55 | 62 | SECTION 1. AMENDATORY 63 O.S. 2011, Section 1 -705, is | |

57 | 64 | Section 1-705. A. The State Board of Health, upon | |
58 | 65 | recommendation of the State Commissioner of Health and with the | |
59 | 66 | advice of the Oklahoma Hospital Advisory Council hereinafter | |
60 | 67 | provided for, shall promulgate rules and standards for the | |
61 | 68 | construction and operation of hospitals, for which licenses are | |
62 | - | required by the terms of this article, to provide for the proper | |
63 | - | care of patients. The promulgation of rules shall be subject to and | |

94 | 102 | shall, after receipt of such reports, take such act ion as deemed | |
95 | 103 | necessary by the Commission to have corrected any deficiencies or | |
96 | 104 | violations of the rules and standards of the Board shown in such | |
97 | 105 | reports. | |
98 | 106 | C. Hospitals licensed pursuant to the provisions of this | |
99 | 107 | article shall not be exempt from being inspe cted or licensed under | |
100 | 108 | laws relating to hotels, restaurants, lodging houses, boarding | |
101 | 109 | houses and places of refreshment. | |
102 | 110 | D. 1. Every hospital that offers or provides inpatient | |
103 | 111 | psychiatric or chemical dependency treatment services to persons | |
104 | 112 | eighteen (18) years of age or younger shall offer, provide or | |
105 | 113 | otherwise make available community -based programs and services and | |
106 | 114 | may make such programs and services available directly, through | |
107 | 115 | contract, or other appropriate means as determined by the State | |
108 | 116 | Department of Health. | |
109 | 117 | 2. For the purposes of this subsection the term "community- | |
110 | 118 | based services" shall have the same meaning as such term is defined | |
111 | 119 | by Section 1-1-105 of Title 10A of the Oklahoma Statutes. | |
