food, and
257	453		Forestry may approve, in writing, an alternate method of disposal of
258	454		carcasses or the storage of poultry waste during the emergency
259	455		period.

261	456		I. J. Every poultry feeding operation shall file by September 1
262	457		of each year an annual report with the Department regarding all
263	458		poultry waste removed from or land -applied by the facility for the
264	459		period from July 1 of the previous year through June 30 of that
265	460		year. The report shall contain the following information:
266		-
267	461		1. The date and amount of poultry waste removed from or land -
268	462		applied at the facility;

270	463		2. The type of poultry waste removed or land -applied, whether a
271	464		cake out, full clean out, in -house windrow or compost, poultry waste
272	465		stack shed, or other type;

274	466		3. The county and, if applicable, the name of the Nutrient
275	467		Limited Watershed where th e poultry waste was produced; and
276		-
277	468		4. The location where the poultry waste is removed to:

279	469		a. if land-applied on site, provide the following:

281	470		(1) the date of the land-application land

310	517		of the hauler of the poultry waste.

312	518		SECTION 2. It being immediately necessary for the preservation
313		-	of the public peace, health or safety, an emergency is hereby ENR. H. B. NO. 1631 Page 8
