4040 An Act relating to emergency vehicles; amending 47
4141 O.S. 2011, Section 12 -227, as amended by Section 2,
4242 Chapter 187, O.S.L. 2016 (47 O.S. Supp. 2020, Section
4343 12-227), which relates to special restriction on
4444 lamps; restricting the use of certain lamps; and
4545 providing an effective date .

5252 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5353 SECTION 1. AMENDATORY 47 O.S. 2011, Section 12 -227, as
5454 amended by Section 2, Chapter 187, O.S.L. 2016 (47 O.S. Supp. 2020,
5555 Section 12-227), is amended to read as follows:
5656 Section 12-227. A. Any lighted lamp or illuminating device
5757 upon a motor vehicle, other than headlam ps, spot lamps, auxiliary
5858 driving lamps, flashing turn signals, vehicular hazard warning
5959 lamps, authorized emergency vehicle lamps, snow removal and
6060 construction and maintenance vehicle warning lamps, and school bus
6161 and church bus warning lamps, which proj ects a beam of light of an
6262 intensity greater than three hundred (300) candlepower shall be so
6363 directed that no part of the high intensity portion of the beam will

9090 strike the level of the roadway on which the vehicle stands at a
9191 distance of more than sevent y-five (75) feet from the vehicle.
9292 B. Except as provided in Sections 12 -218, 12-218.1, 12-228, and
9393 12-229 of this title, no person shall drive or move any vehicle or
9494 equipment upon any highway with any lamp or device thereon
9595 displaying or capable of displ aying a red or blue light visible from
9696 directly in front of the center thereof.
9797 C. Flashing lights are prohibited except on:
9898 1. An authorized emergency vehicle, as provided in Section 12 -
9999 218 of this title;
100100 2. A school bus or a church bus, as provided in Section 12-228
101101 of this title;
102102 3. Any snow-removal, construction and maintenance equipment, as
103103 provided in Section 12 -229 of this title;
104104 4. A wrecker or tow vehicle while at the scene of an emergency
105105 or loading or unloading a vehicle in close proximity t o traffic as
106106 needed for safety precautions or as a means of indicating the
107107 presence of a vehicular traffic hazard requiring unusual care in
108108 approaching, overtaking or passing, as provided in Section 12 -218.1
109109 of this title;
110110 5. Any vehicle as a means of ind icating a right or left turn,
111111 as provided in Sections 12 -206.1 and 12-606 of this title;

138138 6. Any vehicle as a means of indicating the presence of a
139139 vehicular traffic hazard requiring unusual care in approaching,
140140 overtaking or passing, as provided in Sectio n 12-220 of this title;
141141 7. Any vehicle displaying side marker lamps which flash in
142142 conjunction with turn signal lamps or vehicle hazard warning lamps,
143143 as provided in Section 12 -220 of this title;
144144 8. A farm tractor or an implement of husbandry, as provide d in
145145 Section 12-215 of this title;
146146 9. Any vehicle used while performing official duties as a rural
147147 or contract route mail carrier of the United States Postal Service,
148148 as provided in Section 12 -218.2 of this title; or
149149 10. Any vehicle being used in the col lection of refuse, solid
150150 waste or recyclables displaying side marker lamps which flash in
151151 conjunction with turn signal lamps or vehicle hazard warning lamps
152152 indicating the presence of a vehicular traffic hazard requiring
153153 unusual care in approaching, overta king or passing, as provided in
154154 Section 12-220 of this title.
155155 D. Blue A combination of blue and red lights are prohibited
156156 except as allowed in Sections 12 -218, 12-218.1, and 12-229 of this
157157 title.
158158 E. Any person violating the provisions of subsection B, C or D
159159 of this section shall, upon conviction, be guilty of a misdemeanor
160160 punishable by imprisonment in the county jail not exceeding six (6)
