4040 An Act relating to agriculture; amending Section 1,

5858 BE IT ENACTED BY THE PEOPLE OF THE STATE O F OKLAHOMA:
5959 SECTION 1. AMENDATORY Section 1, Chapter 82, O.S.L. 2020
6060 (2 O.S. Supp. 2020, Section 6 -182.1), is amended to read as follows:
6161 Section 6-182.1 A. As used in this section, "intrastate
6262 processor" means a facility that p roduces meat food products or meat
6363 by-products from cattle or bison for wholesale or retail only within
6464 the State of Oklahoma. The facility processes no more than ten
6565 thousand head of cattle and bison in a calendar year. Mobile

9393 products from cattle or bison for wholesale or retail only within
9494 the State of Oklahoma may be considered an intrastate processor.
9595 B. All intrastate processors shall have a n Oklahoma Department
9696 of Agriculture, Food, a nd Forestry inspector, a contracte d
9797 Department certified inspector, or operating remote inspection
9898 capabilities present during the slaughtering, processing, or
9999 butchering of cattle or bison. All costs of inspections shall be
100100 paid by the processor. Proces sing facilities that slaughter mor e
101101 than ten thousand (10,000) head of cattle and bison in a calendar
102102 year shall pay for on site inspectors of the Department.
103103 C. Cooperative agreements may be facilitated by counties,
104104 municipalities, extensions services, i ntrastate processors, or
105105 livestock producers to pay the costs to retain a contract inspector
106106 as required in subsection B of this section.
107107 D. Persons who provide inspections of intrastate processors
108108 remotely or on-site for the Department and persons certi fied by the
109109 Department to provide contract inspections of intrastate processors
110110 shall:
111111 1. Possess the necessary qualifications required of the United
112112 States Department of Agriculture Food Safety and Inspection Service
113113 meat inspectors;
114114 2. Have ten (10) or more years of experience in meat processing
115115 and possess certification by a relevant food safety course provided
116116 by Oklahoma Career Tech or any university; or

143143 3. Possess a bachelor's degree in Animal Science or other
144144 related field approved by the Departme nt, and possess the American
145145 Meat Science Association Meat Evaluatio n Certification or complete
146146 the 20-day Basic Livestock Slaughter Inspection Training Course of
147147 United States Department of Agriculture Food Safety and Inspection,
148148 or other relevant trainin g certification approved by the De partment.
149149 E. Persons who meet the qualifications provided in subsection D
150150 of this section shall be certified by the Department to contract
151151 with intrastate processors to conduct in person inspections.
152152 F. Intrastate processers who utilize remote inspection s shall
153153 provide an uninterrupted video feed of each cattle or bison from
154154 their entry of the facility to the end of processing, except while
155155 the carcass is placed in cold storage.
156156 1. Multiple cameras with an accurate time stamp may be used to
157157 film the entirety of the process.
158158 2. Video provided of the cattle or bison before slaughter shall
159159 be high resolution and with enough lighting to show any
160160 discoloration, spots on the hide or any other known markers used by
161161 remote inspectors to identify illness or injur y and show the ability
162162 of the animal to walk under its own power without assistance.
163163 3. Video angles shall be shown that provide close footage of
164164 the hooves, mouth, nose, eyes, udders, hair and hide, and the whole
165165 of the body in a manner sufficient to all ow the remote inspector to
166166 determine a potential illness.

193193 4. Slaughtering of the animal shall be filmed in a manner
194194 sufficient to determine that it is conducted in compliance with
195195 humane slaughter regulations.
196196 5. There shall be available to the remote in spectors video of
197197 the processing of the carcass during suspension, exsanguination,
198198 hide removal, splitting, and evisceration from angles that may show
199199 multiple carcasses or processing operations, provided they are
200200 sufficient to determine compliance with re gulations.
201201 6. There shall be available to the remote inspectors video of
202202 the entire butchering process of the carcass from angles that may
203203 show multiple carcasses or butchering and processing operations,
204204 provided they are sufficient to determine complianc e with
205205 regulations.
206206 G. Intrastate processors shall provide the remote inspectors
207207 temperature readings of the carcass, processing rooms, and cold
208208 storage as required by regulations. Temperature readings provided
209209 shall be accompanied with an accurate time of measurement that is
210210 synchronized with the required video feed.
211211 H. All packaging of meat food products or meat by -products
212212 produced by intrastate processors shall have an attached label,
213213 prominently displayed, that stat es "Inspected by ODAFF only for sa le
214214 in Oklahoma." Labels shall include batch numbers that are provided
215215 to the Department.

242242 I. Intrastate processors may place a brand label on the package
243243 that is agreed upon by the intrastate processor and the livestock
244244 producer that provided the cattle o r bison.
245245 J. Upon approval by the United States Department of
246246 Agriculture, the Oklahoma Department of Agriculture, Food, and
247247 Forestry may establish additional standards for Oklahoma producers
248248 that market and sell beef and bison in intrastate commerce.
249249 B. K. The Department is authorized to promulgate rules
250250 regarding slaughter facilities that provide for the following:
251251 1. Establish additional standards that allow for flexibility in
252252 beef and bison inspection, including, but not limited to,
253253 establishing the number of inspectors at a facility and the use of
254254 technologies to digitally inspect meat;
255255 2. Establish additional standards for the labeling of beef and
256256 bison products sold intrastate;
257257 3. Establish additional standards for the number of head over
258258 which a facility shall pay for a state inspector; and
259259 4. Establish any other standards necessary to increase the
260260 ability of producers to market and sell beef and bison in intrastate
261261 commerce.
262262 C. L. Any rules promulgated pursuant to this section shall
263263 ensure that food safety will not be compromised in any way and will
264264 ensure that consumers are protected.
