40	40	An Act relating to emergency vehicles; amending 47

43	43	12-227), which relates to special restriction on
44	44	lamps; restricting the use of certain lamps; and

52	52	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
53	53	SECTION 1. AMENDATORY 47 O.S. 2011, Section 12 -227, as
54	54	amended by Section 2, Chapter 187, O.S.L. 2016 (47 O.S. Supp. 2020,
55	55	Section 12-227), is amended to read as follows:
56	56	Section 12-227. A. Any lighted lamp or illuminating device
57	57	upon a motor vehicle, other than headlam ps, spot lamps, auxiliary
58	58	driving lamps, flashing turn signals, vehicular hazard warning
59	59	lamps, authorized emergency vehicle lamps, snow removal and
60	60	construction and maintenance vehicle warning lamps, and school bus
61	61	and church bus warning lamps, which proj ects a beam of light of an
62	62	intensity greater than three hundred (300) candlepower shall be so
63	63	directed that no part of the high intensity portion of the beam will

90	90	strike the level of the roadway on which the vehicle stands at a
91	91	distance of more than sevent y-five (75) feet from the vehicle.
92	92	B. Except as provided in Sections 12 -218, 12-218.1, 12-228, and
93	93	12-229 of this title, no person shall drive or move any vehicle or
94	94	equipment upon any highway with any lamp or device thereon
95	95	displaying or capable of displ aying a red or blue light visible from
96	96	directly in front of the center thereof.
97	97	C. Flashing lights are prohibited except on:
98	98	1. An authorized emergency vehicle, as provided in Section 12 -
99	99	218 of this title;
100	100	2. A school bus or a church bus, as provided in Section 12-228
101	101	of this title;
102	102	3. Any snow-removal, construction and maintenance equipment, as
103	103	provided in Section 12 -229 of this title;
104	104	4. A wrecker or tow vehicle while at the scene of an emergency
105	105	or loading or unloading a vehicle in close proximity t o traffic as
106	106	needed for safety precautions or as a means of indicating the
107	107	presence of a vehicular traffic hazard requiring unusual care in
108	108	approaching, overtaking or passing, as provided in Section 12 -218.1
109	109	of this title;
110	110	5. Any vehicle as a means of ind icating a right or left turn,
111	111	as provided in Sections 12 -206.1 and 12-606 of this title;

138	138	6. Any vehicle as a means of indicating the presence of a
139	139	vehicular traffic hazard requiring unusual care in approaching,
140	140	overtaking or passing, as provided in Sectio n 12-220 of this title;
141	141	7. Any vehicle displaying side marker lamps which flash in
142	142	conjunction with turn signal lamps or vehicle hazard warning lamps,
143	143	as provided in Section 12 -220 of this title;
144	144	8. A farm tractor or an implement of husbandry, as provide d in
145	145	Section 12-215 of this title;
146	146	9. Any vehicle used while performing official duties as a rural
147	147	or contract route mail carrier of the United States Postal Service,
148	148	as provided in Section 12 -218.2 of this title; or
149	149	10. Any vehicle being used in the col lection of refuse, solid
150	150	waste or recyclables displaying side marker lamps which flash in
151	151	conjunction with turn signal lamps or vehicle hazard warning lamps
152	152	indicating the presence of a vehicular traffic hazard requiring
153	153	unusual care in approaching, overta king or passing, as provided in
154	154	Section 12-220 of this title.
155	155	D. Blue A combination of blue and red lights are prohibited
156	156	except as allowed in Sections 12 -218, 12-218.1, and 12-229 of this
157	157	title.
158	158	E. Any person violating the provisions of subsection B, C or D
159	159	of this section shall, upon conviction, be guilty of a misdemeanor
160	160	punishable by imprisonment in the county jail not exceeding six (6)
