44	44	information and links or forms; updating statutory
45	45	term; and providing an effective date.

52	52	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
53	53	SECTION 1. AMENDATORY 70 O.S. 2011, Section 1210.191, is
54	54	amended to read as follows:
55	55	Section 1210.191 A. No minor child shall be admitted to any
56	56	public, private, or parochial school operating in this state unless
57	57	and until certification is presented to the appropriate school
58	58	authorities from a licensed physician, or authorized representative
59	59	of the State Department of Health, that such child has received or
60	60	is in the process of receiving, immunizations against diphtheria,
61	61	pertussis, tetanus, haemophilus influenzae type B (HIB), measles
62	62	(rubeola), rubella, poliomyelitis, varicella , and hepatitis A or is
63	63	likely to be immune as a result of the disease.

90	90	B. Immunizations required, and the manner and frequency of
91	91	their administration, as prescribed by the State Board Commissioner
92	92	of Health, shall conform to recognized standard medical practices in
93	93	the state. The State Department of Health shall supervise and
94	94	secure the enforcement of the required immunization program. The
95	95	State Department of Education and the governing board s of the school
96	96	districts of this state shall render reasonable assistance to the
97	97	State Department of Health in the enforcement of the provisions
98	98	hereof.
99	99	C. The State Board of Health Commissioner, by rule, may alter
100	100	the list of immunizations required afte r notice and hearing. Any
101	101	change in the list of immunizations required shall be submitted to
102	102	the next regular session of the Legislature and such change shall
103	103	remain in force and effect unless and until a concurrent resolution
104	104	of disapproval is passed. H earings shall be conducted by the State
105	105	Board of Health Commissioner, or such officer, agents or employees
106	106	as the Board of Health Commissioner may designate for that purpose.
107	107	The State Board of Health Commissioner shall give appropriate notice
108	108	of the proposed change in the list of immunizations required and of
109	109	the time and place for hearing. The change shall become effective
110	110	on a date fixed by the State Board of Health Commissioner. Any
111	111	change in the list of immunizations required may be amended or
112	112	repealed in the same manner as provided for its adoption.

139	139	Proceedings pursuant to this subsection shall be governed by the
140	140	Administrative Procedures Act.
141	141	D. The State Department of Education and the governing boards
142	142	of the school districts of this state shall provide for release to
143	143	the Oklahoma Health Care Authority of the immunization records of
144	144	school children covered under Title XIX or Title XXI of the federal
145	145	Social Security Act who have not received the required immunizations
146	146	at the appropriate time. The information received pursuant to such
147	147	release shall be transmitted by the Oklahoma Health Care Authority
148	148	to medical providers who provide services to such children pursuant
149	149	to Title XIX or Title XXI to assist in their efforts to increase the
150	150	rate of childhood immunizations pursuant to the requirements of the
151	151	Early and Periodic Screening, Diagnosis and Treatment (EPSDT)
152	152	services provisions. The provisions of this subsection shall not be
153	153	construed to prohibit or affect the eligibility of any child to
154	154	receive benefits pursuant to Title XIX or Title XXI of the Social
155	155	Security Act or to require the immunization of any child if such
156	156	child is exempt from the immunization requirements pursuant to law.
157	157	The name of any child exempt from immunization pursuant to Sec tion
158	158	1210.192 of this title shall not be included in the information
159	159	transmitted pursuant to this subsection.
160	160	E. The State Department of Education shall provide, and ensure
161	161	that each school district in this state provides, on the school
162	162	district website and in any notice or publication provided to

190	190	regarding immunization requirements for school attendance : "For
191	191	school enrollment parent/guardians must provide one of the
192	192	following:
193	193	1. Current, up-to-date immunization records, or
194	194	2. A completed and signed exemption form.
195	195	The State Department of Health recommends following the
196	196	recommended immunization schedule. State law allows for exemptions
197	197	to the immunization schedule. For more informatio n about the
198	198	immunization schedule exemptions or to obtain an exemption form,
199	199	please visit www.ok.gov/health or call (405) 271-4073."
200	200	SECTION 2. This act shall become effective November 1, 2021.
