54	61		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
55	62		SECTION 1. AMENDATORY 63 O.S. 2011, Section 1 -705, is
56	63		amended to read as follows:
57	64		Section 1-705. A. The State Board of Health, upon
58	65		recommendation of the State Commissioner of Health and with the
59	66		advice of the Oklahoma Hospital Advisory Council hereinafter
60	67		provided for, shall promulgate rules and standards for the
61	68		construction and operation of hospitals, for which licenses are
62		-	required by the terms of this article, to provide for the proper
63		-	care of patients. The promulgation of rules shall be subject to and
64		-	be governed by the provisions of the Administrative Procedures Act.

	96	+	required by the terms of this article, to provide for the proper
	97	+	care of patients. The promulgation of rules shall be subject to and
	98	+	be governed by the provisions of the Administrativ e Procedures Act.
91	99		B. Every hospital shall be periodically inspected by an
92	100		authorized representative of the Commissioner. Reports of such
93	101		inspections shall be on forms prescribed by the Commissioner, who
94	102		shall, after receipt of such reports, take such act ion as deemed
95	103		necessary by the Commission to have corrected any deficiencies or
96	104		violations of the rules and standards of the Board shown in such
97	105		reports.
98	106		C. Hospitals licensed pursuant to the provisions of this
99	107		article shall not be exempt from being inspe cted or licensed under
100	108		laws relating to hotels, restaurants, lodging houses, boarding
101	109		houses and places of refreshment.
102	110		D. 1. Every hospital that offers or provides inpatient
103	111		psychiatric or chemical dependency treatment services to persons
104	112		eighteen (18) years of age or younger shall offer, provide or
105	113		otherwise make available community -based programs and services and
106	114		may make such programs and services available directly, through
107	115		contract, or other appropriate means as determined by the State
108	116		Department of Health.
109	117		2. For the purposes of this subsection the term "community-
110	118		based services" shall have the same meaning as such term is defined
111	119		by Section 1-1-105 of Title 10A of the Oklahoma Statutes.
112		-	E. Every hospital emergency room shall provide information on
113		-	available local substance abuse , addiction and mental health

	147	+	E. Every hospital emergency room shall provide information o n
	148	+	available local substance abuse , addiction and mental health
140	149		services to a person seeking help for his or her addiction or mental
141	150		health care needs.
142	151		F. The Department of Mental Health and Substance Abuse Services
143	152		shall provide every hospital emergency r oom with the information on
144	153		available local substance abuse and addiction services required by
145	154		subsection E of this section.
146	155		SECTION 2. This act shall become effective November 1, 202 1.
