5461 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5562 SECTION 1. AMENDATORY 63 O.S. 2011, Section 1 -705, is
5663 amended to read as follows:
5764 Section 1-705. A. The State Board of Health, upon
5865 recommendation of the State Commissioner of Health and with the
5966 advice of the Oklahoma Hospital Advisory Council hereinafter
6067 provided for, shall promulgate rules and standards for the
6168 construction and operation of hospitals, for which licenses are
62-required by the terms of this article, to provide for the proper
63-care of patients. The promulgation of rules shall be subject to and
64-be governed by the provisions of the Administrative Procedures Act.

96+required by the terms of this article, to provide for the proper
97+care of patients. The promulgation of rules shall be subject to and
98+be governed by the provisions of the Administrativ e Procedures Act.
9199 B. Every hospital shall be periodically inspected by an
92100 authorized representative of the Commissioner. Reports of such
93101 inspections shall be on forms prescribed by the Commissioner, who
94102 shall, after receipt of such reports, take such act ion as deemed
95103 necessary by the Commission to have corrected any deficiencies or
96104 violations of the rules and standards of the Board shown in such
97105 reports.
98106 C. Hospitals licensed pursuant to the provisions of this
99107 article shall not be exempt from being inspe cted or licensed under
100108 laws relating to hotels, restaurants, lodging houses, boarding
101109 houses and places of refreshment.
102110 D. 1. Every hospital that offers or provides inpatient
103111 psychiatric or chemical dependency treatment services to persons
104112 eighteen (18) years of age or younger shall offer, provide or
105113 otherwise make available community -based programs and services and
106114 may make such programs and services available directly, through
107115 contract, or other appropriate means as determined by the State
108116 Department of Health.
109117 2. For the purposes of this subsection the term "community-
110118 based services" shall have the same meaning as such term is defined
111119 by Section 1-1-105 of Title 10A of the Oklahoma Statutes.
112-E. Every hospital emergency room shall provide information on

147+E. Every hospital emergency room shall provide information o n
148+available local substance abuse , addiction and mental health
140149 services to a person seeking help for his or her addiction or mental
141150 health care needs.
142151 F. The Department of Mental Health and Substance Abuse Services
143152 shall provide every hospital emergency r oom with the information on
144153 available local substance abuse and addiction services required by
145154 subsection E of this section.
146155 SECTION 2. This act shall become effective November 1, 202 1.
