111111 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
112112 SECTION 1. AMENDATORY 63 O.S. 2011, Section 6102, is
113113 amended to read as follows:
114114 Section 6102. The Oklahoma Legislature finds that:
115115 1. Guided by principles of justice and anti discrimination, it
116116 is the duty of this state to act with fairness and tolerance towards
117117 individuals and groups during catastrophic health emergencies;
118118 2. The right of people to civil rights, liberty, bodily
119119 integrity and privacy must be respected and consistent with
120120 maintaining and preserving the health and security of the public
121121 during a catastrophic health emergency;
122122 3. The government must do more to protect the health, safety,
123123 and general well-being of its citizens during a catastrophic health
124124 emergency;
125125 2. 4. New and emerging dangers, including emergent and
126126 resurgent infectious diseases and incidents of civilian mass
127127 casualties, pose serious and immediate threats during a catastrophi c
128128 health emergency;

155155 3. 5. A renewed focus on the prevention, detecti on, management,
156156 and containment of catastrophic health emergencies is needed;
157157 4. 6. Catastrophic health emergency threats, including those
158158 caused by nuclear, biological or chemical event s, may require the
159159 exercise of extraordinary government powers and fu nctions;
160160 5. 7. This state must have the ability to respond, rapidly and
161161 effectively, to potential or actual catastrophic health emergencies;
162162 6. 8. The exercise of catastrophic health em ergency powers must
163163 promote the common good;
164164 7. 9. Catastrophic emergency health emergency powers must be
165165 grounded in a thorough scientific understanding of public health
166166 threats and disease transmission;
167167 8. Guided by principles of justice and antidiscri mination, it
168168 is the duty of this state to act with fairness and toler ance towards
169169 individuals and groups during catastrophic health emergencies;
170170 9. The rights of people to liberty, bodily integrity, and
171171 privacy must be respected to the fullest extent poss ible consistent
172172 with maintaining and preserving the health and securi ty of the
173173 public during a catastrophic health emergency;
174174 10. This act is necessary to protect the health and safety of
175175 the citizens of this state during a catastrophic health emergency;

206206 SECTION 2. AMENDATORY 63 O.S. 2011, Section 6103, is
207207 amended to read as f ollows:
208208 Section 6103. The purposes of the Catastrophic Health Emerge ncy
209209 Powers Act are:
210210 1. To ensure the civil rights and liberties of the citizens of
211211 this state while providing for their safety;
212212 2. To require the development of a comprehensive plan to
213213 provide for a coordinated, appropriate response in the event of a
214214 catastrophic health emergency;
215215 2. 3. To authorize the reporting and collection of data and
216216 records, the management of state property, the protection of
217217 persons, and access to communications during a catastrophic health
218218 emergency;
219219 3. 4. To facilitate the ear ly detection of a catastrophic
220220 health emergency, and allow for immediate investigation of such a
221221 catastrophic health emergency by granting access to health
222222 information of individuals unde r specified circumstances;
223223 4. 5. To grant state and local officials the authority during a
224224 catastrophic health emergency to provide care , treatment, and
225225 vaccination to persons who are interested in being vaccinated and to
226226 persons who are ill or who have b een exposed to transmissible

255255 5. 6. To ensure during a catastrophic health emergency that the
256256 needs of infected or exposed persons are properly a ddressed to the
257257 fullest extent possible, given the primary goal of co ntrolling
258258 serious health threats without unduly interfering with civil rights
259259 and liberties; and
260260 6. 7. To provide, during a catastrophic health emergency, state
261261 and local officials with the ability to prevent, detect, manage, and
262262 contain health threats wi thout unduly interfering with civil rights
263263 and liberties; and
264264 8. To provide the Governor , during a catastrophic health
265265 emergency, the power to grant local officials certain clearly
266266 defined authorities.
267267 SECTION 3. AMENDATORY 63 O. S. 2011, Section 6105, is
268268 amended to read as follows:
269269 Section 6105. A. There is hereby created the Oklahoma
270270 Catastrophic Health Emergency Planning Task Force. The purpose of
271271 the task force is to prepare a plan for responding to a catastrophic
272272 health emergency.
273273 B. The task force shall be comprised as follows:
274274 1. The cabinet secretary with responsibilities for health and
275275 human services, who shall serve as chair of the task force;
276276 2. The State Commissioner of Health or a designee;

353353 Governor;
354354 15. A person appointed by the Governor representing a statewide
355355 organization representing hospitals;
356356 16. A representative of the Oklahoma Nurses Asso ciation to be
357357 appointed by the Oklahoma Nurses Association; and
358358 17. A representative of the Oklahoma Psychological Association
359359 to be appointed by the Oklahoma Psychological Association ;
360360 18. The Director of the Department of Corrections or a
361361 designee;
362362 19. Two members of law enforcement, who shall be a county
363363 sheriff, chief of police of a municipality or other equivalent law
364364 enforcement officer having administrative responsibilities or a
365365 designee. One member shall be appointed by the Speaker of the House
366366 of Representatives and one member shall be appointed by the
367367 President Pro Tempore of the Senate;
368368 20. Two members from the private sector with expertise in
369369 disaster relief, one appointed by the Speaker of the House of
370370 Representatives and one appointed by t he President Pro Tempore of
371371 the Senate; and
372372 21. Four members from the private -sector business community,
373373 two appointed by the Speaker of the House of Representatives and two
374374 appointed by the President Pro Tempore of the Senate .

401401 C. Appointees shall serve at the pleasure of the appointing
402402 authority.
403403 D. No later than December 31, 2004 2021, the task force shall
404404 deliver a plan for responding to a catastrophic health emergency to
405405 the Governor, the President Pro Tempore of the State Senate, and the
406406 Speaker of the Oklahoma House of Representatives. The plan shall
407407 include provisions or guidelines for the following:
408408 1. Notification of and communication with the population during
409409 a catastrophic health emergency;
410410 2. Central coordination of resources, manpower, an d services,
411411 including coordination of responses by state, local, tribal, and
412412 federal agencies during a catastrophic health emergency;
413413 3. The location, procurement, storage, transportatio n,
414414 maintenance, and distribution of essential materials including, bu t
415415 not limited to, medical supplies, drugs, vaccines, food, shelter,
416416 clothing, and beds during a catastrophic health emergency;
417417 4. The role of law enforcement agencies in response to a
418418 catastrophic health emergency;
419419 5. The method of evacuating populations and housing and feeding
420420 evacuated populations during a catastrophic health emergency;
421421 6. The identification and training of health care providers to
422422 diagnose and treat persons with infe ctious disease during a
423423 catastrophic health emergency;

450450 7. The treatment of persons who have been exposed to or who are
451451 infected with diseases or health conditions that may be the cause of
452452 a catastrophic health emergency;
453453 8. The safe disposal of contamina ted wastes and human remains
454454 during a catastrophic health emergency;
455455 9. The safe and effective control of persons treated during a
456456 catastrophic health emergency;
457457 10. Tracking the source and outcomes of infected persons during
458458 a catastrophic health emerge ncy;
459459 11. Ensuring that during a catastrophic health emergency each
460460 city and county within the state identifies the following:
461461 a. sites where medical supplies, food, and other
462462 essentials can be distributed to the population,
463463 b. sites where public health an d emergency workers can be
464464 housed and fed, and
465465 c. routes and means of transportation of people and
466466 materials;
467467 12. The recognition of cultural norms, values, religious
468468 principles, and traditions that may be relevant during a
469469 catastrophic health emergency; and
470470 13. Other measures necessary to carry out the purposes of this
471471 act.

498498 E. The task force shall distribute this plan to those who will
499499 be responsible for its implementation, other interested persons and
500500 the public and seek their review and comments.
501501 F. The task force shall annually review its plan for responding
502502 to a catastrophic health emergency.
503503 G. Staff assistance for the task force shall be provided upon
504504 request by the chair of the task force by the agency or agencies
505505 determined to be appropriate by the chair.
506506 H. Members of the task force shall receive no compensati on for
507507 serving on the task force, but shall receive travel reimbursement as
508508 follows:
509509 1. Legislative members of the task force shall be reimbursed
510510 for their necessary travel expenses incu rred in the performance of
511511 their duties in accordance with Section 45 6 of Title 74 of the
512512 Oklahoma Statutes; and
513513 2. Nonlegislative members of the task force shall be reimbursed
514514 pursuant to the Oklahoma Travel Reimbursement Act by their employing
515515 or appointing agencies.
516516 SECTION 4. AMENDATORY 63 O.S . 2011, Section 6301, is
517517 amended to read as follows:
518518 Section 6301. A. The provisions of this section shall be
519519 contingent upon a specific executive order by the Governor
520520 activating the reporting requirements.

547547 B. A health care provider, coroner, or medica l examiner shall
548548 report all cases of persons who harbor any illness or health
549549 condition that may be potential cause of a catastrophic health
550550 emergency. Reportable illnesses and health co nditions include, but
551551 are not limited to, the diseases caused by the biological agents
552552 listed in 42 C.F.R., Section 72, app. A (2000) and any illnesses or
553553 health conditions identified by the public health authority.
554554 B. C. In addition to the foregoing requ irements for health care
555555 providers, a pharmacist shall report any unu sual or increased
556556 prescription rates, unusual types of prescriptions, or unusual
557557 trends in pharmacy visits that may be potential causes of a
558558 catastrophic health emergency. Prescription -related events that
559559 require a report include, but are not limited to:
560560 1. An unusual increase in the number of prescriptions or over -
561561 the-counter pharmaceuticals to treat conditions that the public
562562 health authority identifies through regulations;
563563 2. An unusual increase in the number of prescriptions for
564564 antibiotics; and
565565 3. Any prescription that treats a disease that is relatively
566566 uncommon or may be associated with bioterrorism.
567567 C. D. The report shall be made electronically or in writing
568568 within twenty-four (24) hours to the public health authority. The
569569 report shall include as much of the following information as is
570570 available: the specific illness or health condition that is the

597597 subject of the report; the name of the patient, date of birth, sex,
598598 race, occupation, and current home and work addresses, including
599599 city and county; the name and address of the health care provider,
600600 coroner, or medical examiner and of the reporting individual, if
601601 different; and any other information needed to locate the patient
602602 for follow-up. For cases related to animal or insect bites, the
603603 suspected locating information of the biting animal or insect, and
604604 the name and address of any known owner, shall be reported.
605605 D. E. Any animal case of a zoonotic disease that is suspected
606606 to be a bioterrorism event or associated with an outbreak shall be
607607 reported to the State Veterinarian. Appropriate clinical specimens
608608 will be required to be rapidly submitted for laboratory
609609 confirmation. The State Veterinarian or State Veterinary Diagnostic
610610 Laboratory Director or a designee will immediately report by
611611 telephone confirmed veterinary cases of public health importance to
612612 the State Department of Health.
613613 E. F. For the purposes of this section, "health care provider "
614614 shall include out-of-state medical laboratories, provided that the
615615 out-of-state laboratories have agr eed to the reporting requirements
616616 of this state. Results must be reported by the laboratory that
617617 performs the test, but an in -state laboratory that sends specimens
618618 to an out-of-state laboratory is also responsible for reporting
619619 results.

646646 F. G. The public health authority may enforce the provisions of
647647 this section in accordance with existing enforcement rules.
648648 SECTION 5. AMENDATORY 63 O.S. 2011, Section 6302, is
649649 amended to read as follows:
650650 Section 6302. A. The provisions of subse ction B of this
651651 section shall be contingent upon a specific executive order by the
652652 Governor activating the investigatory requirements.
653653 B. The public health authority shall ascertain the existence of
654654 cases of an illness or health condition that may be pote ntial causes
655655 of a catastrophic health emergency ;, investigate all such cases for
656656 sources of infection or contamination and to ensure that they are
657657 subject to proper control measures ;, and define the distribution of
658658 the illness or health condition. To fulf ill these duties, the
659659 public health authority shall identify exposed individuals as
660660 follows:
661661 1. Acting on information developed in accordance with Section 6
662662 6301 of this act title, or other reliable information, the public
663663 health authority shall identify all individuals thought to have been
664664 exposed to an illness or health condition that may be a potential
665665 cause of a catastrophic health emergency; and
666666 2. The public health authority shall counsel and interview such
667667 individuals where needed to assist in the positive identification of
668668 exposed individuals and develop information relating to the source
669669 and spread of the illness or health condition. Such information

697697 person from whom the illness or health condition may have been
698698 contracted and to whom the illness or health condition may have
699699 spread.
700700 B. C. The public health authority, for examination purposes,
701701 shall close, evacuate, or decontaminate any facility or
702702 decontaminate or destroy any materi al when the authority reasonably
703703 suspects that such facility or material may endanger the public
704704 health.
705705 C. D. The public health authority may enforce the provisions of
706706 this section in accordance with existing enforcement rules. An
707707 order of the public he alth authority given to effectuate the
708708 purposes of this section shall be enforceable immediately by the
709709 public safety authority.
710710 SECTION 6. AMENDATORY 63 O.S. 20 11, Section 6401, is
711711 amended to read as follows:
712712 Section 6401. A sta te of catastrophic health emergency may be
713713 declared by the Governor upon the occurrence of a "catastrophic
714714 health emergency" as defined in paragraph 2 of Section 4 6104 of
715715 this act title. Prior to such a declaration, the Governor shall
716716 consult with the public health authority and may consult with any
717717 additional public health or other experts as needed. The Governor
718718 shall notify the Speaker of the House of Representatives and the
719719 President Pro Tempore of the Senate of the powers being requested.

746746 SECTION 7. AMENDATORY 63 O.S. 2011, Section 6402, is
747747 amended to read as follows:
748748 Section 6402. A. A state of catastrophic health emergency
749749 shall be declared by an execut ive order that specifies:
750750 1. The nature of the catastrophic health e mergency;
751751 2. The political subdivisions or geographic areas subject to
752752 the declaration;
753753 3. The conditions that have brought about the catastrophic
754754 health emergency;
755755 4. The duration of the state of the catastrophic health
756756 emergency, if less than thirty ( 30) days; and
757757 5. The primary public health authority responding to the
758758 catastrophic health emergency.
759759 B. In the event of an extension of the duration of the state of
760760 the catastrophic health emergency, the Governor shall state the
761761 specific authorities he or she is requesting in the executive order.
762762 SECTION 8. AMENDATORY 63 O.S. 2011, Section 6403, is
763763 amended to read as follows:
764764 Section 6403. A. The declaration of a state of catastrophic
765765 health emergency shall activate the disast er response and recovery
766766 aspects of the state, local, and inter -jurisdictional disaster
767767 emergency plans in the affected political subdivisions or geographic
768768 areas. Such declaration autho rizes the deployment and use of any
769769 forces to which the plans apply a nd the use or distribution of any

796796 supplies, equipment, and materials and facilities assembled,
797797 stockpiled, or available pursuant to this act.
798798 B. During a state of catastrophic health eme rgency, the
799799 Governor may:
800800 1. Suspend the provisions of any regulator y statute prescribing
801801 procedures for conducting state business, or the orders and rules of
802802 any state agency, to the extent that strict compliance with the same
803803 would prevent, hinder, or d elay necessary action (including
804804 emergency purchases) by the public h ealth authority to respond to
805805 the catastrophic health emergency, or increase the health threat to
806806 the population;
807807 2. Utilize all available resources of the state government and
808808 its political subdivisions, as reasonably necessary , to respond to
809809 the catastrophic health emergency;
810810 3. Transfer the direction, personnel, or functions of state
811811 departments and agencies in order to perform or facilitate response
812812 and recovery programs regarding th e catastrophic health emergency;

815815 active duty shall state the purpose for which it is mobilized and

817817 5. Provide aid to and seek aid from other states during the
818818 catastrophic health emergency in accordance with any interstate
819819 emergency compact made with this state; and

847847 health emergency in accordance with federal programs or
848848 requirements.
849849 C. The public health authority shall coordinate all matters
850850 pertaining to the catastrophic health emergency response of the
851851 state. The public health authority shall have primary jurisdiction,
852852 responsibility, and authority for:
853853 1. Planning and executing catastrophic he alth emergency
854854 assessment, mitigation, preparedness response, and recovery for the
855855 state;
856856 2. Coordinating catastrophic health emergency response between
857857 state and local authorities durin g a catastrophic health emergency;
858858 3. Collaborating with relevant fe deral government authorities,
859859 elected officials of other states, private organizations or
860860 companies during a catastrophic health emergency;
861861 4. Coordinating recovery operations and mitiga tion initiatives
862862 subsequent to catastrophic health emergencies; and
863863 5. Organizing public information activities regarding
864864 catastrophic health emergency response operations.
865865 D. After the declaration of a state of catastrophic health
866866 emergency, special ide ntification for all public health personnel
867867 working during the catast rophic health emergency shall be issued as
868868 soon as possible. The identification shall indicate the authority
869869 of the bearer to exercise public health functions and emergency

897897 health personnel shall wear the identification in plain view.
898898 E. The Governor or a designee shall meet at a minimum twice per
899899 week with the House and Senate members of the Oklahoma Catastrophic
900900 Health Emergency Planning Task Force for the duration of the
901901 emergency to discuss actions that have been taken and actions that
902902 will be taken. The House and Senate task force members may report
903903 updates back to their respective chambers.
904904 SECTION 9. AMENDATORY 63 O.S. 2011, Section 6405, is
905905 amended to read as follows:
906906 Section 6405. A. The Governor shall terminate the declaration
907907 of a state of catastrophic health emergency by executive order upon
908908 finding that the occurrence of the conditio n that caused the
909909 catastrophic health emergency no longer poses a hig h probability of
910910 a large number of deaths in the affected population, a large number
911911 of incidents of serious permanent or long -term disability in the
912912 affected population, or a significant risk of substantial future
913913 harm to a large number of people in the a ffected population.
914914 B. Notwithstanding any other provision of the Catastrophic
915915 Health Emergency Powers Act, the declaration of a state of
916916 catastrophic health emergency shall be terminate d automatically
917917 after thirty (30) days unless renewed by the Governor under the same
918918 standards and procedures set forth in this act. Any such renewal
919919 shall also be terminated automatically after thirty (30) days unless

947947 forth in the Catastrophic Health Emer gency Powers Act.
948948 C. If the Governor declares a catastrophic health emergency,
949949 the State Legislature shall automatically be called into Special
950950 Session by call of the Governor at 8:00 a.m. 10:00 a.m. on the
951951 morning of the second business day following the date of such
952952 declaration for the purpose of concurring with or terminating the
953953 catastrophic health emergency. The State Legislature , by concurrent
954954 resolution, may terminate a state of c atastrophic health emergency
955955 at any time. Thereupon, the Governor sh all, by appropriate action ,
956956 end the state of catastrophic health emergency. Such termination by
957957 the State Legislature shall override any renewal by the Governor.
958958 D. All orders or legisl ative actions terminating the
959959 declaration of a state of catastrophic health emergency shall
960960 indicate the nature of the emergency, the area or areas threatened,
961961 and the conditions that make possible the termination of the
962962 declaration.
963963 SECTION 10. AMENDATORY 63 O.S. 2011, Section 6802, is
964964 amended to read as follows:
965965 Section 6802. A. During a catastrophic health emergency, the
966966 Governor may transfer from any fund available to the Governor in the
967967 State Treasury sums of money as may be necessary during a state of
968968 catastrophic health emergency.

995995 B. Monies so transferred shall be repaid to the fund from which
996996 they were transferred when monies become available for that purpose,
997997 by legislative appropriation or otherwise.
998998 C. A transfer of fu nds by the Governor under the provisions of
999999 this section may be made only when one or more of the following
10001000 conditions exist:
10011001 1. No appropriation or other authorization is available to meet
10021002 the catastrophic health emergency;
10031003 2. An appropriation is insuff icient to meet the catastrophic
10041004 health emergency; or
10051005 3. Federal monies available for such a catastrophic health
10061006 emergency require the use of state or other public monies.
10071007 D. All expenses incurred by the state during a state of
10081008 catastrophic health emergen cy shall be subject to the following
10091009 limitations:
10101010 1. No expense shall be incurred against the monies authorized
10111011 under this section, without the general approval of the Governor;
10121012 2. The aggregate amount of all expenses incurred pursuant to
10131013 this section shall not exceed Fifty Million Dollars ($50,000,000.00)
10141014 for any fiscal year; and
10151015 3. Monies authorized for a state of catastrophic health
10161016 emergency in prior fiscal years may be used in subsequent fiscal
10171017 years only for the catastrophic health emergency for wh ich they were
10181018 authorized. Monies authorized for a catastrophic healt h emergency

10501050 provided every ten (10) days to the Speaker of the House of
10511051 Representatives and the President Pro Tempore of the Senate .
10521052 SECTION 11. AMENDATORY 26 O.S. 2011, Section 2 -107, is
10531053 amended to read as follows:
10541054 Section 2-107. A. The Secretary of the State Election Board
10551055 shall be the administrative officer of the State Election Board and
10561056 shall have general supervisory au thority over county election boards
10571057 and shall have the authority to p rovide administrative supervision
10581058 to any county election board, as well as the authority to stand in
10591059 the place of the secretary of the county election board for the
10601060 purpose of employing c ounty election board personnel when a vacancy
10611061 exists in the office of the secretary of the county election board.
10621062 The Secretary shall have the authority to employ and fix the
10631063 salaries and duties of such personnel as may be necessary to perform
10641064 the duties of the State Election Board. The Secretary may
10651065 promulgate, repeal or modify such rules or regulations as the
10661066 Secretary deems necessary to facilitate and assist in achieving and
10671067 maintaining uniformity in the application, operation and
10681068 interpretation of the state and federal election laws and a maximum

10961096 of the election laws; provided, however, that such rules or
10971097 regulations, to be binding and effective, must have been officially
10981098 adopted by the Secretary of the State Election Board; the procedure
10991099 and adoption of such rules and regulations shall be subject to the
11001100 provisions of the Administrative Procedures Act. The Secretary
11011101 shall promote and encourage voter registration and voter
11021102 participation in elections. The Secretary shall be the chief state
11031103 election official responsible for coordination of state
11041104 responsibilities under the National Voter Registration Act of 1993
11051105 and under the Help America Vote Act of 2002. The Secretary shall
11061106 have the authority to implement programs for confirmation of voter
11071107 registration and for removal of ineligible voters in compliance with
11081108 general Oklahoma election law and requirements of the National Voter
11091109 Registration Act of 1993.
11101110 B. If the Catastrophic Health Emerg ency Powers Act has been
11111111 activated pursuant to an executive order, th e Secretary of the State
11121112 Election Board may promulgate emergency rules, which the Secretary
11131113 deems necessary to protect the public health while simultaneously
11141114 maintaining the integrity of the election process. Emergency rules
11151115 promulgated under this subsect ion shall not be subject to the
11161116 provisions of the Administrative Procedures Act and shall remain
11171117 effective unless disapproved by adoption of a concurrent resolution
11181118 by a constitutional ma jority of each chamber of the Legislature.
